ORDINANCE•NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING CHAPTER 54/ARTICLE V/SECTION 54-190
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE
BUILDING LINES/NONSTANDARD STREET WIDTHS," TO
MODIFY THE WIDTH OF NORTHWEST 2ND AVENUE
BETWEEN.NORTHWEST 8TH STREET AND NORTHWEST 9TH
STREET, MIAMI, FLORIDA; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE, AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Article V of Chapter 54 of the Miami City Code
establishes base building line locations for all public streets
within the City of Miami; and
WHEREAS, Northwest 2nd Avenue between Northwest 8th Street
and Northwest 9th Street was originallydedicated as a 50 foot
wide roadway; and
WHEREAS, the zoned street width of this roadway was
increased.to 75 feet wide but has not been dedicated or developed,
to the 75 foot width; and
WHEREAS, the City Administration's review of this
transportation corridor reveals that the current 50 foot wide
developed roadway adequately serves the present and future
transportation needs of the public; and

WHEREAS, in order to preserve the historic Lyric Theater
which now encroaches into the undedicated portion of the public
right of way, the zoned street width of this section of Northwest
2nd Avenue would have to be reduced from 75 feet to 50 feet; and
WHEREAS, the Police,. Fire -Rescue and Solid Waste departments
have evaluated the effects of the reduction of the zoned street
width of this section of Northwest 2nd Avenue on their operations
and have no substantial objections;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2.Chapter 54/Article V/Section 54-190 of the Code of
the City of Miami, Florida, as amended, entitled "Streets and
Sidewalks/Base Building Lines/Nonstandard Street Widths," is

hereby amended in the following particulars'/
"CHAPTER 54
STREETS AND SIDEWALKS
ARTICLE V.BASE BUILDING LINES
Sec. 54-190. Nonstandard street widths.
Base building lines shall be located from the
centerline as specified for each of the following
streets:
Streets, Avenues, Roads Distance in Feet from

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or .in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.

It is respectfully recommended that the City Commission adopt the attached Ordinance
amending Chapter 54 of the Code of the City of Miami, Florida, entitled "Streets and
Sidewalks" by amending Section 54-190 entitled "Nonstandard Street Widths".
BACKGROUND
The remodeling and renovation of the Lyric Theater/Black Archives, a building approved
for historic preservation, includes the enlargement of the reception area to better serve
the public. The planned expansion of the reception area would be located on private
property behind the existing sidewalk on NW 2 Avenue, however, would encroach into
the undedicated zoned street right of way width. Representatives for the theater have
requested permission from the City to allow the expansion of the reception area into the
undedicated portion of the zoned right of way. This request prompted the Public works
Department to undertake a complete review to assess the necessity for continuing the
protection of the additional zoned street width for NW 2 Avenue between NW 8 Street
and NW 9 Street with the following results and recommendations.
A majority of the original platted subdivisions that created NW 2 Avenue within the
described limits dedicated a right of way width of 50 feet. The road was subsequently
developed with pavement, curb and gutter and sidewalk conforming to the 50 foot wide
right of way and many of the structures on private property were constructed abutting the
property line established by a 50 foot wide roadway. NW 2 Avenue is currently a fully
developed roadway.
As part of the adopted Southeast Overtown/Park West Redevelopment Plan, the City of
Miami Commission, by Ordinance, established a zoned base building line width of 75
feet for this roadway thereby reserving, for future roadway widening, additional property
in anticipation of intensified development.
None of the additional reserved private property has been dedicated for street purposes
to the full 75 -foot width. The Public Works Department's review of this transportation
corridor reveals that the current 50 foot wide developed roadway adequately serves the
transportation needs of the public and protects the Lyric Theater.

A public hearing will be held by the Commission of the City of Miami, Florida on April 27,
