BLACK, A FORMER EMPLOYEE OF THE CITY OF MIAMI, FLORIDA, ENTERING INTO A CONTRACT, TRANSACTING BUSINESS WITH AND FOR THE CITY, OR APPEARING BEFORE THE CITY COMMISSION FOR THE COMMUNITY DEVELOPMENT COMMITTEE TO ' PROVIDE PROFESSIONAL SERVICES RELATING TO THE MODEL CITY HOMEOWNERSHIP PILOT PROJECT. WHEREAS, George D. Buck is a former employee of the City of Miami (the "City"); and WHERFAS, the City's Community Development Committee wishes to engage George D. Black to provide professional services relating to the Model City Homeownership Pilot Project; and WHEREAS, the Conflict of Interest provisions of the City are applicable to George D. Black as he left the service of the City on May 5, 2000, which is within the two-year limitation as set forth in Sections 2-611 through 2-614 of the Code of the City of Miami, Florida, as amended; and a" colamews DOMING OF JUN 142001 twiOuluuWa 1V&. Of- 582 6 0 WHEREAS, Mr. Black seeks a waiver of the Conflict of Interest provisions so he may enter into a contract, transact business with and for the City, or appear before the City Commission for the Community Development Committee to provide professional services relating to the Model City Homeownership Pilot Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The prohibitions contained in Sections 2-611 and 2-614 of the Code of the City of Miami, Florida, as amended, are waived by a four-fifths (415th") affirmative vote of the members of the City Commission, after a duly advertised public hearing, as such prohibitions pertain to George D. Black, a former employee of the City of Miami, Florida. Section 3. The waivers set forth in Section 2 is based upon the following findings: (a) George D. Black left the service of the City of Miami on May 5, 2000; (b) George D. Black seeks to enter into a contract, transact business with and for the City, or appear before the City Commission for the Community Development Committee to provide professional services relating to the Model City Homeownership Pilot Project, which would be ?n violation of the City Code if such waivers are not granted by the City Commission; Page 2 of 3 01— 582 (c) It is in the best interest of the City and its furtherance of development of competitive grant proposals to secure funding for the Model City Homeownership Pilot Project that George D. Black provide professional services relating to the Model City Homeownership Pilot Project. Section 4. Page 3 of 3 01.— 582 CITY OF MIAMI, FLORIDA 3 INTER -OFFICE MEMORANDUM TO: The Honorable Mayor and Members ��;� _ 6 „ FILE of the City Commission DATE: SUBJECT FROM REFERENCES Car City Manager ENCLOSURES Waiver to Engage Professional Services From Former City of Miami Employee Within Two Years of Separation City Commission Meeting June 14, 2001 It is respectfully recommended that the City Commission, by a four fifths (4/50') affirmative vote, adopt the proposed Resolution waiving the prohibitions contained in sections 2-611 through 2-614 of the Code of the City of Miami, Florida, as amended, as such prohibition pertains to George D. Black, a former employee of the City of Miami, Florida, entering into a contract, transacting business with and for the city, or appearing before the City Commission to provide professional services relating to the Model City Homeownership Pilot Proiect. The Department of Community Development is aggressively pursuing grant opportunities in its quest for funding to support the Model City Revitalization Pilot Project. This task will require extensive research to'identify potential grant sources as well as the actual preparation and submission of grants for which the City may be eligible. Current activities include the preparation of grants through the SUPERNOFA of the U.S. Department of Housing and Urban Development (HUD). Staff resources in the Department are limited and it is necessary to retain outside professional services to ensure that the City of Miami is in a position to be competitive for these grant opportunities. Therefore, it is requested that the City Commission, by a four-fifths affirmative vote, waive the prohibitions contained in sections 2-611 through 2-614 of the Code, as amended, to allow Mr. George D. Black, a former employee of the City of Miami, Florida, to enter into a contract to provide professional services relating to grant preparation and research for the Model City Homeownership Pilot Project. Mr. Black served as the Grant Coordinator in the Department of Community Development and separated from this position May 5, 2000. During Mr. Black's tenure with the City of Miami, he established himself as an excellent writer and thorough researcher and was instrumental in developing grants in support of the Department's Workforce initiatives. He is extremely knowledgeable in the inner working of the Department as well as the internal structure of the 01- 582 of . City of Miami. Mr. Black will be a valuable asset in enabling the City to be competitive in its attempts to secure funding for this important revitalization initiative. It is recommended that the City Commission adopt the proposed Resolution that waives the prohibitions contained in sections 2-611 through 2-614 of the Code, as amended and allows Mr. George D. Black, a former employee of the City of Miami, Florida, to enter into a contract to provide professional services relating to grant preparation and research for the Model City Homeownership Pilot Project. _Ac u, Bags 2 of 3 01— 582 • CITY OF MIAMI, FLORIDA N077CE TO THE PUBLIC A public hearing will be held by the Commission of the City of Miami, Florida, on June 14, 2001 at 9:00 A.M. in the City Commission Chambers at City Hall, 3500 Pan American Drive, Miami, Florida, for the purpose of considering a proposed waiver of the prohibition by a former City of Miami employee to enter into any contract, transact any business, or appear before the City Commission within two .years after leaving City employment as such prohibition applies to George D. Black, who wishes to provide professional services relating to the City of Miami Model City Homeownership Project. All interested parties are invited to appear and may be heard concerning such proposed waiver. The hearing will be held at the time and place specified above. Should any person desire to appeal any decision of the City Commission with respect to any matter considered at this hearing, that person shall ensure that a verbatim record of the proceeding is made, including all testimony and evidence upon which any appeal may be based.
