ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING SECTION 5 OF ORDINANCE
NO. 11705, AS AMENDED, AND ORDINANCE
NO. 11839, BY REVISING PREVIOUSLY APPROVED
CAPITAL IMPROVEMENT PROJECTS; AND
ESTABLISHING NEW CAPITAL IMPROVEMENT PROJECTS
TO BEGIN DURING FY' 2000; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 11705, as
amended, and Ordinance No. 11839, establishing appropriations for
Capital Improvement Projects for Fiscal Year 1998-1999 and Fiscal
Year 1999-2000, respectively; and
WHEREAS, it is necessary to reprogram or increase
appropriations in previously approved Capital Improvement
Projects; and
WHEREAS, it is necessary to establish new capital
improvement projects to reflect new capital needs and funding
sources;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings in the Preamble to
this Ordinance are hereby adopted by reference thereto and
incorporated herein as if fully set forth in this Section.
Section 2. Section 6 of Ordinance No. 11705, as amended,
and Ordinance No. 11839 is hereby amended in the following
particulars to revise previously approved Projects and

establish new Projects to be initiated during Fiscal Year 1999-
2000 :1/
"Section 6. The following appropriations are made for
implementation of all municipal capital improvements- of the City
of Miami, Florida, including new capital improvement projects
scheduled to begin during Fiscal `Year 1998-1999. The
appropriations which are designated by reference to descriptive
project title and number also include appropriations for
previously approved scheduled projects as well as
reappropriations of prior fund appropriations. The sources of
revenues to support the appropriations are identified and being
set forth for seven eight program (I -VIII) areas based upon use
or functional category within said areas:

Section 3. All ordinances or parts of ordinances insofar
as they are in conflict with provisions of this Ordinance are
hereby repealed.

Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provision of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies and to generally carry on the functions and
duties of municipal affairs.
Section 6. The requirements of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four-fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon adoption and signature of the Mayor��.
If the Mayor does not sign this ordinance, it shall become effective at
the end of ten calendar days from the date it was passed and adopted. If
the Mayor vetoes this ordinance, it shall become effective immediately
upon override of the veto by the City Commission.

It is respectfully requested that the City Commission adopt the attached Emergency Ordinance
revising and establishing various Capital Projects.
BACKGROUND
The City Commission adopted Ordinance No. 11705 on September 28, 1998, as amended,
appropriating all on-going Capital Projects.
It is now necessary to reprogram or increase appropriations in Parks and Recreation, including
$500,000 for Hadley Park, Public Facilities and Fire -Rescue projects to meet unanticipated Capital
needs or to reflect additional funding sources.
Additionally, three new projects are being established and appropriated. Two of these projects,
"Miami River Dredging" and "Southwest 8t' Street Feasibility Study", will be funded with
Strategic Investments fund balance. The third project, "Disaster Recovery Coordination", will be
funded by pending FEMA and insurance reimbursements.
