AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 2/ARTICLE III OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "ADMINISTRATION/OFFICERS" TO CREATE AND PROVIDE FOR THE APPOINTMENT OF CITY ADMINISTRATOR; MORE PARTICULARLY BY ADDING NEW DIVISION 5, SECTIONS 2'-161 AND 2-162, TO SAID CODE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 2/Article III of the Code of the City of Miami, Florida, as amended, entitled "ADMINISTRATION/OFFICERS," is hereby amended in the following particulars:l/ "Chapter 2 ADMINISTRATION Article III. Officers Secs. 2-144 -- 2-180 2-160. Reserved. �i Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. 11892 Division 5. City Administrator Sec. 2-161. Created; qualifications; restrictions; appointment; compensation; residency requirement. (a) Created. Effective upon the swearing in of the Mayor elected in March 2000, the position of "City Administrator" shall be created. (b) Qualifications and restrictions. The city administrator shall be qualified by administrative and executive experience and ability and shall: (1) be a graduate of an accredited college or university with a bachelors degree; and (2) have seven (7) years of responsible experience in government administration at the level of department head or assistant administrator; or any equivalent combination of training and experience as set forth in subsections (1) and (2) hereinabove. (c) Appointment; compensation. The Mayor shall have the authority to appoint, remove, or discharge the City Administrator. The appointment of the City Administrator shall be effective only after reporting such action to the City Commission in writing and at a public meeting. The Mayor may vacate the position of the City Administrator. The Mayor shall fix the compensation for the City Administrator. (d) Residency. The City Administrator shall reside within the City of Miami, or shall become a resident of the City of Miami within 180 days of his or her appointment as City Administrator, and must maintain an actual and real residence in the City of Miami for the duration of the appointment as Citv Administrator. Sec. 2-162. Powers and duties in general; attendance and participation at City Commission meetings. (a) Powers and duties in general. The City Administrator shall have those powers and duties delegated by the mayor so long as those powers may lawfully be delegated. The city administrator shall not have the power to veto anv action of the Citv Commission. 1892 Page 2 of 4 (b) Attendance and Participation at City Commission Meetings. It is in the best interest of the City of Miami that the city administrator attend all city commission meetings. Subject to the approval of the mayor the city administrator may: (1) attend and participate in the discussions of all meetings of the City Commission; (2) respond to City Commissioners fully and appropriately regarding any recommendations of the mayor. Secs. 2-163 -- 2-180. Reserved. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4.
