ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING CHAPTER 40/ARTICLE IV/DIVISION 3 OF
THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "PERSONNEL/PENSION AND
RETIREMENT PLAN/CITY OF MIAMI GENERAL
EMPLOYEES' AND SANITATION EMPLOYEES'
RETIREMENT TRUST", TO ALLOW FOR INVESTMENTS
OF STOCK IN FOREIGN CORPORATIONS; MORE
PARTICULARLY BY AMENDING SECTION 40-245 OF
SAID CODE; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Board of Trustees of the City of Miami General
Employees' and Sanitation Employees' Retirement Trust recommends
amending Section 40-245 of .the Code of the City of Miami,
Florida, relating to General Employees' and Sanitation_Employees'
Retirement Trust Plan concerning the types of funds where
investments may be made;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference

thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Chapter 40/Article IV/Division 3 of the Code
of the City of Miami, Florida, as amended, entitled
"Personnel/Pension and Retirement Plan/City of Miami General
Employees' and Sanitation Employees' Retirement Trust", is hereby
amended in the following particulars:''
"Chapter 40
PERSONNEL
ARTICLE IV. Pensions and Retirement Plan
Division 3. City of Miami General Employees' and
Sanitation Employees' Retirement Trust
Sec.. 40-245. Trust fund.
(c) Investments.
(2) Not more than five percent of the fund may be
invested in any one entity of the categories
listed below:
1' Words and/or figures stricken through shall be deleted. Underscored
words and/or figures shall be added. The remaining provisions are now
in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereofY
PASSED ON FIRST READING BY TITLE ONLY this -1 th day of

by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.

Amendment to Section 40-245
of the City Code .
The Board of Trustees for the City of Miami General Employees' and Sanitation
Employees' Trust (GESE) requests an amendment to Section 40-245 of the City Code to
allow for investment in foreign stocks.
BACKGROUND
The City of Miami General Employees' and Sanitation Employees' Trust in reviewing its
investment guidelines and upon consultation and recommendation of its Investment
Consultant, Watson Wyatt, have determined that it would be beneficial to the Trust to
invest in foreign stocks. The ability to invest in foreign stocks provides for greater
diversification thereby reducing the Trust's overall risk in its investment portfolio.
