A RESOLUTION OF MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE REQUEST OF THE MODEL CITY HOMEOWNERSHIP TRUST ("TRUST") THAT THE MIAMI-DADE COUNTY SUPERVISOR OF ELECTIONS INCLUDE AT THE APPROPRIATE PRi~;CINC'?.'S A SLATE OF CANDIDATES FOR ELECTION OF A PUBLIC ADVOCATE TO THE TRUST ON THE NOVEMBER 13, 2001 CITY OF MIAMI ELECTION BALLOT, CONDITIONED UPON THE CITY (T.) PAYING ALL, APPLICABLE COSTS FOR SAID ELECTION, AND (2) MEETING ALL CRITHRIA SET FORTH BY THE SUPERVISOR OF ELECTIONS OF, MIAMI-DADE COUNTY; DIRECTING THAT A SPECIAL ELEC'.I'ION FOR PUBLXC ADVOCATE BE HELD ON NOVEMBER 13, 2001; DESCRIBING THE REGISTRATION BOOKS AND RECORDS MAIN'T'A'I'NED UNDER THE PROVISIONS OF THE GENERAL LAWS OF FT.,ORTDA AND CHAPTER 16 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, WHICH 'THE CITY HAS ADOPTED AND DESTRES TO USE FOR HOLDING SUCH SPECIAL ELECTION; DESIGNATING AND APPOINTING THE CITY CLERK AS THE OFFICIAL REPRESENTATIVE OF THE CITY COMMISSION WI'.I'H RESPECT TO THE USE OF SUCH REGISTRATION 130OKS AND KECORDS; AUTHORIZING AND DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF THE ADOPTION OF 'I'HIS RESOLUTION AND THE PROVISIONS THEREOF' PURSUANT TO APPLICABLE LAW; AUTHORIZING THE CITY CLERK TO CAUSE A CERT'I'FIED COPY OF THE HEREIN RESOLUTION TO BE DELIVERED TO THE SUPERVISOR OF ELECTIONS OF MIAMI-DADE COUNTY, FI.,ORIDA. BF; T'T RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY COMMISSION blE ETING of SEP 1 3 2001 hosoiullon No. til- 940 Section 1. The request of the Model City Homeownership Trust ("Trust") that the Miami -Dade County Supervisor of Elections include at the appropriate precincts a slate of candidates for election of. Z Public Advocate to the Trust on the November 13, 2001 City of Miami Election Ballot, a.s approved conditioned upon the City (1.) paying all applicable costs for said Election, and (2.) meeting all. criteria set forth by the Supervisor of Elections of Miami -Dade County. Section 2. In accordance with the provisions set forth in ordinance No. 12082, as amended, a Special Election is directed to be held in the City of Miami, Florida, at District 5 polling precincts as follows: Precinct Nos. 507, 508, 511, 512, 513, 592, 521 [split], and 523 [split], on Tuesday, November 13, 2001 from 7 a.m. until 7 p.m., for the purpose of electing a candidate as the Public Advocate member of the Model City Homeownership Trust. Section 3. The candidate who shall receive the highest number of votes for Public Advocate to the Trust in District 5 Precinct Nos. 507, 508, 511, 512, 513, 592, 521 [split], and 523 [split]) , shall serve as Public Advocate to the Trust for a germ of four (4) years as set forth in Ordinance No. 12082, as amended, commencing upon the City Commission's ratification of the City Clerk's Declaration of Election at the first scheduled City Commission meeting immediately following the election. The Precinct Election Clerks and Lnspectors. to serve at said Polling Precincts on said date shal.1. be those designated by the Supervisor of Elections of Miami -Dade County for such purpose in accordance with the general laws of the SLaLe. The registration Looks and records for the registration of persons qualified to vote in said election shall be those maintained by the Supervisor of ElecL-:ions of Miami. -Dade County. Section 5. F'or the purpose of enabling persons to register who are qualified to vote in said special election and who have nor- registered under the provisions of the general laws of Florida and Chapter 16 of the Code of the City of Miami, Florida, as amended, or who have Lransfe.r_red their. legal residence from one voting precinct- to another voting precinct in the City, they may register at such branch offices as may be approved by the Supervisor of Elections of Miami. -bade County and at said Supervisor's office which will be open during the following Location and times: MIAMI-DADE COUNTY ELECTIONS DEPARTMEN"I.. 1=1 Northwest 13L Street, Miami, Florida Monday to Friday, inclusive: 8:00 A.M. - 5:00 P.M. Page 3 of 8 (.)"1()R j 1 1�" Ljt\i ,..n addition to, the above, said qualified persons may register at branch offices and may also use any mobile registration van for the purpose of