Constantz �71. .1 Executive Director RECOMMENDATION It is respectfully recommended that the Miami City Commission adopt the attached Resolution ratifying, approving and confirming the Executive Director ofthe Bayfront Park Maragetnent Trust's finding of an emergency, waiving the requirements for competitive sealed bids and approving the repair of the AT&T Amphitheater at Bayfront Park bench seating, damaged during the Festival Argentino en Miami, in an amount not to exceed $9,310, payable to H. Way Corporation, with funds allocated therefore from the Bayfront Park Management Trust operating budget. BACKGROUND The Bayfront Park Management Trust was created by the Miami City Commission to direct, operate, manage and maintain all aspects of Bayfront Park with the goal of ensuring maximum community involvement. Bayfront Park is the City of Miami's premier public park, hosting 50 special events and concerts annually. The AT&T Amphitheater at Bayfront is Bayfront Park's primary performance venue. Ethnic festivals and community events are scheduled in the amphitheater on a regular basis. The exuberance of the attendees at the Festival Argentino en Miami proved no match for the benches. Eighteen (18) benches were damaged or destroyed. The immediate repair of the amphitheater benches for future events was deemed essential to the safety and convenience of the City and the Trust. Bayfront Park staff solicited proposals for the bench repair from five contractors on the approved City of Miami contractor list. H. Way Corporation, a Black, Miami -Dade County Vendor, submitted the most responsive and responsible bid, in the amount of S9,310. Funds for these repairs are available from the Bayfront Park Management Trust's Operating Budget. The Bayfront Park Management Trust ratified the Executive Director's finding of an emergency by a unanimous vote at it July 24, 2001, meting. Finding of an Emergency On Sunday, April 29, 2001, during the Festival Argentino en Miami, the crowd dancing on the benches in the AT&T Amphitheater destroyed 18 benches and damaged nine (9) sections. Maintenance Supervisor Carlo Manzo contacted five (5) contractors from the city -approved list to get bids for the benches' repair. H. Way Corporation, a Black, Miami -Dade County vendor submitted the most responsive and responsible bid of 59,310, and the repairs were undertaken immediately. These repairs to the damaged benches are deemed an emergency because the immediate procurement of the repair services is essential to the safety and convenience of the city.
