HomeMy WebLinkAboutR-01-0708J-01-1105 07/19/01 RESOLUTION NO. -01" `0Q A RESOLUTION OF THE MIAMI CITY COMMISSION RELATED TO THE "HAPPY BIRTHDAY MIAMI" EVENT, CONDUCTED BY THE BLACK ARCHIVES HISTORY & RESEARCH FOUNDATION OF SOUTH FLORIDA, INC. (THE "ORGANIZER"), TO BE ]IELD AT THE LYRIC THEATER AND NINTH STREET PEDESTRIAN MALL, 819 NORTH WEST 2`D AVENUE, MIAMI, FROM 10:00 A.M. THROUGH 10:00 P.M. ON JULY 28, 2001; ACCEPTING, APPROVING AND AUTHORIZING CO- SPONSORSHIP OF THE EVENT ON BEHALF OF THE CITY OF MIAMI; AUTHORIZING THE WAIVER OF ALL FEES AND PERMITS PERMISSIBLE BY LAW; AUTHORIZING THE PROVISION OF IN-KIND SERVICES BY THE DEPARTMENTS OF POLICE, HIRE -RESCUE, GENERAL SERVICES ADMINISTRATION, SOLID WASTE, AND PARKS AND RECREATION; AND DIRECTING THE CITY MANAGER THAT SAID AUTHORIZATIONS SHALL BE CONDITTONED UPON THE ORGANIZER: (1) OBTAINING ALL PERMITS REQUIRED BY LAW; (2) OBTAINING INSURANCE, INCLUDING 13UT NOT LIMITED TO LIQUOR LIABILITY, TO PROTECT THE CITY IN THE AMOUNT AS PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE; (3) ADVISING ALL ADJACENT BUSINESSES, PROPERTY OWNERS, AND RESIDENTS OF' STREET CLOSURES ASSOCIATED WITH SAID EVENT; AND (4) COMPLYING WITH ALL CONDITIONS AND LIMITATIONS AS MAY BE PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE. The City Manager is authorizedil to co- sponsor the "Happy Birthday Miami" event on behalf of the City of Miami. Section 2. The waiver of all fees and permits permissible by the Code of the City of Miami, Florida, as amended, and the provision of in-kind services by the Departments of Police, Fire -Rescue, General Services Administration, Solid Waste and Parks and Recreation are hereby authorized. Section 3. The herein authorizations are conditioned upon the organizer: (1) obtaining all permits required by law, including but not limited to a temporary permit to sell alcoholic beverages by the Florida Department of Business Regulation, Division of Alcoholic Beverages and 'Tobacco, pursuant to Section 54-13 of the Code of the City of: Miami, Florida, as amended; (2) obtaining insurance, including liquor liability, to protect the City in the amount as prescribed by the City Manager or his designee; (3) instituting an identification program to assure that only those individuals over the age of twenty-one may purchase alcoholic beverages; (4) advising all adjacent businesses, property owners, and residents The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but rot limited to those prescribed by applicable City Charter and Code provisions. BACKGROUND Mr. Derek T. Davis, Executive Director of the Black Archives, History &c Research Foundation of South Fl, Inc, requests the City of Miami to waive permit, administrative, disposal fees, and City personnel services (Police, Fire, Solid Waste). The Black Archives will be having an event to celebrate the "City of Miami's 105'h birthday" on Saturday, July 28'h, 2001.
