AN ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "SAFE NEIGHBORHOOD PARKS PROGRAM CONSTRUCTION MANAGEMENT FUND"; APPROPRIATING FUNDS FOR ITS OPERATION IN THE TOTAL AMOUNT OF $235,000, CONSISTING OF A GRANT FROM MIAMI-DADE COUNTY THROUGH ITS OFFICE OF SAFE NEIGHBORHOOD PARKS; AND AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AWARD AND TO EXECUTE THE NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE TO CITY ATTORNEY, FOR SAID PURPOSE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Safe Neighborhood Parks Act of 1996 was approved by the citizens of Miami -Dade County to preserve, improve and restore park, beach and open space lands, senior centers, youth facilities, and recreation facilities for the benefit of current and future generations; and WHEREAS, in three years, the City of Miami through its Parks and Recreation Department, has received grants for capital projects totaling approximately $23 million from the Safe. Neighborhood Parks Program; and WHEREAS, in addition, the City applied and has been awarded the herein "Interest Earning Grant" to acquire assistance in the e 11903 construction management of the Safe Neighborhood Parks Bond capital projects. NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: "SAFE NEIGHBORHOOD PARKS PROGRAM CONSTRUCTION MANAGEMENT FUND" RESOURCES: MIAMI-DADE COUNTY, OFFICE OF SAFE NEIGHBORHOOD PARKS $235,000 APPROPRIATION: SAFE NEIGHBORHOOD PARKS PROGRAM CONSTRUCTION MANAGEMENT FUND $235,000 Section 3. The City Manager is hereby authorized' to accept the grant from Miami -Dade County and to execute all necessary document(s), in a form acceptable to the City Attorney, for this purpose. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provision of this Ordinance are hereby repealed. �i The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. If any section; part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not -be affected. Section 6. Management ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached Ordinance creating a new special revenue fund entitled "Safe Neighborhood Parks Program Construction Management Fund'' and appropriating funds for the program's operation in the amount of $235,000; consisting grant from the Miami -Dade County. through its office of Safe Neighborhood Parks. This Ordinance further authorizes the City Manager to execute the necessary documents in a form acceptable to the City Attorney, for this purpose. BACKGROUND: The Safe Neighborhood Parks Act of 1996 was approved in November by the citizens of Miami -Dade County to preserve, improve and restore park, beach and pen space lands, senior centers, youth facilities, and recreation facilities for the benefit of current and future generations. The City of Miami Parks and Recreation Department has in three (3) years submitted applications and received grants for capital projects totaling more than $23 million from this Program. In addition, we have received this grant, which is the subject of this Ordinance to assist us in the construction management of the Safe Neighborhood Parks Bond Program. 11903 Honorable Mayor and Members Of the City Commission Page two This grant will be used to either hire temporary staff or an outside firm to assist the City in the implementation of Safe Neighborhood Parks Bond projects in the following areas: • Construction Management-. the daily supervision of construction activities in the field (to be supervised by both the Public Works and Parks Department)., • Plans Processing- the coordination and implementation of the building plans review process (to be supervised by the Public Works Department). • Construction Procurement - the preparation of contract documents, pre-bid conferences and analysis of bid responses (to be supervised by the Public Works Department). It is therefore, recommended that the City Commission appr v^ the attached Ordinance in its entirety.
