FOR REPRESENTATION OF THE CITY OF MIAMI IN THE CASE OF ALICE YOUNG, AS PERSONAL REPRESENTATIVE OF THE ESTATE OF ANTONIO ALEXANDER YOUNG VS. CITY OF MIAMI, ET AL. IN THE U.S. DISTRICT COURT FOR THE SOUTHERN DISTRICT OF FLORIDA, CASE NO. 99 -2994 -CIV -JORDAN, IN THE AMOUNT OF $100,000 PLUS COSTS AS APPROVED BY THE CITY ATTORNEY; ALLOCATING FUNDS FROM THE SELF-INSURANCE AND INSURANCE TRUST FUND, ACCOUNT CODE NO. 515001.624401.6.652, FOR SAID SERVICES. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The engagement of the law firm of Akerman, Senterfitt & Eidson, P.A. for representation of the City of Miami in the case of Alice Young, as Personal Representative of the Estate of Antonio Alexander Young vs. City of Miami, et al. in the U.S. District Court for the Southern District of Florida, Case No. 99 -2994 -CIV -JORDAN, in the amount of ,$100,000 plus costs as approved by the City Attorney, is authorized, with STING OF DEC 13 ?Q,91 ... If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. The attached proposed Resolution seeks authorization for the engagement of the law firm of Akerman, Senterfitt & Eidson, P.A. for representation of the City of Miami only in the case of Young vs. City of Miami, et al., in the U.S. District Court for the Southern District of Florida, Case No. 99 -2994 -Civ -Jordan, in the amount of $100,000 plus costs as approved by the City Attorney. As a result of the indictments of several of the officers named as defendants in these cases, coupled with the guilty pleas of two of the named defendants, the City Attorney's Office is ethically prohibited from further representation of any defendant in this lawsuit, including the City. We have filed a motion to withdraw from the representation of both the City, the Chief, and the officers. With the concurrence of the Chief of Police, we will not be retaining counsel for the defendant police officers.
