OF RIGHT OF WAY FROM N. W.. 7TH STREET OF 40 FEET WIDE (EAST,TO WEST)
AND A 200 FEET: DEEP. (NORTH TO. SOUTH) AND THENCE RUNNING WESTERLY
TO THE 5 ACRE PARCEL .
JOSE MILTON PRESENTLY OWNS THIS.5.-ACRE PARCEL. JOSE MILTON
GOT APPROVAL FOR THE 5 ACRE PARCEL TO BUILD 602 APARTMENTS
AND 950 PARKIN SPACE,•
THE EASEMENT OF RIGHT. OF WAY IS. NOT OWNED BY:JOSE MILTON, BUT IS A
NON DEDICATED COMMON, EASEMENT RIGHT OF WAY FOR JOSE
MILTON AND ALL PERSONS HAVING BUSINESS WITH THE ENTIRE -
PARCEL. THE ENTIRE PARCEL IS MADE' OF 171 ACRES, 1.2 UP AND 5 ACRES
SUBMERGED:
THE EASEMENT LEGAL;,INTERPRETATION STATES THAT ".NO STRUCTURES
OF ANY KIND IS ALLOWED OR PERMITTED ON THE EASEMENT"
DUE TO THIS LANGUAGE WE ARE NOT ALLOWED TO PROTECT OUR
PROPERTY FROM DUMPING. JOSE MILTON HAVE REFUSED TO JOINTLY

FURTHER, JOSE MILTON HAVE TILED, 21 LAW SUITS IN THE 1ITH JUDICIAL.'.
CIRCUIT COURT, IN.MIAMI-DADE COUNTY
CASE NUMBER 97-00975 AND 99-576.4'.THE PURPOSE OF THESE LAW
SUITS IS HARRASSMENT DUE TO THEINADEQUATE. EGRESS AND INGRESS
HE HAS TO.HIS.:PROPERTY.
JOSE MILTON, HAVE AND, IS. STILL TRYING TO OBTAIN A. LARGER
ENTRANCE ,TO THE PROPERTY FRONT US. WE ADVISED HIM THAT WE

Dear Caroline:
This letter is to advise you that Judge Muir denied Jose Milton and Blue Lagoon Airport
Club Apartments' claim for a temporary injunction in the referenced case. As you are aware, the
Plaintiffs sought an order that would have required you to remove the berms of concrete clean
fill. After conducting an evidentiary hearing on November 17, 2000, at which she heard the
testimony of Jose Milton and other of Plaintiffs' witnesses, including testimony from Dennis
Wheeler and Enrique Forum of NET, Judge Muir ruled that the berms of concrete clean fill do
not presently constitute a nuisance. In so holding, Judge Muir recognized that you had been
working with the City and that there was a February timetable to obtain permitting for the use of
the concrete clean fill, which may be extended depending upon the progress that has been made
at that time.
