ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
ESTABLISHING A SPECIAL REVENUE FUND ENTITLED
"BULLETPROOF VEST PARTNERSHIP GRANT," AND
AUTHORIZING EXPENDITURES, IN THE AMOUNT OF
$14,000, CONSISTING OF A GRANT FROM THE U.S.
DEPARTMENT OF JUSTICE, OFFICE OF JUSTICE
PROGRAMS, BUREAU OF JUSTICE ASSISTANCE;
AUTHORIZING THE CITY MANAGER TO ACCEPT SAID
GRANT AND 'TO EXECUTE ALL NECESSARY
DOCUMENT(S), IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR THIS PURPOSE; CONTAINING A
REPEALER PROVISION AND SEVERABILITY CLAUSE.
WHEREAS, the Department of Police has been awarded a
"Bulletproof Vest Partnership" grant in the amount of $14,000
from the U.S. Department of Justice, Office of Justice Programs,
Bureau of Justice Assistance; and
WHEREAS, the Bulletproof Vest Partnership, Grant Act of 1998
("BVP") was enacted for the purpose of saving the lives of law
enforcement officers by assisting local governments in outfitting
law enforcement officers with armored vests; and
WHEREAS, the BVP Program reimburses up to 50% of the total
cost of each vest purchased that complies with the National
Institute of Justice's Standard 0101.03 Ballistic Resistance
of Police Body Armor; and

WHEREAS, the U.S. Department of Justice, Office of Justice
Programs, Bureau of Justice Assistance, has approved an initial
award in the amount of $14,000, reimbursement for vests already
purchased by the Police Department;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The following Special Revenue Fund is hereby
established and resources are hereby appropriated as described
herein:

RESOURCES: U.S. Department of Justice
Office of Justice Programs $14,000.00
Bureau of Justice Assistance
APPROPRIATIONS:
$14,000.00

Section 3. The City Manager is hereby authorized" to
accept the grant from the U.S. Department of Justice, Office of
Justice Programs, Bureau of Justice Assistance, and to execute
all necessary documents, in a form acceptable to the City
Attorney, for acceptance of the aforesaid monies for the
operation of said Program.
Section 4. All Ordinances or parts of Ordinances insofar
as they are inconsistent or. in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.'
The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.
This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted. If
the Mayor vetoes this Ordinance, it shall become effective immediately
upon override of the veto by the City Commission or upon the effective
date stated herein, whichever is later.

It is respectfully recommended that the City Commission adopt the attached. Ordinance which
establishes initial resources and initial appropriations for a Special Revenue Fund entitled:
"Bulletproof Vest Partnership (BVP) Grant," accepting a grant from the U.S. Department of
Justice, Office of Justice Programs, Bureau of Justice Assistance, in the amount of $14,000.00.
BACKGROUND
The Police Department has been awarded a grant, in the amount of $14,000, from the U.S.
Department of Justice, Office of Justice Programs, Bureau of Justice Assistance. The Bulletproof
Vest Partnership (BVP) Grant Act of 1998 was signed into law (Public Law 105-81), on June 16,
1998. The purpose of the Act is to save the lives of law enforcement officers by helping States and
units of local government and tribal government equip their law enforcement officers with armor
vests. The program reimburses up to 50% of the total cost for each vest purchased. Total cost
includes the price of the vest, shipping, handling, fitting charges, state and local taxes, if
applicable. This program only allows for the reimbursement of body armor that has been tested
and found to comply with the National Institute of Justice's (NIJ) Standard 0101.03 Ballistic
Resistance of Police Body Armor.
