AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 38/ARTICLE I, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "PARKS AND RECREATION/IN GENERAL", TO ESTABLISH A RENTAL RATE FOR NON-PROFIT ORGANIZATIONS SPONSORING FOUR OR MORE EVENTS DURING ONE FISCAL YEAR AT THE MANUEL ARTIME COMMUNITY CENTER; MORE PARTICULARLY BY AMENDING SECTION 38-8 OF SAID CODE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Manuel Artime Performing Arts Center serves the Little Havana neighborhood providing many non-profit organizations to present cultural, educational and community-based programs; and WHEREAS, the City Commission desires to establish a rental rate for non-profit organizations that sponsor four or more events during any one fiscal year at the Manuel Artime Performing Arts Center; NOW, THEREFORE,.BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11913 Section 1. The recitals and findings contained in the Preamble to this 'Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 38/Article I o.f the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:l/ "Chapter 38 PARKS AND RECREATION ARTICLE I. In General Sec. 38-8. Use of Manuel Artime Community Center. (a) Rates. Rates for the use of the following areas at the city facility known as the Manuel Artime Community Center are hereby established, which rates include normal janitorial service, air conditioning, normal houselights, and such other items that are available at the facility for use, but do not include event personnel or support services such as police officers, firefighters, ushering staff, ticket sellers, and ticket takers, stagehands, spotlight operators, sound and lighting technicians, musicians, projectionists, booth equipment and installing and dismantling electrical installations. The use rates established are as follows; however, nothing contained in the provision of this section shall limit or restrict the right of the city commission to establish and fix special charges or special terms and conditions for the use of the Manuel Artime Community Center of Little Havana: �i Words and/or figures stricken through shall be deleted. Page 2 of 4 11913 (5) Special Rates for Frequent Non -Profit Users: For those non profit organizations sponsoring four (4) or more events in one fiscal year the rate shall be four hundred ($400.00) dollars per event so long as the promoter, producer, sponsor, or organizer of the event is directiv and legally connected to said non-profit organization. (-56) Special Rates: In addition to those rates set forth herein, special rates or fee waivers may be approved by the city commission at the Manuel Artime Community Center facilities upon user request and recommendation by the administration. * *„ Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.21 PASSED ON FIRST READING BY TITLE ONLY this 9th day of March , 2000. BACKGROUND The Manuel Artime Performing Arts Center serves the Little Havana neighborhood by providing a setting for many non-profit organizations to present cultural, educational and community-based programs. The Department of Conferences, Conventions and Public Facilities recommends that a rental rate of Four Hundred ($400.00) Dollars be established for non-profit organizations who sponsor (4) or more events in one fiscal year at the Manuel Artime Performing Arts Center.
