RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY AND
AMENDING RESOLUTION NO. 01-22, ADOPTED
JANUARY 11, 2001, TO TNCREASE THE AMOUNT FOR
THE DESIGN AND ENGINEERING SERVICES, IN AN
AMOUNT NOT TO EXCEED $33,112.80, FROM
$100,000 TO $133,112.80 AND INCREASE THE
AMOUNT FOR THE CONSTRUCTION CONTRACT, IN AN
AMOUNT NOT TO EXCEED $34,887.20, FROM
$650,000 TO $684,887.20 FOR THE PROJECT
ENTITLED MODEL CITY ROADWAYS IMPROVEMENTS,
LOCATED AT NW 41 STREET BETWEEN NW 12 AVENUE
AND NW 17 AVENUE, MIAMI, FLORIDA; ALLOCATING
FUNDS FROM PROJECT NO. 341203 AS
APPROPRIATED BY THE ANNUAL APPROPRIATIONS
AND CAPITAL IMPROVEMENT PROJECTS ORDINANCES,
AS AMENDED.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5th$) affirmative vote of
the members of the City Commission, the City Manager's finding
of an emergency, is ratified, approved and confirmed and

competitive sealed bidding procedures, and
authorizing the acquisition of services for
the Department of Public Works for Capital
Improvement Project No. 341203, entitled
Model City lmprovements, located at
Northwest 413t Street between Northwest 12th
and Northwest 17th Avenues, Miami, Florida,
prem as follows: design and engineering

It is respectfully recommended that the City Commission adopt the attached Resolution
ratifying, approving and confirming the City Manager's finding of an Emergency and
amending Resolution No. 01-22 by increasing the amount for the design and engineering
services from $100,000 to $133,112.80 and increasing the amount for the construction
contract from $650,000 to $684,887.20 for the project entitled Model City Roadway
Improvements located at NW 41 Street between NW 12 and 17 Avenues, Miami, Florida.
BACKGROUND
On January 11, 2001, at an advertised public hearing, the Miami City Commission
adopted Resolution No. 01-22 ratifying, approving and confirming the City Manager's
finding of an emergency, waiving the requirements for competitive sealed bids and
authorizing the acquisition of professional design and engineering services for the project
entitled Model City Roadway Improvements located at NW 41 Street between NW '12
and 17 Avenues. The Resolution further establishes an amount not to exceed $100,000
for the design and engineering services and an amount not to exceed $650,000 for the
construction contract based on an estimate of cost to complete this project.
In response to the emergency need to complete the improvements on NW 41 Street, the
design and construction phases of this project must be completed on a fast-track basis.
The most efficient design services and the lowest responsive bidder were selected for this
project. However, due to the compression of the project schedule required by the
emergency, the costs of design services and the construction contract have exceeded the
amounts authorized by Resolution No. 01-22. Based on the urgency to complete this
project, I have found that an emergency exists which justifies an increase in the amount
for design and engineering services from $100,000 to $133,112.80 and an increase in the
amount for the construction contract from $650,00 to $684.887.20.
Funds are available from Project No. 341203, as appropriated by the Annual
Appropriations and Capital Improvement Project Ordinances, as amended, to cover the
increased costs of the design and engineering services and the construction contract.

Emergency increase in hands for
N.W. 41 Street Improvements

On January 11, 2001, at an advertised public hearing, the Miami City Commission
adopted Resolution No. 01-22 ratifying, approving and confirming the City
Manager's finding of an emergency, waiving the requirements for competitive
sealed bids and authorizing the acquisition of professional design and engineering
services for the project entitled N.W. 41 Street Improvement Project located on N.W.
41 Street between N.W. 12 and 17 Avenues. The Resolution further establishes an
amount not to exceed $100,000 for the design and engineering services and an
amount not to exceed $650,000 for the construction contract based on an estimate of
cost to complete this project.
In response to the emergency need to complete the improvements on N.W. 41

WHEREAS, on December 14, 2000, the City Manager made a
written finding that roadway improvements required at Northwest
41st Street between Northwest 12th and 17th Avenues, Miami,
Florida, were of an emergency nature; and

December 14, 2000, increased the appropriations for Capital
Improvement Project ("CIP") °No. 341203, entitled Model City
Street Improvements, to reflect the appropriation of funds in
the amount of $750,000 for said CIF; and
WHEREAS, pursuant to Resolution No. 00-1109, adopted
December 14, 2000, the City Commission authorized the allocation
of funds, in an amount not to exceed $750,000, and authorized
the City Manager to execute agreement(s), for design and
engineering services for said CIP; and
WHEREAS, the City Manager was further directed to schedule
a public hearing at the January 11, 2001 City Commission meeting
for purposes of waiving competitive bidding procedures for the
selection of the contractor(s) for said improvements;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.

previously allocated pursuant to Resolution No. 00-1109 for
Capital Improvement Project No. 341203.
Section 4. The City Manager is authorized:1 to execute
an agreement (s) , in a form acceptable to the City Attorney, with
the appropriate entities for said project.

requirements that may be imposed by the City Attorney, including but
not limited to those prescribed by applicable City Charter and Code
provisions.
