PARTICULARLY DESCRIBED IN "EXHIBIT A" ATTACHED AND INCORPORATED, FOR PUBLIC PURPOSES, SETTING FORTH A MANAGEMENT PLAN, ATTACHED AS "EXHIBIT B". WHEREAS, the City of Miami entered into a Management Agreement with Shake -A -Leg Miami, Inc. ("SAL") dated July 12, 2000 (the "Agreement"), for the use of a portion of City -owned property, including the dock area, located at 2600 South Bayshore Drive, Miami, Florida, to serve primarily as a public recreation center to provide recreational and educational opportunities to City of Miami residents, youth groups, disadvantaged sectors of the public, organized community groups and the general public] and WHEREAS, as a condition precedent to the Management Agreement taking effect, the City must own or control the lands C= C01=8510N 1=TING OF JUIN S 4 2001 W"UAUM XV. 01- 563 contained in the Management Agreement that includes certain submerged lands owned by the State; and WHEREAS, the State has agreed to enter into a management agreement allowing the City to continue use and management of certain sovereign submerged lands; and WHEREAS, due to the public purpose nature of SAL's programs, no fee will. be required in connection with the management agreement with the State; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized!' to execute a Management Agreement, in a form acceptable to the City Attorney, with the State of Florida to authorize the City's management of certain submerged sovereign lands located adjacent to 2600 South Bayshore Drive, Miami, Florida, as more particularly described in "Exhibit A" attached and incorporated, for public purposes, setting forth a management pian, attached as "Exhibit B". The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but nol limited ro those prescribed by applicable City Charter and Code provisions. BACKGROUND: The City of Miami entered into a Management Agreement with Shake -A -Leg ("SAL") dated July 12, 2000, for the use of a portion of the City owned property located at 2600 South Bayshore Drive including the nock Area. to serve primarily as a public recreation center and provide recreational and educational opportunities to the City of Miami residents, youth groups, disadvantaged sectors of the public, organized community groups and the general public. As a condition precedent to the Management Agreement taking effect, the City must own or control the lands contained in the Management Agreement that includes certain sovereign submerged lands owned by the State. The existing dock structures are located on these sovereign submerged lands. Following discussions with the State, it was agreed that the most appropriate instrument for the City to continue utilizing and managing these submerged lands is to enter into a management agreement with the State. The City has submitted a formal application to the State for the management agreement. The management agreement will set forth a management plan. a draft of which is attached hereto as Exhibit "B" for reference, and provide for the State's consent to the existing dock structures and future improvements as shown in the sketch attached to the draft management plan. The State has indicated that due to the public purpose nature of SAL's programs. no fee will be due in connection with the State Management Agreement. In order for the City to continue with SAL's Management Agreement and to avoid delays in the construction of the Initial Improvements, it is requested that the City Commission authorize the City Manager to execute a management agreement with the State, in a form acceptable to the City Attorney. The facility occupies the historic U.S. Coast Guard Hanger site that was recently restored, and also includes an area of adjacent sovereign bay bottom for its docking facilities. The watersports center is operated by Shake -A -Leg Miami, a non-profit organization that provides watersports programs for the community with emphasis on youth and people with disabilities. In -water facilities, over sovereign land, currently include floating docks where Shake -A -Leg's fleet of adaptive sailboats are moored, and a public boat ramp that is,controlled by Shake -A - Leg (see attached sketch of exiting facilities). Future in - water facilities include an additional floating dock and ramp for adaptive dinghies, a boardwalk for environmental education that winds through a shade of mangroves, an observation platform, and shade structures over portions of the floating docks (see attached sketch of proposed facilities). It is important to note that this portion of Biscayne Bay has been designated as a marine expansion area in Miami Dade County's approved marine protection plan. The following provides a history of the watersports center and Shake -A -Leg Miami's role in developing and managing the center through its management agreement with the City. The section, which follows also, describes in detail existing facilities and programs, proposed facilities and future programs and serve as a management plan for the use of the sovereign bay bottom land occupied by this facility. 2 01- 563 • r ORGANIZATION INFORMATION History: In 1990, the City of Miami formed a partnership with Shake -A -Leg Miami, Inc. a Florida based, non-profit 501 (c) (3) organization, for the purpose of establishing a watersports program for people with disabilities. Following Hurricane Andrew and a series of community planning sessions, it was determined that the program should be expanded into a comprehensive community waterspor.ts park and recreation center. Over the years The City and Shake -A -Leg Miami have worked together to carry out this plan while continuing to operate programs and serve the needs of the community. Shake -A -Leg was originally founded in Newport, Rhode Island. Over the years, the organization developed and operated a variety of empowerment programs. It participated in the development of a fully accessible sailboat and created one comprehensive adaptive sailing center. The organization grew through the collaboration with many organizations, foundations, families and individuals to operate a variety of unique programs and services. These programs and services provide opportunities for thousands of people with and without disabilities along with their families to explore their potential and achieve personal goals. Sharing resources and expertise allows us to offer affordable and effective programs. Recognizing this successful pioneering work, Dr. Barth Green, world renown for his work in the area of spinal. cord injuries, recruited Shake -A -Leg to expand its operation to Miami. Since 1990, Shake -A -Leg has been working with the City of Miami, Dade County and a variety of community based organizations, developing and operating South Florida's only water sports program for people with disabilities. After the destruction of Hurricane Andrew and the community's desire to rehabilitate the former Coast Guard Facility into a community water sports center, Shake -A -Leg set out to develop the team and deliver a plan back to the city. Bill Cullom, President of the Greater Miami Chamber of Commerce, organized a group of business and civic leaders to restructure the organization, developed a plan and submitted it to the City of Miami Commission for approval. The Commission authorized the manager to enter into an agreement. Shake -A -Leg Miami's proposed community water sports center was included for funding as part of the Trust For Safe Neighborhood Parks bond act, which was approved by Dade County voters on November 5th, 1996. ' Following the approval of the bond and to most effectively serve the community the YMCA was asked to join the project. They have agreed to develop the former Coast Guard Hangar into a full service YMCA facility. The YMCA will offer swimming instruction and land based programs and Shake A Leg Miami will offer water- based programs. 