HomeMy WebLinkAboutR-01-0557J-01-433 5/21/01 RESOLUT?ON NO. _ 01— 557 A RESOLUTION OF THE CITY OF MIAMI ;COMMISSION, AUTHORIZING THE AMOUNT OF $4,513,945 IN APPLICATIONS FOR SPECIFIEN PER CAPITA/INTEREST PROJECTS TO MIAMI-DADE COUNTY AS DESIGNATED HEREIN FOR THE SAFE NEIGHBORHOOD PARKS BOND PROGRAM,, BOND SERIES 2C01, Y.AR FOUR FUNDING; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR ACCEPTANCE OF THE GRANTS; AND AUTHORIZING, PURSUANT TO THE PROVISIONS OF THE SAFE NEIGHBORHOOD PARKS ORDINANCE, THE PAYMENT OF (1) SUPPLEMENTAL FUNDS REQUIRED TO COMPLETE SAID PROJECTS IF THE COSTS OF SAID PROJECTS EXCEED THE GRANT ALLOCATION, AND (2) FUNDS TO OPERATE, MAINTAIN AND PROVIDE PROGRAMMING AT EACH PROJECT UPON ITS COMPLETION. WHEREAS, the citizens of Miami -Dade County authorized the issuance of general obligation bonds (the "Bonds") for the purpose of financing capital improvement programs for certain parks, beaches, natural areas and recreation facilities; and WHEREAS, to implement and give effect to the bond program, Miami Dade County, Florida enacted Ordinance No. 96-115, the Safe Neighborhood Parks Ordinance (the "Ordinance"); and CITY connS ion WXETMG OF JUN 14 2001 Ku,k"w tau. 01— 557 $tee WHEREAS, it is necessary and desirable to improve the quality of life, to benefit property values, to promote prevention of juvenile crime by providing positive recreation opportunities, and to improve the recreation facilities for youth, adult, and senior citizens in this community through the improvement of our parks and natural areas; and WHEREAS, to foster these important values, the projects more specifically listed below have been identified for reimbursement pursuant to the terms of the Ordinance; and WHEREAS, pursuant to the terms of the Ordinance, the passage of this Resolution and the acts contemplated by this Resolution are conditions to obtaining a grant; and WHEREAS, the City of Miami has made applications for the grant monies for the projects listed to Miami -Dade County, pursuant to all terms and conditions of the Ordinance; and WHEREAS, the City Commission supports any future actions Necessary to accomplish the intent of the Ordinance; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1.. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Page 2 of 6 01— $57 • Section 2. The City Manager is authorized= to execute the necessary document(s), in a form acceptable to the City Attorney, to implement acceptance of the grants. Section 4. The City of Miami shall complete each of the Projects in accordance with the terms of the grant agreement(s), the Ordinance, and the administrative rules authorized by the Citizen's Oversight Committee (the "Committee") to implement the Ordinance. If the total cost of a Project exceeds the value allocated in the grants, then the City of Miami will provide any supplemental funds required to complete the Project. In the event that supplemental funds are necessary for completion, the City of Miami will demonstrate that such supplemental funds have been committed to the Project prior to and as a condition of disbursement of grant funds for a specified project. The requirement for the City of Miami to provide any supplemental funds required to complete the Project may, at the sole discretion of the Committee, be modified in whole or in part by a reduction in scope of work consistent with the Ordinance. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code Provisions. The City of Miami recognizes and directs that any beach, park, or other public facility acquired, developed, rehabilitated or restored with bond funds, including the Projects, shall be open and accessible to the public without discrimination as to race, color, gender, age, religion, belief, residence, natural origin, marital status or disability. Section 6: To the extent allowed by law, City of Miami shall commit any and all funds, which may be required to operate, maintain and provide programming at each park project upon its completion. Section 7. All grants received shall be used solely fox the projects for which they have been designated. Section 8. This Resolution shall become effective' immediately upon Its adoption and signature of the Mayoral It the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was parsed and adopted. REFERENCES City Manage ENCLOSURES RECOMMENDATION s It is respectfully recommended that the City Commission adopt the attached Resolution, authorizing $4,513,945 in applications for Specified/Per Capital/Interest projects to Miami -Dade County as designated herein under the Safe Neighborhood Park Bond Program, Bond Series 2001 (Year 4 funding). The Resolution further authorizes the City Manager to accept said grants and execute the necessary documen-.(s), in a form acceptable to the City Attorney, to implement said grants. In addition, the Resolution authorizes the payment of: (1) supplemental funds required to complete said projects if the costs of said projects exceed the grant allocation; (2) funds to operate, maintain and provide programming az each project upon its completion. BACKGROUND: The attached memorandum dated December 14, 2000 informed the Honorable Mayor and Members of the City Commission that we were submitting Series 2001 (Year 4) Safe Neighborhood Park Bond applications for twenty-two (22) park improvement projects. Funds for these projects came from the originally approved City of Miami allocation of $21,675,000, of which $18 million were for specified projects and $3,675,000 were for unspecified improvements (not assigned to any specific park). Out of the total $21,675,000, approximately $8,060,895 (37sk) has been expended as of April 30, 2001. The new applications totaling $4,513,945 would represent approval to expend $18,290,745 (84%) of our total allocation of $21,675,000. Out of this amount, $14,806,650 (82%) is for specified projects and $3,484,095 (95%) is for unspecified improvements. 01- 557 II�IIIiI�Ii� Honorable Mayor and Members of the City Commission Page 2 of 3 It should be noted that besides the $21,675,000 originally allocated, we have been successful in securing additional Safe Neighborhood Park Bond Program funding in the amount of $2,569,850 for the following projects: a total of $1,793,900 in Challenge Grants for Jose Marti, Shenandoah, Hadley, Virrick and Sampson Parks; $313,950 from our municipal bond interest earnings for Lemon City Park, Maximo Gomez (Domino) Park, expansion and for the Little River Preserve Land Acquisition projects; $227,000 in general municipal bond interest earnings for Virrick Gym and Allapattah Mini Park; and $235,000 in general municipal bond interest earnings to hire temporary staff to manage our construction projects. These projects represent $4,513,945 in funding requests. The applications will be reviewed by the Safe Neighborhood Parks Citizen Advisory Committee in January, 2001. Miami -Dade County will then proceed to sell the necessary bonds to fund the approved projects. It is anticipated that the funding for these improvements will be available some time during the Summer of 2001. These projects will be presented for City Commission ratification and appropriation as soon as possible after they are approved by the County.
