ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION ESTABLISHING A NEW SPECIAL REVENUE
FUND ENTITLED: "SUMMER FOOD SERVICE PROGRAM
FOR CHILDREN 2000" AND APPROPRIATING FUNDS
FOR THE OPERATION OF SAME IN THE ESTIMATED
AMOUNT OF $431,814 CONSISTING OF A GRANT FROM
THE UNITED STATES DEPARTMENT OF AGRICULTURE
THROUGH THE FLORIDA DEPARTMENT OF EDUCATION;
AUTHORIZING THE CITY MANAGER TO ACCEPT THE
GRANT AWARD FROM THE UNITED STATES DEPARTMENT
OF AGRICULTURE AND TO EXECUTE THE NECESSARY
DOCUMENT(S), IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY;.CONTAINING A REPEALER PROVISION AND
A SEVERABILITY CLAUSE.
WHEREAS, the Department of Parks and Recreation of the City
of Miami sponsors a Summer Food Service Program for children
which provides nutritional meals in conjunction with its
comprehensive recreational programs; and
WHEREAS, the Florida Department of Education, Food and
Nutrition Management Division, with funding from the U.S.
Department of Agriculture ("USDA") grants funds in the estimated
amount of $431,814 to conduct a summer food service program from
June 19, 2000 through August 18, 2000 for children up to the age
of 18; and
WHEREAS, the grant for year 2000 is estimated to be $431,814
based year 1999 figures and reimbursement rates of $2.18 for
operational and actual lunch cost and $.1900 for administrative

costs, and $.50 for operational and actual supplement costs and
$0.050 for administrative costs of the program; and
WHEREAS, an estimated 149,850 lunches and 155,925
supplements will be served during the project period starting
June 19, 2000 and ending August 18, 2000; and
WHEREAS, an estimated amount of $431,814 will be received
from the State of Florida for implementation of the program;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and included
as if fully set forth in this Section.
Section 2. The following Special Revenue Fund is hereby
established and resources are hereby appropriated as follows:
FUND TITLE: Summer Food Service for Children -1999
RESOURCES: Grant Reimbursements from the U. S.
Department of Agriculture through
the Florida Department of Education.
$431,814
APPROPRIATION: Summer Food Service Program for
Children -1999 $431,814
Section 3. This appropriation is contingent upon
approval by the Florida Department of Education of the City's
application for the grant and the City Manager's acceptance.

Section 4. The City Manager is authorized" to accept
the grant from the United States Department of Agriculture,
through the Florida Department of Education and to execute all
the necessary documents(s) in a form acceptable to the City
Attorney.
Section 5. All Ordinances or parts of Ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 6. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 7. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required -purchases
of goods and supplies, and to generally carry on the functions
and duties of municipal affairs.
�i The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 8. The requirements of reading this Ordinance on
two separate days is hereby dispensed with an affirmative vote of
not less that four-fifths of the members of the Commission.
Section 9. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor./
PASSED AND ADOPTED BY TITLE ONLY this 25th day
of May , 2000.
If the Mayor does not sign this Ordinance, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission.

ENCLOSURES:
It is respectfully recommended that the City Commission adopt the
attached emergency ordinance to create a new Special Revenue Fund
and to appropriate grant funds in the estimated amount of $431,814,
to be received from the United States Department of Agriculture
(USDA) to conduct a summer food service program for youth' aged 18
and under from June 19,2000 through August 18, 2000.
BACKGROUND:
Each year since 1968, the Department of Parks and Recreation has
sponsored a Summer Food Service Program for children. Under this
program, the City provides nutritional meals in conjunction with
its comprehensive recreational program featuring arts and crafts,
sporting activities, field trips and special events. This year, we
plan to serve up to 3,300 lunches and 3,465 snacks per day using no
less than twenty-nine (29) sites throughout the City.
Based on 1999 program totals, we estimate that 149,850 lunches and
155,925 snacks will be served during the upcoming summer program.
These figures average out to 3,300 lunches and 3,465 snacks each
day for the 45 -day program. Funding is provided to the City from a
USDA grant through Florida's Department of Education. This year's
grant is estimated at $431,814 based on last year's meals figures
and reimbursement rates of $2.18 for lunch and $.50 for afternoon
supplements (snacks), as well as appropriate administrative
expenses. This rate will provide sufficient funds to cover the
meal cost and to hire the necessary temporary, part-time recreation
aides to operate the program. The final grant award amount will
be made available by Florida's Department of Education in May 2000.
This grant does not require matching funds.

This Ordinance is being presented as an emergency item because of
the need to meet the State of Florida established time constraints;
deadlines for contract execution; and to ensure that funds are in
place prior to the start of the Summer Program on June 19, 2000.
This item is companion to a resolution which would authorize the
purchase of food through a Metro Dade County bid.