3 ©i" 563 Currently Shake A Leg Miami has formed an alliance with the Dade County Public Schools to operate programs for students with disabilities. These alliances, along with partnerships with 60 community based organizations, positions the organization to provide affordable and effective services to the community for many years to come. The partnership has the experience in designing and operating programs. It has grown by partnering with community- based organizations and foundations that share mutual goals of improving the quality of life of people with disabilities and youth. . 4 01- 55a • Mission • To provide a state--of-the-art universally accessible facility offering affordable and effective watersports, recreation, education, empowerment and family oriented programs. People Served The center will be open and accessible to all members of the community and visitors from around the world. Special emphasis will be on youth, people with disabilities and families. Programs and facilities will serve the needs of individuals, community based organizations, area educational institutions and municipal parks. Programs The programs offered at the currently offered by the City of Leg Miami, the YMCA of Greater organizations from South Florida. The current programs include: facility complement programs Miami Parks Department, Shake -A - Miami and other community based Watersports Instructional and Recreational Programs; Boating and Water Safety Programs; Scout Merit Badges; Group Outings; Special Events; Community Meetings; Environmental Education Programs. Future programs will include: Health, Education and wellness Programs; Sports Specific Conditioning Programs; Youth Regional Day Camps/Holiday Programs; Teenage Leadership Training; College Credit Programs; Clubs; Volunteer Development; Community Service; Child Care; Youth Recreation Programs and Sports Leagues. Facilities The Facilities are located on a deed -restricted site, which requires that the property -be used for recreation purposes. It provides the ideal access to Biscayne Bay. Once the facilities are completed they will become the Flagship Watersports Park of the City of Miami Park's system. Phases 1 of the Facilities have been completed with the historic restoration of the Coast Guard Hangar and installation of the floating docks (see attached sketch). Phase 2 will include the 01- 563 .1 y construction of the watersports center building which. will include multi-purpose conference and class rooms, library, youth institute, gift and snack shop administrative offices, maintenance and equipment repair center; restoration of the boat ramp, construction of a kayak and dinghy dock, and bay walk (see attached sketch). Current boats include 15 non -motorized sailboats with keels, 15 dinghies, 3 motorized sailboats with keels, 4 motorized safety boats, a pontoon spectator boats, and 25 kayaks. The disabled participants and youth -at -risk develop skills that are improving their quality of life. The able-bodied people gain a better appreciation of the needs and abilities of people with disabilities and youth -at -risk. As a result, they become capable volunteers, mentors, companions, friends and advocates for people with disabilities and youth at risk. • We operate South Florida's only adaptive sailing program serving adults and youth with disabilities, youth at risk, students and families. We have become the nations leading provider of adaptive sailing programs for people with disabilities. • After two years of work and funding from the Peacock Foundation and other financial supporters, we convinced the Miami Dade County School Board to allow us to operate a pilot project for 240 students with disabilities. The positive response from the students, teachers and administrators has resulted in a request to expand the number of students to 800. • Shake -A -Leg Miami and the Miami Lighthouse for the Blind have developed a blind sailing program for local residents. Graduates have competed in national and international competitions. We were selected by Blind Sailing International to host the 1999 World Blind Sailing Championships. We hosted the event on October 16 - 22, 1999. 120 sailors (60 blind) from 14 countries participated. • us Sailing awarded Shake -A -Leg Miami as the nation's "Outstanding Year Round Community Sailing Program for 1997. The Greater Miami Chamber of Commerce named Shake -A -Leg Miami the Outstanding non-profit sports program. • Established a Marine Institute that uses the Internet to communicate with individuals and organizations locally and from around the world. using the marine environment and activities as our theme, the emphasis is on fostering the exchange of ideas, services and technology that will improve the independence and employability of people with disabilities and youth. • In an effort to further expand its scope of services and strengthen its ability to serve diverse populations, the organization has expended much effort over the last several years in forming a strategic alliance with the YMCA of Greater Miami and the City -of Miami Parks Department to create the Miami international Watersports Park and Recreation Center. This new facility will provide Miami. -Dade County with one of the most comprehensive, fully accessible watersports centers available worldwide. In recognition of the project's 01- 563 0 0 substantial impact on the community, the Trust for Safe Neighborhood Parks bond act awarded the enterprise $4,000,000 for capital improvements. • To further utilize the natural resources of the Bay an Environmental Education and Water Appreciation Project was established. In 1997, Shake -A -Leg Miami convinced a bipartisan Florida delegation lead by U.S. Representative Carrie Meek to seek a $100,000 appropriation from the US Congress for the Army Corps of Engineers to conduct a study of doing an environmental restoration the barrier islands off the coast of the watersports center. Congress approved the appropriation. This year, the Army Corps of Engineers has completed the feasibility phase of the study and will be recommending that the project be approved.
