AN ORDINANCE OF THE MIAMI CITY COMMISISON ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "SOLID WASTE REDUCTION RECYCLING AND EDUCATION (FY'00)" AND APPROPRIATING FUNDS FOR THE DEVELOPMENT AND IMPLEMENTATION OF SAME IN THE AMOUNT OF $265,147, CONSISTING OF TWO GRANTS FROM THE STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL REGULATION, A RECYCLING AND EDUCATION GRANT IN THE AMOUNT OF $174,155, AND A WASTE TIRE GRANT IN THE AMOUNT OF $90,992; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AWARDS AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO ACCEPT SAID GRANTS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the State of Florida enacted the 1988 Solid Waste Management Act (the "Act") which required that counties and cities, statewide, develop and implement recycling programs to achieve a statewide recycling mandate and achieve certain goals in accordance with Section 43.706(4) Florida Statutes, as amended; and WHEREAS, the City of Miami entered into an interlocal agreement with Miami -Dade County pursuant to Resolution No. 89-218 in which the City and other municipalities agreed to 11902 submit a joint grant application with Miami -Dade County to the State of Florida Department of Environmental Regulation (FDER) requesting funding for recycling and waste tire projects to assist in meeting Act goals and grant requirements; and WHEREAS, the FDER, in accordance with State of Florida Solid Waste Management Grant Rule No. 17-716, has approved the City of Miami and Miami -Dade County joint application for FY '00; and WHEREAS, the Miami -Dade County Board of Commissioners accepted the State of Florida Solid Waste Management grant award for FY '00, in the amount of approximately $4 million, on behalf of the County and participating municipalities and the County Manager executed the grant agreement; and WHEREAS, the City of Miami's portion of the grant funds is $265,147, and it is now appropriate to establish a special revenue fund in which to appropriate said grant funds; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. The following Special Revenue Fund is hereby established and resources are hereby appropriated as follows: Fund Title: Solid Waste Reduction: "Recycling and Education and Waste Tire (FY 100) Resources: State of Florida: $265,147 Department of Environmental Regulation: Solid Waste Management Recycling Program and Waste Tire Grants Appropriation: Solid Waste Reduction: $174,155 Recycling and Education (FY '00) Appropriation: Solid Waste Reduction: $ 90,992 Waste Tire (FY 100) Section 3. The City Manager is hereby authorizedZ' to execute the necessary documents, in a form acceptable to the City Attorney, to accept said grant and implement the programs. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this. Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Warshaw REFERENCES: City Manager ENCLOSURES: jAN L 6 2v0V FILE : RECYCLING APPROPRIATION ORDINANCE (FY'00) RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached appropriations ordinance establishing a Special Revenue Fund 'Entitled: "Solid Waste Reduction: Recycling and Education (FY'00)" in the amount of $265,147.00, consisting of a Recycling and Education Grant and Waste Tire Grant from the State of Florida Department of Environmental Regulation (FDER), pursuant to the 1988 Solid Waste Management Act, Section 403.7095 Florida Statute and FDER Grant Rule 17-716. BACKGROUND The City of Miami (City) currently has interlocal agreements with Miami -Dade County to allow for joint applications for two (2) State Grants. The grants are 1) The Recycling and Education Grant and 2) The Waste Tire Grant. As a municipal participant in an interlocal agreement by and between the City of Miami and Miami - Dade County, the City of Miami per Resolution No. 89-218 agreed to submit a joint grant application with Miami -Dade County and other municipalities in Miami -Dade County to the FDER in order to avoid a local match requirement per Section 403.7095 3(c) Florida Statute. On June 8, 1999, the Miami -Dade County Board of County Commissioners, per Recycling and Education Grant FY'99-'00 for Municipal Grant Allocations applied for and accepted on behalf of the County and those municipalities participating in the joint grant application, a grant award in the amount of approximately $4 million in grant funds from the State of Florida Solid Waste Management Grant Program for the funding of recycling and waste tire project; further providing authorization for execution of the grant contract (R-636-99), in substantially the attached form. Said grant agreement provides funding for recycling program operations and for recycling related educational and promotional purposes. According to the final grant statement and pursuant to FDER Grant Rule 17-716, only those expenditures incurred during the funding period will be funded. The method of payment for recycling program expenditures incurred by the City is based on monthly or quarterly requests for payment.
