ORDINANCE NO. 1
AN ORDINANCE OF THE MIAMI CITY COMMISSION
ESTABLISHING A SPECIAL REVENUE FUND ENTITLED,
"LOCAL LAW ENFORCEMENT BLOCK GRANT IV
PROGRAM" AND AUTHORIZING EXPENDITURES FOR ITS
OPERATION, IN THE AMOUNT OF $3,449,194,
CONSISTING OF A GRANT FROM THE U.S.
DEPARTMENT OF JUSTICE; PROVIDING FOR THE
APPROPRIATIONS TO SAID FUND OF INTEREST
EARNED FROM FISCAL YEAR 1999-2000 AND FISCAL
YEAR 2000-2001; AUTHORIZING THE CITY MANAGER
TO ACCEPT SAID GRANT AND TO EXECUTE ALL
NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, FOR THIS PURPOSE, AND
THE APPROPRIATION OF INTEREST FROM THE GRANT
MONIES; FURTHER AUTHORIZING THE ALLOCATION OF
MATCHING FUNDS, IN THE AMOUNT OF $383,244,
FROM THE POLICE DEPARTMENT GENERAL OPERATING
BUDGET, ACCOUNT CODE NO. 001000.290301.6.050;
CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE.
WHEREAS, the Department of Police received a grant in the
amount of $3,449,194 from the United States Department of
Justice, Local Law Enforcement Block Grant Program ("LLEBG"); and
WHEREAS, the purpose of LLEBG Program is to provide units of
local government with funds to underwrite projects to reduce
crime and improve public safety; and
WHEREAS, `"matching funds in the amount
required as a condition of said Grant;
of $383,244 are

WHEREAS, the required matching funds, in the amount of
$383,244, are available from the Police Department General
Operating Budget, Account Code No. 001000.290301.6.050; and
WHEREAS, any purchases must comply with applicable city code
procurement requirements;
NOW, THEREFORE, BE IT RESOLVED BY.THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as, if fully set forth in this
Section.
Section 2. The following Special Revenue Fund is hereby
established and resources are hereby appropriated as described
herein:

RESOURCES: U.S. Department of Justice $3,449,194.00
Police Department General
Operating Budget Matching Funds 383,244.00
APPROPRIATIONS: $3,832,438.00

Section 3. The City Manager is hereby authorized" to
accept the grant from the U.S. Department of Justice and interest
earned from the grant monies as set forth in the Preamble to this
Ordinance and to execute all necessary document(s), in a form
acceptable to the City Attorney, for acceptance of the aforesaid
monies for the operation of said Program.
Section 4. The required matching funds in the amount of
$383,244, are hereby allocated from the Police Department General
Operating Budget, Account Code No. 001000.290301.6.050.
Section 5. All Ordinances or parts of Ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 6. I.f any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
i� The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted. If
the Mayor vetoes this Ordinance, it shall become effective immediately

date stated herein, whichever is later.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Ordinance which
establishes initial resources and initial appropriations entitled: "Local Law Enforcement Block
Grant (LLEBG) IV Program" accepting a grant from the U.S. Department of Justice, in the amount
of $3,449,194.00 and allocating a required cash match in the amount of $383,244.00, from the
Police Department General Operating Budget, Account Code No. 001000.290301.6.050.
BACKGROUND
The Local Law Enforcement Block Grant Program is administered by the U.S. Department of
Justice, Bureau of Justice Assistance (BJA).. The Miami Police Department is eligible for
$3,449,194.00 in funding during fiscal year 1999-2000. The City of Miami is required to provide a
cash match in the amount of $3 83,244.00.
The purpose of this grant is to fund local governments to underwrite projects to reduce crime,
improve public safety, and start or expand crime prevention programs. The LLEBG Program
allows jurisdictions to find criminal justice initiatives in the following seven purpose areas: 1)
supporting law enforcement, 2) enhancing security measures, 3) establishing or supporting drug
courts, 4) enhancing the adjudication of cases involving violent offenders, 5) establishing
multijurisdictional task forces, 6) establishing community crime prevention programs, and 7)
indemnification insurance. .
These funds will be utilized by the Police Department to purchase new equipment. Application
requirements include a non-binding review by an Advisory Board, which has already been done.
Also required is a public hearing regarding the proposed use of said funds.

again request that the Dade -Miami Criminal Justice Council serve as its designated Advisory
Board for reviewing the application and making non-binding recommendations. As the City of
Miami's designated Advisory Board, it is requested that you take the necessary steps to include a
review of the grant on your agenda for the next available meeting. Assistant Chief Raymond
Martinez will be in attendance to answer any questions you may have regarding this matter.
The Miami Police Department anticipates the funding will be used for the following:
All of the funding from the 1999 Law Enforcement Block Grant would be utilized for the
purchase of new equipment. Total - $3,449,194

The Omnibus Fiscal Year 1999 Appropriations Act, Public Law 105-277, provides funds
'for the implementation of the LLEBG Program, to be administered by BJA, U.S.
Department of Justice. The purpose of the LLEBG Program is to Provide units of local
government with funds to underwrite projects to reduce crime and improve public safety.
The LLEBG Program allows jurisdictions to find criminal justice initiatives in the
following seven purpose areas: supporting law enforcement; enhancing security measures;
establishing or supporting drug courts; enhancing the adjudication of cases involving
violent offenders; establishing multijurisdictional task forces; establishing community
crime prevention programs; and indemnification insurance.

Application
The LLEBG Trust Fund Requirement
All direct LLEBG recipients and State subrecipients must establish a trust fund in which to
deposit LLEBG program funding. For purposes of the LLEBG Program,.a trust fund is
defined as an account that is specifically designated for this program. The trust fund may or
may not be an interest bearing account; regardless of the type of account selected, the trust
fund must protect the principal. Only allowable program expenses may paid from this
account. This fund may not be used to pay debts incurred by other activities beyond the
scope of the LLEBG program. The trust fund.inust be established by the recipient
jurisdiction, not by the implementing agencylies. In other words, in -the case of a city award,
the city manager or mayor's office must establish the trust fund, not the police department. In
some jurisdictions the term "Special Revenue Fund" inay denote the same attributes as the
definition for trust fund under the LLEBG Program.
A LLEBG recipient's LLEBG trust fund must include the following four features:
1. The fund may earn interest, but any earned interest must be used for. program purposes.
[The trust fund does not have to be an interest bearing fund.]
2. The recipient must be able to account for the Federal, award amount. -
3. The recipient must be able to account for the local match amount.
4. The recipient must be able to account for any interest earned.