registration to vote in the herein described elections during such times and on such dates as may be designated by the Supervisor of Elections of Miami - Dade County. Section 6. The election shall. be held at: the voting places in District 5 Precinct: which are Precinct Nos. 507, 508, .511., 512, 513, 592, 521 [split] , and 523 [ split]) , or as may be designated by the Supervisor of Elections of Miami -Dade County, ir. conformity with the provisions of the general laws of the State. A description of the registration books and records which pertain to election precincts wholly or partly within the City and which the City is adopting and desires to use for holding such election is as follows: Al. registration cards, books, records and certificates pertaining to electors of the City and established and maintained as official by the Supervisor of Elections of Miami -Dade County, in conformity with the provisions of the general laws of the State, are adopted and declared to be, and shall hereafter be recognized and accepted as, official registration cards, books, records and certificates of. the City. Section 7. The ballot to be used in said election shall be so prepared that the name.-, of the qualified candidates w.i.l.l L)age 4 of 8 UI.r i1� 9 appear on said ballot in alphabetical order according to surname; provided, however, that the ballot and its preparation shal.l comply wiuh the laws of the State of Florida w_th respect to absentee ballots, and ro the use of mechanical voting machines or the Computer. Election System ("CE;S"). Section 8. (a) In compliance with Ordinance No. 12082, Lhe City Clerk is authorized and directed Lo widely publicize the special. election for Public Advocate in the Model City Community Revitalisation District in the media and in newspaper(s) of general circulation in the City of Miami, }Florida, at least two weeks in advance of the special election, which notice shal.l. be substantially as set forth in the following form: "NOTICE OF SPECIAL ELECTION IN PRECINCTS NOS. 507, 508, 511, 512, 513 592, 521 [split] , and 523 [split] ) IN THE CITY OF MIAMI, FLORIDA FOR THE ELECTION OF THE PUBLIC ADVOCATE MEMBER TO THE MODEL CITY HOMEOWNERSHIP TRUST TO BE HELD ON TUESDAY, NOVEMBER 13, 2001 PURSUANT TO RESOLUTION NO. 01- A Special Election will be held on Tuesday, November 13, 2001, from 7 a.m. until 7 p.m., in the City of Miami, Florida, at District 5 Polling Precincts Nos. 507, 508, 511, 512, 53.3, 592, 521 [split] , and 523 [split]) , as designated by the Board of County Commissioners of Mia►tii-Dade County, Florida, at which election the qualified electors participating therein will. vote for the election of the Public Advocate member of the Model City Homeownership Trust." FOR PUBLIC ADVOCATE Vote for one (1) only (Names of Candidates) Section 9. WALTER J. FORMAN, the City Clerk of the City of. Miami, Florida, or his duly appointed successor, i.s Page 6 of 8 940 designated and appointed as the official representative of the Commission of: the City of Miami, Florida, in all transactions with the Supervisor of Elections of Miami -Dade County in relation to matters pertaining to the use of the registration books for the holding of the special election. Section 10. The City Clerk shall cause to be prepared absentee ballots for the use of absentee electors entitled to cast such ballots in said election. Section 11. All qualified electors of said City shall be permitted to vote in said special election and the Supervisor of Elections of Miami -Dade County is requested, authorized, and directed to furnish, at the cost and expense of the City of Miami., a list of all qualified electors residing in Precincts Nos. 507, S08, 511, 51.2, 513, 592, 521 [split] , and 523 in the City of Miami as shown by the registration books and records of the office of said Supervi_so.r. of Elections and duly certify thE� same for delivery to and for use by the election officials designated to serve at the respective polling places in said election precincts. Section 12. The City Clerk is authorized and directed uo cause a certified copy of this Resolution to be delivered to the Supervisor of Elections of Miami -Dade County pursuant to applicable law.
