ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING CHAPTER 54/ARTICLE V/SECTION 54-190
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE
BUILDING LINES/NONSTANDARD STREET WIDTHS", TO
MODIFY THE WIDTH OF CERTAIN STREETS, AVENUES
AND PLACE IN THE OVERTOWN COMMUNITY, MIAMI,
FLORIDA; CONTAINING A REPEALER PROVISIONS AND
A SEVERABILITY CLAUSE, AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Article V of Chapter 54 of the Miami City Code
establishes base building line locations for all public streets
within the City of Miami; and
WHEREAS, the City Commission approved the Design Standards
and Guidelines for the Southeast Overtown/Park West Redevelopment
Project (the "Project") on March 21, 1985, which requires
numerous modifications to the base building line location within
the Project area; and
WHEREAS, Ordinance No. 10031, adopted September 12, 1985,
increased the zoned width of certain streets as transportation
corridors in the Project area to accommodate future vehicular and
pedestrian traffic anticipated by the Project; and
WHEREAS, since the adoption of the Design Standards and
Guidelines for the Project, the intensity of residential

development that was anticipated. and traffic demand through the
Overtown community has not increased to the level projected; and
WHEREAS, the City Commission in 1998 designated the area of
Northwest 3rd Avenue as the "Northwest 3rd Avenue Historic
Business Corridor"; and
WHEREAS, a number of projects are planned for the "Northwest
3rd Avenue Historic Business Corridor" and its impact areas such
as a new franchise, a job creation plaza, parking facilities and
a cultural and technology center that are negatively impacted by
the increased zoned width of certain streets in the Overtown
community; and
WHEREAS, the City administration has determined that the
current 50 foot width of the developed roadways designated as
transportation corridors adequately serves the present and future
needs of the public; and
WHEREAS, the Police, Fire -Rescue and Solid Waste Departments
have evaluated the effects of the reduction of the zoned street
width of the roadways in the Overtown community on their
operations and have no substantial objections;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference

thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Chapter 54/Article V/Section 54-190 of the
Code of the City of Miami, Florida, as amended, entitled "Streets
and Sidewalks/Base Building Lines/Nonstandard Street Widths" is
hereby amended in the following particularsY

Sec. 54-190. Nonstandard street widths.
Base building lines shall be located from the
centerline as specified for each of the following streets:

Section 3. All ordinances or'parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.21
This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.

It is respectfully recommended that the City Commission adopt the attached Ordinance amending
Chapter 54 of the Code of the City of Miami, Florida, entitled "Streets and Sidewalks" by
amending Section 54-190 entitled "Nonstandard Street Widths".
BACKGROUND
On March 21, 1985, the City Commission approved the Design Standards and Guidelines for the
Southeast Overtown/Park West Redevelopment Project. This project requires numerous
modifications to the base building line location within the project area. The City Commission
adopted Ordinance No. 10031 on September 12, 1985 which increased the zoned width of certain
streets within the project area in order to accommodate future vehicular and pedestrian traffic
anticipated by new development.
Since the adoption of the redevelopment project, conditions in the Park West area have not
materialized to allow the intensity of residential redevelopment that was anticipated and traffic
demand through the Overtown community will not be as high as previously stated in the
redevelopment plan. In 1998, the City Commission designated the area of NW 3 Avenue as the
"NW 3 Avenue Historic Business Corridor". A number of new projects are planned for the
business corridor such as a new franchise, a job creation plaza, parking facilities and a cultural
and technology center; however, they are negatively impacted by the increased zoned width of
certain streets in the Overtown community.
A majority of the original platted subdivisions that created these roads within the redevelopment
area dedicated a right of way width of 50 feet. The roads were subsequently developed with
pavement, curb and gutter and sidewalk conforming to the 50 foot wide right of way and many of
the structures on private property were constructed abutting the property line established by a 50
foot wide roadway. None of the additional reserved private property has been dedicated for street
purposes to the full 70 -foot or 75 -foot width. The Public Works Department's review of this
transportation corridor reveals that the current 50 foot wide developed roadway adequately serves
the transportation needs of the public.
The Police, Fire -Rescue. and Solid Waste Departments have been notified of the proposed
reduction of the zoned width of these roadways.
