A RESOLUTION OF THE MIAMI CITY COMMISSION, BY
A FOUR-FIFTHS (9/5THS) AFFIRMATIVE VOTE,
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDDING
PROCEDURES, AND APPROVING THE ACQUISITION OF
PROFESSIONAL SERVICES FOR ENVIRONMENTAL
PERMITTING FOR FLOATING DOCKS AT MORNINGSIDE
PARK AND THE SHORELINE STABILIZATION AT LEGION
PARK FROM ENVIRONMENTAL DEVELOPMENT CONSULTING
CORPORATION, IN A TOTAL AMOUNT NOT TO EXCEED
$8,950; ALLOCATING FUNDS FROM CAPITAL
IMPROVEMENT PROJECT NOS. 331312 ($4,475) AND
331313 ($4,475), AS APPROPRIATED BY THE ANNUAL
APPROPRIATIONS AND CAPITAL IMPROVEMENT
PROJECTS ORDINANCES, AS AMENDED.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5tns) affirmation vote of
the City Commission, the City Manager's finding of an emergency,
waiving the requirements for the competitive sealed bidding
procedures, and approving the acquisition of professional
services for environmental permitting for floating docks at
Morningside Park and the shoreline stabilization at Legion Park
from Environmental Development Consulting Corporation, in a

total amount not to exceed $8,950, is ratified, approved and
confirmed, with funds allocated from Capital Improvement Project
Nos. 331312 ($4,475) and 331313 ($4,475), as appropriated by the
Annual Appropriations and Capital Improvement Projects
Ordinances, as amended.
Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.l�

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt
the attached Resolution, by a 4/5t4 affirmative vote, ratifying
approving and confirming the City Manager's finding of an
emergency, waiver of competitive sealed bids requirements and
his action to approve the procurement of professional services
for environmental permitting for Morningside and Legion Parks
from Environmental Development Consulting Corporation (EDC) in
the total amount of $8,950, funding was available in the Capital
Improvement accounts for Morningside and Legion Parks.
BACKGROUND:
On October 5, 2001 the Department of Parks and Recreation
requested a finding of an emergency in order to procure the
services of a consultant to obtain environmental permitting
required to install a floating dock at Morningside Park and
stabilize the shoreline at Legion Park. (See attached memo).
The Department solicited proposals from three (3) engineering
firms experienced in environmental, permitting. Environmental
Development Consultants Corporation (EDC) submitted the lowest
bid in the amount of $4,750 for work at Morningside Park and
$4,750 for work at Legion Park totaling $8,950 for permitting
services for both parks.

ENCLOSURES:
The Department of Parks and Recreation received approval from the City Manager for an
emergency finding and waiver of formal bidding on the procurement of Professional
Services for the environmental permitting and construction pians on two City projects at
Morningside and Legion Parks. The Department of Parks and Recreation proceeded with
opening up the required purchase orders and authorized the work on the projects. Staff
has prepared the legislation for the December 13, 2001 Commission Meeting, which
ratifies the City Manager's finding of an emergency.
Funding in the total amount of $4,475 was available from the Morningside Capital
Improvement Budget and funding in the amount of $4,475 was available from the Legion
Park Capital Improvement Budget for said project.
We are hereby requesting your approval confirming the availability of $4,475 from the
Morningside Capital Improvement No. 331313 and the availability of $4,475 from the
Legion Park Capital Improvement Account No. 331312.

Emergency Finding for
Permitting Services at
Morningside and Legion
Parks
The purpose of this memorandum is to request approval of an emergency finding for the
procurement of professional services for the environmental permitting and construction
plans from the Environmental Development Consulting Corporation (EDC) for critical
projects at two (2) City parks, Morningside Park and Legion Park.
Morningside Park—FloatingDocks:
On May 14, 2001, the City Manager approved an emergency finding to waive formal bids
for the procurement of floating docks at Morningside Park to start a sailing program. The
emergency finding did not provide for the permitting services necessary to obtain the
environment permits required to install the floating docks. Since the floating dock
project was an emergency and the City did not have the expertise to obtain the required
permits, the Parks and Recreation and the Public Works Departments moved forward
with the solicitation of proposals from three (3) engineering firms experienced in
environmental permitting. The Environmental Development Consultants Corp. (EDC)
submitted the lowest responsive and responsible bid in the amount of $4,475. EDC
prepared and submitted the required environmental permit applications. After
considerable delay by the environmental permitting agencies, the required permits were
finally obtained to install the floating docks.
Legion Park — Shoreline Stabilization:
The shoreline at Legion Park has been eroding away, it is full of debris and there is an
urgent need for a shoreline stabilization project. The Parks and Recreation Department
needed additional funding to do the project and they contacted the Florida inland
Navigation District (FIND) for grant funds and were advised they would have to expedite
a grant application with the required environmental permits to obtain funding this year.
To meet the deadline, Parks and Recreation solicited proposals from three (3) engineering
firms experienced in environmental permitting and FIND grants that could meet the
deadline for submittal. The Environmental Development Consultants Corp. (EDC)
submitted the lowest responsive and responsible proposal in the amount of $4,475. EDC
was directed to proceed with the permitting and grant application work and Parks and
Recreation Department did obtain the $90,000 FIND grant.

The City Manager's approval is needed to open up purchase orders to pay EDC for their
services on both projects. Funding is available in the Capital Improvement Project
Accounts for Morningside Park and the Legion Park to pay EDC for their environmental
permitting and related services. if this meets with your approval, please indicate by
