AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE BUILDING LINES/NONSTANDARD STREET WIDTHS," TO MODIFY THE WIDTH OF NORTHEAST 12TH STREET BETWEEN NORTHEAST BISCAYNE BOULEVARD AND NORTHEAST 2ND AVENUE, MIAMI, FLORIDA; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article V of Chapter 54 of the Miami City Code establishes base building line locations for all public streets within the City of Miami; and WHEREAS, Northeast 12"' Street between Northeast Biscayne Boulevard and Northeast 2nd Avenue was originally dedicated as a 40 foot wide roadway; and WHEREAS, the zoned street width of this roadway was increased to 70 feet wide but has not been dedicated -or developed to the 70 foot width; and WHEREAS, the City Administration,'s review of this transportation corridor reveals that the current 50 foot wide developed roadway adequately serves the' present and future transportation needs of the public and the central business district; and WHEREAS, for the adjacent landowners to enjoy full use of their property to enhance and sustain the central business district, the zoned street width of this section Northeast 12th Street must be reduced from 70 feet to 50 feet; and WHEREAS, the Police, Fire Rescue and Solid Waste Departments have evaluated the effects of the reduction of the zoned street width of this section of Northeast 1st Avenue on their operations and have no substantial objections; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 54/Article V/Section 54-190 of the Code of the City of Miami, Florida, as amended, entitled "Streets and Sidewalks/Base Building Lines/Nonstandard Street Widths," is - 2 - 11880 hereby amended in the following particulars!:/ "CHAPTER 54 STREETS AND SIDEWALKS ARTICLE V. BASE BUILDING LINES Sec. 54-190. Nonstandard street widths. Base building lines shall be located from the centerline as specified for each of the following streets: Streets, Avenues, Roads Distance in Feet from Etc. in Alphabetical Order Centerline to Base Building Line (38) 12th Street, N.E., N.E. Biscayne Boulevard to N.E. 2nd Avenue. .-3-S, 2 1; * * * if Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. - 3 - 11880 remaining provisions of this Ordinance shall not be affected. Section 5. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later. * .. _: -1--.''...'' - - - 0 The Honorable Mayor and Members of the City Commission al w City Manager RECOMMENDATION 12 NOV - 2 1999 Amendment to City Code First Reading of Ordinance Amending Code Section 54-190 Location Map It is respectfully recommended that the City Commission adopt the attached Ordinance amending Chapter 54 of the Code of the City of Miami entitled "Streets and Sidewalks" by amending Section 54-190 entitled "Nonstandard Street Widths". BACKGROUND The owner of commercial property in downtown Miami located at 1200 North Biscayne Boulevard, is currently contemplating developing a new commercial/residential tower on the north side of NE 12 Street. Since the zoned right of way width of NE 12 Street reserved for future widening is wider than the currently dedicated 40 feet of right of way width, the owner is prevented from developing the property to full capacity. The owner has requested that the City consider the reduction of the zoned width of NE 12 Street between Biscayne Boulevard and NE 2 Avenue. This request prompted the Public Works Department to undertake a complete review to assess the necessity for continuing the protection of the additional zoned street width for the NE 12 Street corridor between Biscayne Boulevard and the I-395 entrance ramp with the following results and recommendations. The original platted subdivisions that created NE 12 Street within the described limits dedicated a right of way width of 40 feet. The road was subsequently developed with pavement, curb and gutter and sidewalk conforming to the 40 foot wide right of way and many of the structures on private property were constructed abutting the property line established by a 40 foot wide roadway. - Subsequent to Comprehensive zoning Ordinance 6871, the City of Miami Commission, by Ordinance, established a zoned base building line width of 70 feet for this roadway thereby reserving additional property in anticipation of future roadway widening. The existing and future planned development within the district is consistent with . the' City's Zoning Ordinance and Comprehensive Plan and the protection of the additional property 'is no longer necessary for this transportation facility....
