A RESOLUTION OF THE MIAMI CITY COMMISSION,
BY A FOUR-FIFTHS (4/5THS ) AFFIRMATIVE VOTE,
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY AND
APPROVING THE ACQUISITION OF SOFTWARE AND
TRAINING SERVICES FOR THE SETUP AND USE OF
HAPPY SOFTWARE FROM HAPPY SOFTWARE, INC. , IN
AN AMOUNT NOT TO EXCEED $30,755; ALLOCATING
FUNDS FROM THE HOUSING OPPORTUNITIES FOR
PERSONS WITH AIDS PROGRAM.
WHEREAS, Resolution No. 01-148, adopted February 15, 2001,
authorized and directed the City Manager to reorganize,
restructure, and implement the City's Housing Opportunities for
Persons with Aids Program, including the transfer of Long -Term
Housing Assistance Program to the City of Miami Department of
Community Development; and
WHEREAS, it was necessary to purchase software and contract
training services to increase operational efficiency and
compliance with reporting requirements and time frames; and

WHEREAS, based on staff research, the HAPPY software best
met the requirements of ease of use, reliability and
functionality as compared to other systems on the market;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5th') affirmative vote of
the City Commission, the City Manager's finding of an emergency
and approving the acquisition of software and training services
for the setup and use of HAPPY Software from HAPPY Software,
Inc., in an amount not to exceed $30,755, is ratified, approved
and confirmed, with funds allocated from the Housing
Opportunities for Persons with Aids Program.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.1/
i� If the Mayor does not sign this Resolution, it shall become effective
at the end of ten calendar days from the date it was passed and
adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.

Confirming Emergency Purchase of
HAPPY Software

ENCLOSURES:
It is respectfully recommended that the City Commission adopt the attached resolution, by a 415`h
affirmative vote, ratifying, approving and confirming the City Manager's finding that it was
advantageous and practicable for the City Manager to authorize the expenditure of $30,755 in
Housing Opportunity for Persons With AIDS (HOPWA) Program funds to purchase software
and contract training services for the setup and use of HAPPY software from HAPPY Software,
Inc. to increase operational efficiency and compliance with reporting requirements and time
frames of the HOPWA and Section 8 Programs managed by the Department of Community
Development.
BACKGROUND:
At the City Commission meeting of February 15, 2001, the City Commission adopted Resolution
No. 01-148 which authorized the City Manager to take the steps necessary to effectuate the
restructuring and subsequent implementation of the City's Housing Opportunity for Persons
With AIDS (HOPWA) program after terminating its agreement with Economic Opportunity
Family Health Center.
In an effort to increase operational efficiency and compliance with reporting requirements and
time frames, the City Manager authorized the Department of Community Development to
purchase software and contract training services for the setup and use of HAPPY software from
HAPPY Software, Inc. This software assists in the management of client information for the
City's HOPWA program and also the Section 8 program. As a result of the life issues at stake,
operational issues involved, and the tremendous public attention received by the HOPWA
program has, it was imperative to act in the best interests of City to purchase the software on an
emergency basis.
Based on staff research, the HAPPY software best met the requirements of ease of use, reliability
and functionality as compared to other systems on the market. The HAPPY software complies
with HUD's reporting requirements; is user-friendly; assists in managing applicant and waiting
Iist data, certification and re -certification data; and, will allow data to be uploaded without
requiring staff to re-enter current data from Excel formats. It will also assist in tracking
applicants' occupancy status, maintenance of landlord information, lease and payment

information and track and assist in scheduling HQS Inspections in a timely manner to assist in
complying with HUD regulations and time frames.
The immediate purchase and installation of this software was critical for the City to manage data
for approximately 1,200 HOPWA current clients, as well as those on the waiting list. The cost of
the software, including customization, the maintenance agreement, and training upon installation
totals $30,755. Grant funds are available from the HOPWA Program for this purpose.
It is recommended that the City Commission adopt the proposed resolution, by a 4/5's
affirmative vote that ratifies, approves and confirms the City Manager's action in purchasing the
HAPPY software at a cost of $30,755.

DOCUMENT(S), IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY TO EFFECTUATE THE ALLOCATION,
TRANSITION AND IMPLEMENTATION OF THE

WHEREAS, the Housing Opportunities for Persons With AIDS
("HOPWAO) Program was created under the AIDS Housing Opportunity
Act, and revised under the Housing and Community Development Act
of 1992; and.

