RESOLUTION NO. 01— 771 A RESOLUTION OT THE MIAMI CITY COMMISSION AUTIIORT7TNG THE DOWNTOWN DEVELOPMENT AUTHORITY ("DDA") TO ESTABLISH A PROPOSED MILLAGE RATE OF ONE-HAI,F (1/2) MILL FOR THE DO'JJNTOWN DEVELOPMENT DISTRICT OF THE CITY OF' MIAMI, FLORTDA FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2001 AND ENDING SEPTEMBER 30, 2002, PURSUANT TO SEC'T'ION 200.065, FLORIDA S'T'ATUTES (2000); AUTHORIZING AND DIRECTING THE DDA TO SUBMIT SAID PROPOSED MILLAGE RATE TO THE MIAMI DADE COUNTY TAX COLLECTOR, TOGETHER WITH THE DAT,,, '.GIME AND PLACE OF THE PUBLIC HEARINGS A',WHTCH THE MTAMI CITY COMMISSION WILL CONSIDER THE PROPOSED MTLLAGE RATE AND TIIr DDA TENTATIVE BUDGET FOR SAID FISCAL, YEAR. BE IT RESOLVED BY THE COMMISSION OF THE CI'T'Y OF MIAMI, FLORIDA: Section 1. The Downtown Development Authority ("DDA") is authorized to establish a proposed millage rate of one-half (1/2) mill for the Downtown Development: District of the City of Miami., Florida for the Fiscal. Year beginning October 1, 2001 and ending September. 30, 2002. Section 2. ENCLOSURES: It is respectfully requested that the 'City Commission approve the attached Resolution establishing the FY'02 Millage rate for the Downtown Development Authority of the City of Miami, Florida. Background In 1980, the State of Florida Legislature enacted House Bill -41) entitled "Truth in Millage" ("TRIM BILL") which has been incorporated into the Florida Statues under Section 200. The TRIM BILL also stipulates that the proposed millage rate be submitted to the Property Appraiser and Tax Collector and included in the City's tax notices mailed to property owners. The City Commission is authorized under Chapter 14 of the City of Miami Code to levy an additional ad valorem tax on all real and personal property in the Downtown Development District, not to exceed one-half (1/2) mill, for the purpose of financing the operations of the Downtown Development Authority. The proposed millage rate for the DDA for the Fiscal Year beginning October 1, 2001 and ending September 30, 2002 is .a mill. The Miami City Commission must also establish the dates and times of the first and second public hearings in connection with the DDA FY'2002 proposed Millage Rate and Budget. As in past year's the DDA's public hearings should be scheduled for the same dates as the City's. cc: Alejandro Vilarello, City Attorney Walter Foeman, City Clerk 01- 771 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE DOWNTOWN DEVELOPMENT AUTHORITY ("DDA") OF THE CITY OF MIAMI, FLORIDA AUTHORIZING THE EXECUTIVE DIRECTOR TO ESTABLISH A PROPOSED MILLAGE RATE FOR THE DOWNTOWN DEVELOPMENT DISTRICT OF THE CITY OF MIAMI, FLORIDA FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2001 AND ENDING SEPTEMBER 30, 2002. WHEREAS, Section 200.065(2)(a)I, Florida Statutes (Supp. 1992)("TRIM BILL"), requires each taxing authority to establish a proposed millage rate; and WHEREAS, said law stipulates that the proposed millage rate be submitted to the Miami Dade County Property Appraiser and the Tax Collector; and WHEREAS, said rate reflects the levy necessary to realize property tax revenges anticipated in the Fiscal Year 2002 Budget; and . WHEREAS, the proposed millage rate submitted to the Property Appraiser is not binding but necessary for the purpose of preparation of tax notices. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE DOWNTOWN DEVELOPMENT AUTHORITY. Section i . The Executive Director of the DDA is hereby authorized to establish a proposed millage rate for the Downtown Development District of the City of Miami, Florida for the Fiscal Year beginning October 1, 2001 and ending September 30, 2002 at .5 Mills. RESOLUTION NO. 305 3?12423 P.02/03 A RESOLUTION AUTHORIZING TFIE HOARD OF THE DOWNTOWN DEVELOPMENT AUTHORITY ("DDA") OF THE CITY OF MI.ANII, FLORIDA APPROVING} THE ANNUAL BUDGET OF THE DOWNTOWN DFVELOPMENT AUTHORITY FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2001 AND ENDING SEPTEMBER 30, 2002 REQUESTING THAT THE MIAMI CITY COMMISSION ESTABLISH THE MrLLAGE AND ALLOCATE OTHER FUNDS TO SUPPORT THE FINANCIAL REQUIREMENTS OF THE BUDGET; AUTHORIZING THE EXECUTIVE DIRECTOR AND TREASURER OF THE DOWNTOWN DEVELOPMENT AUTHORI'T'Y TO EXPEND FUNDS UNDER THE NEW BUDGET; DIRECTING THE EXECUTIVE DIRECTOR TO FILE A DETAILED STATEMENT OF THE PROPOSED EXPENDITURES AND ESTIMATED REVENUES FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2001 AND ENDING SEPTEMBER 30, 2002 WITH THE CITY CLERK OF THE CITY OF MIAMI AFTER ADOPTION AND ESTABLISHMENT OF THE NULLAGE BY THE MIAMI CITY CON MISSION; AND FURTHER PROVIDING THAT A COPY OF THIS RESOLUTION BE FILED WITH THE CITY CLERK OF THE CITY OF MIAMI.. WHEREAS, the Downtown Development Authority of the City of Miami, Florida has prepared a budget for the Fiscal Year beghming October 1, 2001 and ending September 30, 2002; and WHEREAS, the Board of Directors of the Downtown Development Authority has reviewed said budget, said budget being based on the Estimated Tax Roll provided by Miami Dade County; and WHEREAS, the Board of Directors of the Downtown Development Authority Ends that the proposed budget is necessary in order to Rather the objectives of the Downtown Development Authority, as authorized by City Ordinance. Section 6.
