BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a four-fifths (4/5th,) affirmative vote of the City Commission, after a duly advertised public hearing, the City Manager's finding of sole source, is ratified, approved and CITY C0I0SS MEETING 02 DEC 1 3 2001 ReavlutIM iQ6 0 confirmed, the requirements for competitive sealed bidding procedures are waived, and the continuation of software -related maintenance services for the Department of Planning and Zoning from Environmental Svstems Research Institute, Inc., on a contract basis, for a period of five years, in an estimated annual amount not to exceed $8,100, is approved, with funds allocated from Planning and Zoning fiscal year 2001-2002 General Operating Budget, Account Code No. 850101-728. Section 2. The City Manager is authorized!' to negotiate and execute an agreement, in a form acceptable to the city attorney, for said services. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor./ ii The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. Gi nez City Manager RECOMMENDATION SUBJECT: Finding of Sole Source for GIS Software Maintenance for various City Departments REFERENCES: ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached resolution authorizing the continuation of existing software -related maintenance to the City's Geographic Information System (GIS) being provided by Environmental Systems Research Institute, Inc. (ESRI), 380 New York Street, Redlands, CA 92373-8100. This software service is proprietary and can only be obtained from ESRI, and thus qualifies as a sole source purchase. In order to continue to operate the GIS, it is requested that authorization be provided to continue the acceptance of this existing software -related service, in the form' of ESRI annual software license maintenance fees for a five-year period. The annual proposed cost for ESRI software service is estimated not to exceed $8,100:00. Funding for FY'02 is available in Planning and Zoning Department budget code 850101-728. BACKGROUND On April 13, 1989, the City Commission adopted Resolution 89-362 accepting the proposal of ESRI for software services necessary to establish a geographic information system. On April 11, 1991, the City Commission adopted Resolution No. 91-291, extending said software services for an additional five years. On June 9, 1997, the City Commission adopted Resolution No. 97-374, again extending said software services for an additional five years. The GIS is presently being used by the City Clerk, the CRA, and the Departments of ITD, Police, Fire -Rescue, Planning and Zoning, Real Estate and Economic Development, Asset Management, Community Development, Budget, NET, ITB, Solid Waste, Parks and Public Works for elections, demographics, crime analysis, fire and emergency response, solid waste routing, zoning and land use studies, and housing research. ESRI's was, and is still considered, worldwide, the most versatile and powerful of commercially available GIS software. ESRI is a fifty percent woman -owned firm, with headquarters at 380 New York Street, Redlands, California 92373-8100. In 1991 and again in 1997, sole source findings were rendered by the Chief Procurement Officer, as this type of software - related service was found to be proprietary and could be obtained only from ESRI. The Department of Planning and Zoning has again requested the continued maintenance of the software be declared a sole source acquisition. According to Environmental Systems Research Institute, Inc., they are the owner and manufacturer of the AreGIS software product line, and the sole source provider of AreGIS maintenance in the United States. Further, contact was made with Dave Whittington, Chief of GIS, with the Department of Planning and Zoning, and according to Mr. Whittington, he reported SSRI continues to be the sole source provider of software -related maintenance on its own proprietary equipment. The City remains satisfied with this ESRI product and recommends the continuation of software -related maintenance. Accordingly, I am recommending that the requirements for competitive bidding be waived, and these findings be approved: Environmental Systems Research Institute, Inc.
