ORDINANCE NO. (�
AN ORDINANCE OF THE MIAMI CITY COMISSION
AMENDING CHAPTER 38/ARTICLE I, OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED,
ENTITLED "PARKS AND RECREATION/IN GENERAL",
TO ESTABLISH FLAT RATES AND CHANGING CERTAIN
CONFERENCE ROOMS TO RENTAL OFFICE SPACE AT
THE MANUEL ARTIME COMMUNITY CENTER; MORE
PARTICULARLY BY AMENDING SECTION 38-8;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission desires to change the existing
rates for use of the Manuel Artime Performing Arts Center ("the
Center") to meet the cost of maintenance; and
WHEREAS, certain conference rooms will be changed to rental
office space, and charges made accordingly to meet the rising
cost of maintenance of the Center;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference

thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Chapter 38/Article I/Section 38-8, of the
Code of the City of Miami, Florida, as amended, is hereby amended
in the following particulars:l/
"Chapter 38
PARKS AND RECREATION
ARTICLE I. In General
Seca 38-8. Use of Manuel Artime Community Center.
(a)' Rates. Rates for the use of the following
areas at the city facility known as the Manuel
Artime Community Center are hereby established,
which rates include normal janitorial service, air
conditioning, normal houselights, and such other
items that are available at the facility for use,
but do not include event personnel or support
services such as police officers, firefighters,
ushering staff, ticket sellers, and ticket takers,
stagehands, spotlight operators, sound and
lighting technicians, musicians, projectionists,
booth equipment and installing and dismantling

specified fee plus ten pereent ef- ticket sales.
The use rates established are as follows; however,
nothing contained in the provision of this section
shall limit or restrict the right of the city
commission to establish and fix special charges or
special terms and conditions for the use of the
Manuel Artime Community Center of Little Havana:
(1) Building A (900 S. W. First Street) :
(a) Manuel Artime Performing Arts Center:

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.

Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid; the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.!'

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Ordinance amending
Section 38-8 of the Code of the City of Miami by establishing a flat rate for the use of the Manuel
Artime Performing Arts Center, and charging rental office space rates for certain meeting rooms at
the Manuel Artime Community Center.
BACKGROUND
The Department of Conferences, Conventions and Public Facilities recommends that a flat rate be
established for the use of the Manuel Artime Performing Arts Center. Additionally, it is
recommended that certain meeting rooms at the Manuel Artime Community Center be changed to
rental office space, with those appropriate rates. These rate changes will allow the maintenance
costs currently paid by the facility to be incorporated in the rates charged to users.
