A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR --FIFTHS (4/5TIS ) AFFIRMATIVE VO'T'E, RATIFYING, APPROVING AND CONFIRMING THE CI'T'Y MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, AND APPROVING THE ACQUISITION AND INSTALLATION OF A STEEL PICKET FENCE AT ELIZABETH VIRRICK PARK FOR THE DEPARTMENT OF PARKS AND RECREATION FROM PROFESSIONAL WELDING, INC., IN AN AMOUNT NOT TO EXCEED $121,000; ALLOCATING FUNDS FROM COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a four-fifths (4/5ths) affirmative vote of the members of the City Commission, the City Manager's finding of an emergency, waiving the requirements for the competitive sealed bidding procedures, and approving the acquisition and installation of a steel picket fence at Elizabeth Virrick Park for the Department of Parks and Recreation from Professional Welding, Inc., in an amount not to exceed $121,000, is ratified, CITY CQN!MSSiCJN F.T11&O OF 4 approved and confirmed, with funds allocated from Community Development Block Grant funds. Page 2 of 2 CITY OF MIAMI, FLORIDA 21 INTER -OFFICE MEMORANDUM TO; Honorable Mayor and Members 'DATE: OCT - 9 FILE: of the City Commission SUBJECT: Approval of Emergency Action for the Fence at Elizabeth Virrick Park FROM: /" ` a Ios A • Gimenez REFERENCES ; City Manager ENCLOSURES: RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached Resolution, by a 4/5th affirmative vote, ratifying, approving and confirming the City Manager's finding and recommendation to proceed on an emergency basis with the purchase and installation of a steel picket fence at Elizabeth Virrick Park, from Professional Welding, Inc. in a total amount not to exceed $121,000. This Resolution further allocates funds for said purposes, from the Community Development Block Grant Funds Program (CDBG). BACKGROUND: The Department of Parks and Recreation requested a finding of an emergency in order to complete the installation of the fence prior to the August 16th United Way Kickoff campaign at the park and to expend the funds for this project before September 30th, a requirement of the CDBG program. The old fence at this Park was a chain link one which was rusty and in disrepair. Although the replacement of this chain link fence with a steel picket one was always planned for this facility, it had to be purchased sooner than expected because painting it by volunteers became a high priority for the United Way Kickoff Campaign. As a result, the city saved some money in not having the fencing contractor paint it. Additionally, the fence has contributed greatly to securing the Park. Gimenez City Manager Alberto Ruder, Director DEtartment of Parks and Recreation 9 BATE; June 21, 2001 ! c' 5l M`ECT Emergency Picket Fence at Elizabeth Virrick Park REFERENCES, ENC'..GSURS: ' The Department of Parks and Recreation respectfully requests your approval, on an emergency basis, to proceed with the purchase and installation of a steel picket fence at Elizabeth Virrick Park in Coconut Grove in an amount not to exceed $121,000, It is essential to complete the installation of the proposed steel picket fence as soon as possible since there is strict spending and time constraints in the use of federal Community Development Block Grant (CDBG) Program funds earmarked for this work. These funds need to be expended prior to September 30, 2001. It should also be pointed out that the proposed fence will ' not only provide additional protection to the new recreational building .and indoor basketball court currently under construction at the park but also will offer added safety to the pool and other park facilities. The proposed steel picket fence to be installed around the perimeter of Elizabeth Virrick Park will have a top bent outward at a 180 degree for added protection. A flat cap will be placed on top of each picket for extra safety. The Department of Parks and Recreation has solicited quotes from four (4) vendors and has received two (2) quotations since two (2) of the four (4) companies declined to bid on this project. The lowest responsible and responsive bidder for the proposed work is Professional Welding, Inc., a City of Miami based vendor. Please note that due to a shortage of available funds for capital improvement projects like this, it will not include a contingency amount. The funding sources for this purchase is Community Development Block Grant Program funds. Please be advised that once the work is completed, we will be presenting legislation at the next available City Commission meeting to ratify this emergency action.
