AN ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A SPECIAL REVENUE FUND ENTITLED "CITY OF MIAMI PROGRAMS FOR PERSONS WITH DISABILITIES MIAMI-DADE COUNTY ADA GRANT" AND APPROPRIATING FUNDS FOR ITS OPERATION IN THE AMOUNTS OF: $58,878 FROM 1996-1997 GRANT FUND; $61,038.61 FROM 1997-1998 GRANT FUND; AND $51,783.39 FROM 1998-1999 GRANT FUND, FROM MIAMI-DADE COUNTY, OFFICE OF AMERICANS WITH DISABILITIES ACT ("ADA") COORDINATION; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AWARDS AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CAUSE. WHEREAS, Section 316.1967 Florida Statutes and Section 30-447, Code of Miami -Dade County, Florida, ("County Code") authorize fines to be charged for misuse of specially marked parking spaces for people with disabilities; and WHEREAS, revenues from said fines shall be distributed by Miami -Dade County in accordance with the provisions of Section 30-447 of the County Code; and WHEREAS, pursuant to the fine revenue distribution pattern, Miami -Dade .County awarded the.City of Miami, Department of Parks and Recreation, Program for Persons with Disabilities, three grants described as follows: (1) in the amount. of $51,783.39 from 1998 - 1999 program funds to engage a certified therapeutic 11882 recreation specialist, at a cost of $42,630, and to expand the existing handicapped accessible walkway system at Merrie Christmas Park at a cost of $9,153, (2) in the amount of $61,038.61 from 1997-1998 program funds to engage a certified therapeutic recreation specialist ($38,351) and to install a new larger handicapped accessible playground structure at Kinloch Park ($22,687), and (3) in the amount of $58,878 from 1996-1997 program funds for the design and construction of a wheelchair accessible trail at Simpson Park; and NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals, and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Fund is hereby established as described herein: FUND TITLE: City of Miami Programs for Persons with Disabilities ADA Grant Account RESOURCES: Miami -Dade County, Office of ADA Coordination -Fine Revenues from Specially Marked Parking Spaces for People with Disabilities 1996-1997 Program Funds $58,878.00 1997-1998 Program Funds 61,038.61 1998-1999 Program Funds 51,783.39 $171,700.00 APPROPRIATION: City of Miami Programs for Persons with Disabilities ADA Grant Account $171,700.00 Section 3. All Ordinances or parts of Ordinance insofar 11882 2 as they are inconsistent or in conflict with the provision of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments, and to generally carry out the functions and duties of municipal affairs. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by a vote of not less than four-fifths of the members of the Commission. Section 7. The Ordinance also authorizes the City Manager to accept said grant award and to execute the necessary documents, in a form acceptable to the City Attorney. BACKGROUND: Section 316.1967 of the Florida Statues and Section 30-447, Code of Miami -Dade County authorizes the charging of fines for misuse of specially marked parking spaces for people with disabilities. Miami -Dade County in conformance with the distribution 'provisions of said fine revenues, has awarded the City of Miami three (3) grants in the amounts specified as follows: $58,878 from 1996-97 Grant funds; $61,038.61 from 1997-98 Grant funds and $51,783.39 from 1998-99 Grant funds to build handicapped accessible public improvements at three (3) City parks and provide service to meet the needs of persons with physical disabilities. These parks are: Merrie Christmas, Kinloch and Simpson Parks. This is a companion item to a Resolution authorizing the acceptance of these grants.
