ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING CHAPTER 2/ARTICLE IV.
DEPARTMENTS/DIVISION 9 OF THE CODE OF THE
CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED
"COMMUNITY DEVELOPMENT DEPARTMENT" TO REQUIRE
AN ADVERTISED PUBLIC HEARING TO BE HELD PRIOR
TO THE EXPENDITURE OF ANY STATE HOUSING
INITIATIVES PARTNERSHIP PROGRAM ("SHIP")
FUNDS; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, State Housing Initiatives Partnership Program
("SHIP") provides funds to eligible participating municipalities
for the development and implementation of a local housing
assistance plan created to make affordable residential units
available to persons of very low income, low income, or moderate
income and to persons who have special housing needs; and
WHEREAS; the expenditure of SHIP funds follows a
determination by the governing body of the municipality that the
purpose for the expenditure meets certain criteria; and
WHEREAS, the determination is made at a meeting which is
required to be open to the public but is not advertised as a
public hearing; and
WHEREAS, the City Commission deems it advisable and in the
best interest of the general welfare of the City of Miami and its
inhabitants to amend the Code of the City of Miami, Florida, to

provide for advertised public hearings prior to the expenditure
of any SHIP Program funds;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitalsand findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Chapter 2/Article IV. Departments/Division 9,
Sections 2-413, of the Code of the City of Miami, Florida, as
amended, is hereby amended in the following particulars:'/
"Chapter 2
ADMINISTRATION
ARTICLE IV. Departments
Division 9. Community Development
Sec. 2-413. Functions and duties of the department.
The functions and duties of the community
development department are to:
(1) Provide or cause to be developed
programs designed to identify and remove
physical, social, economic, employment
and cultural barriers which preclude
vulnerable persons from enhancing the
equality of their lives. .

(2) Provide_, recommendations for funding
and/or coordinate services to city
citizens and neighborhood -based
organizations of a social service,
economic or community development
nature, which funding may be allocated
after an advertised public hearing and
authorization by the city commission.
(3) Administer the community development
block grant and adult/youth job training
programs, recommend projects for funding
and coordinate the planning and
implementation of such projects which
funding may be allocated only after an
advertised public hearing and
authorization by the city commission.
(4) Establish, maintain, and administer
programs that will ensure grassroots
citizen participation.
The advertisements reauired by _Sections 2 and 3
above shall include the time, date, and place of the
meeting and a description of the proposed funding
allocation and shall be iublished in a newspaper of
general paid circulation in the City of Miami.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.

Section 6. This ordinance shall become effective thirty
(30) days after final reading and adoption thereof."
