A RESOLUTION OF THE MIAMI CITY COMMISSION,
BY A FOUR—FIFTHS (4/5THs) AFFIRMATIVE VOTE,
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED
BIDS, AND APPROVING THE PROCUREMENT OF AN
AIR CONDITIONING UNIT FOR THE KINLOCH PARK
RECREATION BUILDING FOR THE DEPARTMENT OF
PARKS AND RECREATION FROM AIR SYSTEMS
DISTRIBUTORS IN AN AMOUNT NOT TO EXCEED
$3,269; ALLOCATING FUNDS FROM PROJECT
NO. 332174, AS APPROPRIATED BY THE ANNUAL
APPROPRIATIONS AND CAPITAL IMPROVEMENT
PROJECTS ORDINANCES, AS AMENDED.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5ths) affirmative vote of
the City Commission, the City Manager's finding of an emergency,
waiving the requirements for the competitive sealed bidding
procedures, and approving the procurement of an air conditioning
unit for the Kinloch Park recreation building for the Department
of Parks and Recreation from Air Systems Distributors in an
amount not to exceed $5,269, is ratified, approved and
confirmed, with funds allocated from Project No. 332174, as

Improvement Projects Ordinances, as amended.
Section 2. This Resolution shall become effective

If the Mayor does not sign this Resolution, it shall become effective
at the end of ten calendar days from the date it was passed and
adopted. if the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission
adopt the attached Resolution, by a 4/5th affirmative vote,
ratifying approving and confirming the City Manager's
finding of an emergency, waiver of competitive sealed bids
requirements and his action to approve the purchase of an
air conditioning unit from Air Systems Distributors in the
amount of $5,269 for the recreation building at Kinloch
Park with funds available from the Safe Neighborhood Park
Bond Program.
BACKGROUND.-
On
ACKGROUND:
On October 23, 2001, the Department of Parks and Recreation
requested approval for the emergency purchase of an air
condition unit to replace the broken unit at the Kinloch
Park Recreation Building. Please refer to the attached
memorandum. Because this building is the site of one of
the Parks Department's main annual Halloween special
events, the City proceeded to procure the air conditioning
system on an emergency basis in order to have the unit
installed before Halloween. The Department obtained three
(3) quotations of which the lowest responsible bidder was
Air Systems Distributors in the amount of $5,269. Approval
of the attached Resolution formalizes the City Manager's
finding of an emergency.

The Department of Parks and Recreation respectfully requests your approval, on an
emergency basis, to proceed with purchase of an air conditioning unit from Air Systems
Distributors at a cost of $5,269, the lowest bidder, for replacement of the broken air
conditioning unit at Kinloch Park. The City's General Services Administration has
agreed to install the unit, which represents a substantial savings to the City.
The Department solicited three (3) quotations of which the lowest responsible bidder was
Air Systems Distributors.
It is in the best interest of the City and the public to proceed on an emergency basis to
replace the air conditioning unit at this park facility. This building in Kinlock Park is the
site of one of our main annual Halloween special events held in our Parks system. If the
existing condition with the air conditioning is not resolved in time, then this important
community event will have to be cancelled.
The funding source of this purchase is Safe Neighborhood Park Bond funds. Please be
advised that once the work is completed, we will be presenting legislation at the next
available City Commission meeting to ratify this emergency action.

The Department of Parks and Recreation received approval from the City Manager for
Emergency finding waiving the bid requirements on the purchase of an air conditioning
unit for Kinloch Park in the amount of $5,269 with funding from the Safe Neighborhood
Park Bond Program. A purchase order was opened and the work was completed. Staff
has prepared legislation for the December 13th City Commission ratifying and confirming
the City Manager's finding of an emergency.
Your approval confirming the availability of the $5,269 from the Kinloch Park Capital
Improvement Account No. 332174, is hereby requested.
