AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING SECTION 6 OF ORDINANCE NO. 11705, AS AMENDED, AND ORDINANCE NO. 11839, TO REVISE A PREVIOUSLY APPROVED CAPITAL IMPROVEMENT PROJECT AND TO ADD A NEW CAPITAL IMPROVEMENT PROJECT TO BEGIN DURING FISCAL YEAR 1999-2000; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 11705, September 28, 1998, as amended, and Ordinance No. 11839, adopted September 28, 1999, which made appropriations relating to operational and budgetary requirements for Fiscal Years ending September 30, 1999, and September 30, 2000, revised ongoing Capital Improvement Projects and made appropriations for new projects scheduled to begin in Fiscal Year 1998-1999, and Fiscal Year 1999-2000; and WHEREAS, the pumps and motors in the City of Miami stdrmwater pumping station serving the Orange Bowl drainage district are frequently damaged by debris that enters the stormwater drainage system resulting in flooding in the residential neighborhood and commercial areas south of and surrounding the Orange Bowl Stadium; and 11918 1 0 0 WHEREAS, once damaged, the pumps and motors are expensive to repair and may be out of service for extended periods of time while being repaired; and WHEREAS, the stormwater pumping station is in urgent need of an automatic bar screen improvement that will protect the pumps and motors from damage; and WHEREAS, the City has been awarded grants for Capital Improvements at the stormwater pumping station from the Federal Emergency Management Agency (FEMA) and the State of Florida Department of Community Affairs for a new automatic bar screen, said grants requiring expenditures within specific time frames; and WHEREAS, it is necessary to revise existing capital project appropriations to reflect the new ,grants and/or reprogrammed funding; and WHEREAS, to meet time frame requirements for the projects, it is necessary to immediately appropriate the funds in their respective capital accounts; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Page 2 of 5 Section 2. Section 6 of Ordinance No. 11705, as amended, and Ordinance No. 11839, is hereby amended in the following particulars to revise a previously approved project and add a new project :1' v Section 6. The following appropriations are made for implementation of all municipal capital improvements of the City of Miami, Florida, including new capital improvement projects scheduled to begin during Fiscal Year 1998-1999. The appropriations which are designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriat ions of prior fund appropriations. The sources of revenues to support the appropriations are identified and being set .forth for seven program (I -VII) areas based upon use or functional category within said areas: The following appropriations in all Capital Projects are in the thousands of dollars. All ordinances or parts of ordinances insofar as they are in conflict with provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary purchases and payments and to generally carry on the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four-fifths of the members of the Commission. BACKGROUND The City Commission adopted Ordinance No. 11705 on September 28, 1999 , as amended, appropriating all on-going Capital Projects. The pumps and motors in the City of Miami stormwater pumping station serving the Orange Bowl drainage district are frequently damaged by debris that enters the stormwater drainage system resulting in flooding in the residential neighborhood and commercial areas south of and surrounding the Orange Bowl Stadium. Once these pumps and motors are damaged they are very expensive to repair and may be out of service for extended periods of time while being repaired. The pump station urgently needs an automatic bar screen to remove debris from the stormwater and protect the pumps and motors from damage. The City has been awarded grants for a new bar screen, from the Federal Emergency Management Agency (FEMA) and the State of Florida Department of Community Affairs, in the amounts of $225,000 and $37,500 respectively. It is now necessary to revise the existing Capital Project Appropriations to reflect the new grants and reprogrammed funding.
