We accompanied him and other members of the community on a tour of various locations. During this tour, the attached issues were raised and the Administration has responded accordingly. The issues have been addressed by the lead Department responsible for each, even though it is recognized that various support Departments must cooperatively participate to correct some of the issues. Apartment Building at 676 NW 47th Street: This issue will appear before the Code Enforcement Board on October 25, 2000. a) Bars on windows that do not appear to be able to be opened from the inside per code. A Life Safety complaint (CR:0014439) is currently being processed by the Fire -Rescue Department; specifically, by Inspector H. Johnson. b) No posted City of Miami Certificate of Use (CU) or Occupational License (OL); posted County/State licenses expired in 1998. This property has valid City of Miami Occupational License and Certificate of Use. The property owner has been advised to post the licenses on site. NET will follow-up on expired Miami -Dade County/ State of Florida licenses. c) Meter room is housed on inside rear porch and has numerous "poke-throughs" in the ceiling to allow newly installed electrical tubing access to upper floors. Referred to the Building Department, Electrical Section for appropriate action (CR:0020415). 2. Apartment Building just west of 676 NW 47th Street (no street number posted): numerous problems are presented. Needs to be completely inspected. Property specified is located at 4699 NW 7 Avenue. This property is vacant with an unauthorized homeless person living on the premises. The property owner is currently pursuing the removing of the vagrant. This matter was referred to the Building Department, Code Compliance Section for appropriate action (CR:0020411). Model City NET is sending a Notice of Violation regarding the overgrown yard, junk in the yard and failure to display address. 3. Vacant and abandoned house on north side of 47th Street, east of 676 NW 47th Street: What is status of this structure? Submitted into the public record in connection with item on ( G 0 0_ 3 4 Walter Foeman City Clerk • Property specified is located at 659 N.W. 47 Street (property owner deceased). A case for vacant/unsecured structure was heard by the Code Enforcement Board wherein they affirmed the structure was vacantfunsecured. Liens are currently running and the approximate liens accrued thus far total $50,750.00 (CR:9905703). The Building Department's Unsafe Structures section is also processing this case (CR:9905707). 4. Kwik Pic at 695 NW 46th Street: a) Alleyway is not maintained. issued Solid Waste Notice of Violation (CR:0020409). The property owner partially trimmed the foliage in the alleyway. This property changes ownership frequently and has always presented an ongoing problem in which Model City NET has repeatedly cited the owners in the past and currently continues to do so. . b) Dumpster is located on unpaved lot on east side of building; trash all around. Issued Solid Waste Notice of Violation. (CR:0020409) c) There appears to be some type of grease trap located on the east side of the building which may be open and hazardous to small children. This matter has been referred to the Building Department, Mechanical Section (CR:0020407 & CR:0020408) for appropriate action. 5. Overgrown lot located at NW 12th Place and 43rd Street: What is status? When was the last time that we cut it and are there any fines or liens associated with this property? Property specified is located at 1253 NW 43 Street and is in the bidding process for lot clearing. We are currently awaiting approval of the bid. After the Request for Quotation is awarded to the vendor, the vendor has 7 days in which to complete the assignment. The last time this lot was cut was on June 8, 2000. There are various liens on this property. City liens total $14,117.73. 6. Vacant and abandoned houses located at 4700 NW 15th Court: What is status? Vacant/Unsecured structure case was heard before the Code Enforcement Board. To date, liens total $60,400.00 (CR:9901579). The Building Department's Unsafe Structures Section is processing an open complaint (CR:9905720) on this matter. "Note: The properties referenced in this tickler have been ongoing problems in which Model City NET has always cited in the past and continues to do so currently. Item Corrective Action No. 1 Several broken plastic deck drain grates -- Replacement plastic drain grates are on order. Once the grates are received, the majority will be installed easily. Some minor support repair work must be performed by GSA prior to the installing of a small amount of this grate. No. 2 Cracks in wall at breezeway and -- The Public Works Department will apparent ceiling leaks. conduct a structural assessment of the breezeway, walls, floor, and ceiling for cracks and leaks. A preliminary assessment by the Public Works Department reveals that the subject leak is caused by rainwater blowing in through louvers on the roof tower and leaking out at breezeway ceiling. Public Works will recommend a solution to prevent said leaks and seal off the roof tower. No. 3 Water leaking from Community Room -- The A/C condensation line has A/C condenser unit. been unclogged. In response to your request for a complete status of the demolition of unsafe structures, including the current list of what has been presented to the Building Department by NET, and the structures pending the City Attorney's review and approval, please refer to the attachments as follows: • Attachment A (Unsafe Structures Ready for Demolition Process), which identifies the properties/structures not in compliance with Unsafe Structures Board order. The next step will be to start the demolition process. • Attachment B (NET priority Demolition List). This is the list of current structures, which are pending the City Attorney's review and approval. 2. Status of structures located at 4700 NW 15 Court and 1575 NW 47 Street: • The Structure located at 4700 NW 15 CT, was inspected on 10/20/00. Findings revealed that the structure remains Vacant, Open and Abandoned. An Unsafe Structures Case was presented and heard by the Miami -Dade County Unsafe Structures Board on 10/20/99. Please note that this case is listed on Attachment B, Item #61. • The Structure located at 1575 NW 47 ST, was inspected on 10/20/00. Findings revealed that a small wood structure is vacant, secured and abandoned at this time. 7. The following questions were raised by Mayor Carollo concerning the demolition process for Unsafe Structures: 1. Who can change the South Florida Building Code? (In reference to allowing the City of Miami to establish its own Unsafe Structures Board) 2. Can the City of Miami adopt the South Florida Building Code with certain exemptions, i.e., Unsafe Structures Board? 3. Does the Florida Statute address any or all of the above? For answers to the above questions, please refer to Attachment C of this package. The following questions were discussed: 1. Who can change the South Florida Building Code? 2. Can the City of Miami adopt the South Florida Building Code with certain exemptions, i.e.: Unsafe Structures Board? 3. Does the Florida Statute address any or all of the above? Staff from the Law Department is researching questions No. 2 and No. 3 and will be supplying a response. As for question No. 1, it is stated under Section 106 of the South Florida Building Code that the Board of County Commission, through their actions, are the only ones who can make any changes to this Code. For your information, there was a meeting between the Building Department and the Dade County Code Compliance Office. In that meeting, it was verbally agreed that if the City should need additional meetings because of the large volume of cases we had, the Board was willing to have more meetings a month and/or was willing to start these meetings earlier in order to assist us. Another issue discussed at that meeting was the possibility of having the cost involved in presenting these cases become a lien against the property, the same manner in which the City liens its expenses instead of paying the County up front ($653.00) per case.
