SUBJECT: Waiver of Waterfront Charter
Provision for One Riverview
Square Project

It is respectfully recommended that the City Commission deny the attached request to
waive a provision of the City of Miami's Waterfront Charter requirement for the One
Riverview Square Office Project to be located at the property generally bounded by the
Miami River on the south, Miami Avenue on the west, the Metromover guideway on the
east, and SE 4th Avenue on the north.
BACKGROUND
Section 3(mm)(ii) of the City of Miami Charter (see attached) requires a 50-foot setback
for development along Biscayne Bay and the Miami River. Waivers.of this provision are
permitted by the City Commission if the Commission determines that "the modifications
requested provide public access, public walkways, plaza dedications, covered parking up
to the floodplain level, or comparable benefits which promote a better urban environment
and public advantages, or which preserve natural features."
The attached request is in order to construct a new office building along the Miami River.
at the Miami Avenue Bridge. The requested waiver is to specifically allow a setback of
20 feet instead of the required 50 feet.
The Department of Planning and Zoning has reviewed the proposal and is recommending
denial as presented based on findings that the new construction, although providing
Riverwalk amenities and public access, does not promote a better urban environment and
public advantages, in that it could be designed to comply with the 50-foot requirement if

parking were to be modified and placed under the building in its entirety.

accompanying application for a public hearing as required by Chapter 55 of the Code of the City

Please find enclosed with this letter our revised design submission on the above
referenced office building project for the Urban Development Review Board.

Please find enclosed also a letter dated October 11, 2000 from the U.S. General
Services Administration, one of the tenants, addressing issues pertaining to
parking, security and building imagery as raised by some of the Board Members
during the last review meeting.
Please note the following revisions made to our previous submission addressing
concerns of the Board Members:
1. We reduced the building footprint at the southwest corner of the site.
2. We provided a landscaped pedestrian walkway connecting South Miami
Avenue to the River Walk on the west side of the property.
3. We brought down the end wall of the building on the west side to screen
•
the loading area from view from South Miami Avenue.
4. We reduced the area of the restaurant and provided an outside dining area
under cover on the River Walk.

5. We shifted the lobby of the office building entrance to the south and
provided retail space on SE 4th Street to enhance the urban pedestrian
• experience.
® 6. We provided a covered arcade for the retail space on SE 4th Street.
7. We provided awnings along the retail space on SE 4tl' Street and the
restaurant on the River Walk to enhance human scale.
8. We reduced the amount of parking on grade and exposure of the parking
structure on SE 4th Street.
9. We maximized the width of the landscape setback in front of the parking
structure on SE 4th Street exceeding the 5 ft. code requirement where
possible.
10. We chopped off the east end of the previous parking garage and widened
the entry driveway from SE 4th Street to enhance the visual connection of
pedestrians from SE 4th Street to the Plaza on the River Walk.
11. We opened up the corner of the entry driveway on SE 4th Street by cutting
the corner of the parking structure above.
12. We provided concrete pavers on the entry driveway from SE 4th Street as
well as the pedestrian walkways on both sides of the driveway leading up
to the Plaza on the River Walk to make the entry more inviting.
13. We provided tree -grated planting on the pedestrian walkway along the
entry driveway.
14. We provided shade trees and planter seats at the Plaza on the River Walk.
15. We located planters on the perimeter of the parking structure and the top
deck to provide a park -like environment and soften the building edge.

16. We altered the architecture of the office tower. Rather than a split of a
single form, we are expressing the shifted floor plate as two separate yet
relating volumes.
While we concur that most of the concerns expressed by the Board Members were
valid, we feel that we tried very hard to address them the best that we could
within the constraints of the design program and the site. We would also like to
take this opportunity to re-emphasize that even though GSA is one of the tenants,
the project is a private speculative office development, and not a government
building commissioned by the GSA.
We appreciate your assistance throughout this process, and hope the revised
design will meet with your recommendation for approval.

INSTRUCTIONS FOR COMPLIANCE WITH SECTION 112.3143, FLORIDA STATUTES
A person holding elective or appointive county, municipal, or other local public office MUST ABSTAIN from voting on a measure
which inures to his special private gain. Each elected or appointed local officer also is prohibited from knowingly voting on a measure
which inures to the special gain of a principal '(other than a government agency4 by whom ,he is retained (including the parent
organization or subsidiary of a corporate principal by which he is retained); to the special private gain of a relative; or to the special
private gain of a business associate. Commissioners of community redevelopment agencies - under Sec. 163.356 or 163.357, F.S., and
officers of independent special tax districts elected on a one -acre, one -vote basis are not prohibited from voting in that capacity.
For purposes of this law, a 'relative" includes only the officer's father, mother, son, daughter, husband, wife, father-in-law, mother4n-
law, son-in-lau, and daughter-in-law. A "business associate" means any person or entity engaged in or carrying on a business
enterprise with the officer as a partner, joint venturer, coowner of property, or corporate shareholder (where the shares of the
corporation are not listed on any national or regional stock exchange).