WHEREAS, the Housing and Community Development Act of 1992
requires that the most populous unit of general local
in an Eligible Metropolitan Statistical Area ("BMSA"'), not
including county government, be the applicant for the HOPWA
Grant and be allocated the related funding, and
WHEREAS, since 1994 the City of Miami has received the
HOPWA Program funds from U.S. HUD, and has been responsible for
the implementation of programs designed to provide housing and
housing -related services to individuals living with HTV/AIDS in
the City of Miami and the cities of Miami, Hialeah, Miami Beach
and throughout Miami --Dade County; and
WHEREAS, the City of Miami has been awarded funding from
the U.S. Department of Housing and Urban Development
("U.S. HUD") for the implementation of the 2000-2003, HOPWA
Program Grant; and
WHEREAS, on May 11, 2400, the City Commission adopted
Resolution No. 00-425 approving the restructuring of the HOPWA
Program; and
WHEREAS, under the restructured HOPWA Program (see attached
"CAty of Miami HOPWA Budget, 10/1/00 - .9130101"), the city of
Miami acting through the Department of2' Community Development
will be responsible for implementation and administration of the
HOPWA
Program for participants
living in
the City, and Miami -
Dade
County, acting through the
Miami -Dade
Housing Agency, will

be responsible for similar services to participants residing
outside the City of Miami in Miami. -Dade County; and
WHEREAS, on May 11, 2000, the City Commission also adopted
Resolution No. 00-426, authorizing and directing the City
Manager to hire the accounting firth of Sharpton, Brunson and
Company to perform an audit of the City•s HOPWA Program before
implementation of the restructured Program; and
WHEREAS, on September 14, 2000, the City Commission adopted
Resolution No. 00-792 allocating $9,979,000 in HOPWA Program
funds to ten service providers to provide housing assistance and
housing related services to low income persons living with
HIV/AIDS, from October 1, 2000 through September 30, 2001, to
ensure that services are provided through the transition period;
and
WHEREAS, one of the service providers, Economic opportunity
Family Health Center, Inc., was awarded $1,200,000 to provide
long-term housing assistance for individuals living with
HI'V/AI}7S through March 31, 2001; anal
WHEREAS, over past year the City has received numerous
complaints from both program participants and landlords
regarding Late rental assistance payments from the Economic
Opportunity Family Health Center Program; and
WHEREAS, the Department of Community Development's
monitoring and preliminary audit of the agency revealed that the

Economic Opportunity Family Health Center Program has a, number
of programmatic and financial problems, and raised concerns
related to the commingling of funds; and
WHEREAS, it is recommended that the City Commission approve
the termination
of the City's
agreement with
Ilconomsc
Opportunity Family
Health Center, for
the provision of
long term
housing assistance
and
transfer
the responsibility for
administering the
program
to the
Department of Community
Development; and
WHEREAS, based on the City's evaluation of the Short -Term
Housing Assistance Program, a caseload exists of more than two
hundred individuals living with HIV/AIDS who seek assistance
through the Program and who are on the waiting lint for the Long
Term Housing Assistance program; and
WHEREAS, the Administration recommends the elimination of
the Short -Term Housing Assistance Program and an increase; in the
number of slots available through the Long -Term Housing
Assistance Program, to be administered by the Department of
Community Development and the Miami -Dade Housing Agency; and
WHEREAS, it is recommended that an additional $358,000 in
HOPWA Program funds be allocated to maintain the caseload
capacity "Of the Douglas Gardens Community Mental Health, Center
of Miami Beach to provide long-term housing assistance in the

WHEREAS, it is also reco;ad that an, additional
$2,700,000 in HOPWA Program funds be allocated to the Department
of Community Development for operations and long term housing
assistance to individuals living with IJIV/AIDS;
NOW, THEREFORE, BE ST RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized and directed
to reorganize, restructure, and implement the City's Housing
Opportunities for Persons With Aids ("HOPWAfr) Program, including
the transfer of the long-term housing assistance program for low
income individuals living with HIV/AIDS previously operated by
the Economic opportunity Family Health Center to the City of
Miami Department of Community Development, for implementation

upon expiration of the City's contract with the agency on
March 31, 2001.
Section 3. The allocation of HOPWA Program funds, in
the total amount of $3,058,000, for the services and service
providers listed below to serve' low income individuals living
with Hlv/Alr)S as specified is authorized;
