BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5th`) affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, ratifying, approving and confirming the City
Manager's finding of sole source, is ratified, approved and
confirmed, the requirements for competitive sealed bidding
procedures is waived, and the acquisition of routine inspection
and re -certification of 180 Survivor TM 2000 Series EMS
surveillance vests for the Department of Fire -Rescue from

It is respectfully recommended that the City Commission adopt the attached Resolution, by a four-fifths
(4/5`) affirmative vote of the Members of the City Commission, after a duly advertised public hearing,
ratifying, approving, and confirming the City Manager's finding of sole source; waiving the requirements
for competitive sealed bids and authorizing the procurement of routine inspection and re -certification of
180. Survivor TM 2000 Series Surveillance Vests, from Pinnacle Armor, a non-local/non-minority
vendor, located at P.O. Box 5839, Fresno, CA 93755-5839, the sole source provider, for the Department
of Fire -Rescue.
The cost of this purchase is not to exceed $31,500.00. Funding is available from Capital Improvement
Program (CIP) Project No. 313304, Account Code 289401.6.850, as funded by the Fire Assessment.
BACKGROUND
The Fire -Rescue personnel occasionally find themselves in hostile situations involving the use of
firearms and other weapons. Demonstrations, riots, and sniper fire sometimes prevent our emergency
responders from doing their jobs. In 1994, the Department of Fire -Rescue purchased 180 Survivor TM
2000 Series EMS Surveillance Vests manufactured by Armor Technology, Corporation. These garments
are designed so as to protect firefighters from hazards encounters in the Emergency Medical Service
industry that requires routine inspection and re -certification accordance to the National Institute of
Justice (NIJ) Standard 0101.04, Ballistic Resistance of Personal Body Armor. To date, the initial five-
year warranty on the ballistic panels has expired. The re -certification will allow the vest's warranty to be
extended another six to seven years, and re -certification extends the warranty to a full 12 years from the
original date of receipt of the unit. Failure to inspect and re -certify these ballistic vests will result to loss
of product warranty and garments must be taken out of service.
Since Armor Technology Corporation manufactured these ballistic vests, any extended warranty for
inspection and re -certification will mandate and assure the product warranty be provided by Pinnacle
Armor.
The Chief Procurement Officer has deemed Pinnacle Armor as a sole source; it is therefore
recommended at this time that the City Commission ratify the City Manager's finding of sole source and
authorize the procurement of this service.

An investigation as conducted by staff to determine whether Pinnacle Armor, a non -minority / non local
vendor, locatedd P. O. Box 5839, Fresno, Ca. 93755-5839, is the sole source provider for the procurement of
routine inspection and re -certification of 180 Survivor TM 2000 Series Surveillance Vests, for a total estimated
amount not to exceed $31,500.00, on behalf of the Department of Fire -Rescue. Funding is available from CIP
Project No. 313304, Account Code 289401.6.850, as funded by the Fire Assessment.
The Department of Fire -Rescue acquired 180 Survivor TM 2000 Series EMS Surveillance Vests, manufactured
by the Armor Technology Corp., in 1994. These vests are designed so as to protect firefighters from hazards
encountered in the Emergency Medial Service industry that requires routine inspection and re -certification, in
accordance with the National Institute of Justice (NIJ) Standard 0101.04, Ballistic Resistance of Personal Body
Armor. The initial five-year warranty on the ballistic panels has expired, and the re -certification will allow the
vests' warranty to be extended another six to seven years, and re -certification extends the warranty to a full I2
years from the original date of receipt of the units. Failure to inspect and re -certify these ballistic vests will
result in the loss of product warranty, with garments taken out of service.
These ballistic vests were originally manufactured by Armor Technology Corporation, whose assets have been
acquired by Pinnacle Armor. Pinnacle Armor is honoring the re -certification and inspection requirements for
extended warranties, as they are the exclusive body armor manufacturing company allowed to examine and
inspect prior Armor Technology -manufactured body armor. No other vendor is authorized to inspect and re-
certify these EMS surveillance vests, and Pinnacle Armor is also now the sole manufacturer and supplier of this
EMT body armor.
Accordingly, I am recommending that the requirements for competitive bidding be waived, and these findings
be approved: Pinnacle Armor is the sole source provider for the procurement of routine inspection and re-
certification of ISO Survivor TM 2000 Series Surveillance Vests, for a total estimated amount not to exceed
$31,500.00, on behalf of the Department of Fire -Rescue. Funding is available from CIP Project No. 313304,
Account Code 289401.6.850, as funded by the Fire Assessment.

The extended warranty specification for ballistic resistant body
armor vests
Scope: The following is a specification for the return of USA Armoring vests after the initial
five-year warranty on the ballistic panels has expired. The re -certification will allow the vest's
warranty to be extended another six to seven years, depending on date of purchase. The re-
certification extends the warranty to a full 12 years from the original date of receipt of the unit.
As of now, USA Armoring has frill discretion as to each unit and whether it's worthy of this
procedure.
Inspection: The process for inspection is listed as follows:
1. Disassembly of body armor
a. Removal of ballistic panel from carrier
b. Removal of ballistic panel from its cover
e. Removal of trauma plate from its cover
li. Ballistic Panel and Trauma Plate inspection for defects of:
a. Severe creases
b. Folding of ballistic material
c. Damage of ballistic fiber
d. Fraying
e. Stitching
f Dents, cracks or visible damage
111. Restoration
a. New ballistic panel cover
b. New trauma plate cover
c. Restore ballistic panel integrity
d. New body armor vest carrier .
Please dote: All vests that pass inspection will be restored to its initial ballistic integrity and
original specifications. If any specifications with the National Institute of Justice (Nil') standards
are changed, the vest will refect the appropriate ballistic resistance of new standards. We
reserve the right to decline an individual vest being a candidate for re -certification.
Product Liability: USA Armoring offers the highest standard continual product liability
insurance in the industry. $15,000,000.00 USD of product liability is insured on every
manufactured and re -certified vest.
