A RESOLUTION OF THE MIAMI CITY COMMISSION ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER TO APPROVE THE FINDINGS OF THE EVALUATION COMMITTEE, PURSUANT TO REQUEST FOR PROPOSAL NO. 00-01-162, DATED AUGUST 27, 2001, THAT THE MOST QUALIFIED FIRMS TO PROVIDE BANKING SERVICES FOR THE CITY OF MIAMI ARE, IN RANK ORDER: (1) FIRST UNION BANK, ( 2 ) BANK OF AMERICA AND (3) SUN TRUST; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A PROFESSIONAL SERVICES AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH FIRST UNION BANK, THE FIRST -RANKED FIRM, FOR A PERIOD OF THREE YEARS, WITH THE OPTION TO RENEW FOR THREE ADDITIONAL ONE-YEAR PERIODS; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT WITH BANK OF AMERICA, THE SECOND -RANKED FIRM, IN THE EVENT NEGOTIATIONS FAIL WITH FIRST UNION BANK, AND IF NEGOTIATIONS ARE NOT SUCCESSFUL, TO ISSUE A NEW REQUEST FOR PROPOSAL FOR BANKING SERVICES; DIRECTING THE CITY MANAGER TO PRESENT THE AGREEMENT TO THE CITY COMMISSION FOR ITS CONSIDERATION. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recommendation of the City Manager to approve the findings of the evaluation committee, pursuant to Request for Proposal No. 00-01-162, dated August 27, 2001, that the most qualified firms to provide banking services for the City CITY COMMISSION MEET=1 or 5 All �ia�olutiox� I�'a of Miami are, in rank order: (1) First Union Bank, (2) Bank of America and (3) Sun Trust, is accepted. Section 2. The City Manager is authorized!' to negotiate and execute a professional services agreement, in a form acceptable to the City Attorney, with First Union Bank, the first -ranked firm, for a period of three years, with the option to renew for three additional one-year periods, and to negotiate and execute an agreement with Bank of America., the second -ranked firm, in the event negotiations fail with First Union Bank, and if negotiations are not successful, to issue a new Request for Proposal for banking services. Section 3. The City Manager is directed to present the agreement to the City Commission for its consideration. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. BACKGROUND On July 1312001, RFP No. 00-01-162 was issued with responses due to the Office of the City Clerk by August 27, 2001. Three (3) proposals were received, and three proposals were found to be responsive and in accordance with the terms set by the RFP. Two meetings (September 7, 2001 and September 27, 2001) were held by the RFP Evaluation Committee to review and evaluate the proposals. The proposals were evaluated based on the Proposer's a) Qualifications and Experience; b) Ability and Capability to Perform Required Services; c) Corporate Community Commitment; d) Fees for Services; and e) Minority[Women Participation. The results of the Committee's findings in order of results from the proposer with the highest point awarded to the least are as follows: 1) First Union Bank 2) Bank of America 3) Sun Trust It is the recommendation of the Evaluation Committee that the City Manager negotiate with the highest ranked proposer, and in the event negotiations are not successful, proceed to negotiate with the second ranked proposer.
