J-01-541 7/9/01 RESOLUTION NO. _0j— -683 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO NEGOTIATE A MANAGEMENT AGREEMENT WITH THE CITY OF MIAMI RETIRED POLICE OFFICERS COMMUNITY BENEVOLENT ASSOCIATION, INC., FOR THE RESTORATION, OPERATION AND MANAGEMENT OF A HISTORICAL MUSEUM AND TO PROVIDE EDUCATIONAL AND COMMUNITY-BASED PROGRAMS ON CITY -OWNED PROPERTY LOCATED AT 1009 NORTHWEST 5T° AVENUE, MIAMI, FLORIDA; FURTHER DIRECTING THE CITY MANAGER TO PRESENT THE NEGOTIATED AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO THE CITY COMMISSION FOR CONSIDERATION AS SOON AS PRACTICABLE. WHEREAS, the City desires to enter into a Management Agreement (the "Agreement") for the restoration, operation and management of City -owned property located at 1009 Northwest 5 r Avenue, Miami, Florida (the "Property"), as a historical museum and to provide educational and community-based programs; and WHEREAS, on May 18, 2001, the City placed an advertisement soliciting letters of interest for competitive negotiations for such Agreement; and WHEREAS, the letter of interest from City of Miami Retired Police Officers Community senevolent Association, Inc. (the CITY CK?� MEFTWO 1111 1 V 2001 liaaotettw� D2a. 01- 6$.:; "Organization") was the only letter received in response to this solicitation; and WHEREAS, the City Commission deems that it is in the beet interest of the City to enter into negotiations with the Organization; and WHEREAS, the City Manager will present the negotiated Agreement to the City Commission for consideration as soon as practicable; NOW, THEREFORE, AE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorizedlI to negotiate a management agreement with the City of Miami Retired Police Officers Community Benevolent Association, Inc. for the restoration, operation and management of a historical museum and to provide educational and community-based programs on City - owned property located at 1009 Northwest 5`h Avenue, Miami, Florida. Section 3. Inc. ity Manager EYCLOSURES The administration recommends that the City Commission adopt the attached Resolution authorizing the City Manager to negotiate a management agreement with City of Miami Retired Police Officers Community Benevolent Association, Inc. ("COMRPOCBA), for the restoration, operation and management of the City-o%%med property located at 1009 NW 5 Avenue, Miami, Florida, as a museum documenting the historical use of the site and the provision of educational and community-based programs. The City of Miami owns the property located at 1009 NW 5 Avenue, Miami, Florida. This property was used historically as the first Black Police Precinct in Miami. On May 18, 2001, the City placed an ad soliciting letters of interest from parties interested in entering into competitive negotiations for the restoration, operation and management of the property as a museum documenting the historical use of the site, and other educational and community based programs. The ad further indicated the selected operator would be required to raise the necessary funds to restore the property and to provide for the continued operation and maintenance of the site. The COMRPOCBA submitted the only letter received expressing its interest in negotiating a management agreement with the City for this purpose. It is requested at this time that the City Manager be authorized to negotiate an agreement with COMRPOCBA and to bring back said negotiated agreement to the City Commission for approval.
