ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING SECTIONS VI OF ORDINANCE
NO. 11705, ADOPTED SEPTEMBER 28, 1998, AS
AMENDED; REVISING PREVIOUSLY APPROVED CAPITAL
IMPROVEMENT PROJECTS IN THE PARKS AND
RECREATION AREA; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 11705,
September 28, 1998, as amended, establishing appropriations for
Capital Improvement Projects; and
WHEREAS, the City has been awarded several grants for
capital improvements at various city parks as identified herein;
and
WHEREAS, it is necessary to revise existing Capital Project
Appropriations to reflect the new grants;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference

thereto and incorporated herein as if fully set forth in this
Section.
Section 2., Section 6 of Ordinance No. 11705, adopted
September 28, 1998, as amended, is hereby amended in the
following particulars to revise previously approved projects:l/
"Section 6. The following appropriations are
made for implementation of all municipal capital
improvements of the City of Miami, Florida, including
new capital improvement projects scheduled to begin
during Fiscal Year 1998-1999. The appropriations which
are designated by reference to descriptive project
title and number also include appropriations for
previously approved scheduled projects as well as
reappropriations of prior fund appropriations. The
sources of revenues to support the appropriations are
identified and being set forth for seven program
(I -VII) areas based upon use or functional category
within said areas:

Section 3. All ordinances or parts of ordinances insofar•
as they. are in conflict with provisions of this Ordinance are
hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase -or word of this Ordinance is declared invalid, the
remaining provision of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies and to generally carry on the functions and
duties of municipal affairs.
Section 6. The requirements of reading this Ordinance on
two separate days is hereby dispensed with.by an affirmative vote
of not less than four-fifths of the members of the Commission.

RECOMMENDATION:
It is respectfully requested that the City Commission adopt the attached Emergency
Ordinance revising various Capital Projects.
BACKGROUND:
The City Commission adopted Ordinance No. 11705 on September 28, 1998, as
amended, appropriating all on-going Capital Projects.
On January 27, 2000, the City Commission passed'Resolution accepting grants for the
Parks and Recreation Department for Capital Improvement Projects from Series 99
Miami -Dade County Safe Neighborhood Park Bond Programs.
Additionally, the Department of Real Estate and Development has been awarded a grant
from the United States Economic Development Administration for infrastructure and boat
ramp improvements in Watson Island. The City Commission through Resolution No. 99-
890 accepted this grant.
The Emergency Ordinance is necessary to have the appropriations in place in the
respective capital accounts since time is of the utmost importance in implementing these
projects for the use of City of Miami residents.
