A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AORFEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH MERCHANT PAYMENT SOURCE, INC. FOR THE PROVISION OF AUTOMATIC TELLER MACHINES ("ATM") SERVICES AT THE ORANGE BOWL STADIUM AT NO CHARGE TO THE CITY OF MIAMI, CONTINGENT UPON COMPLIANCE WITH ALL CONDITIONS AND LIMITATIONS AS MAY BE PRESCRIBED BY THE CITY MANAGER OR DESIGNEE. WHEREAS, the Department of Conferences, Conventions and Public Facilities has determined that it would be beneficial to citizens of the City of Miami to provide Automatic Teller. Machines ("ATM") at several locations in the Orange Bowl Stadium for use by attendees at events; and WHEREAS, informal proposals were solicited from four firms for the provision of ATM services and three responses were received, with Merchant Payment Source, Inc. ("Merchant") providing the most advantageous proposal; and an il'DliO CV MAY 2 4 M1 §WWAA" W 01- 530 WHEREAS, Merchant will provide portable ATM machines at the Orange Bowl Stadium on event days and assume full responsibility for the delivery, removal and maintenance of the machines at no charge to the City; and WHEREAS, the City will receive $1.00 for each ATM transaction, generating estimated annual revenues of approximately $45,000; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAM1, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorizedil to execute an Agreement, in a form acceptable to the City Attorney, with Merchant payment Source, Inc. for the provision of ATM services at the Orange Bowl Stadium at no charge to the City of Miami, contingent upon compliance with all conditions and limitations as may be prescribed by the City Manager or designee. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Carlos A. Gimenez to provide ATM services at the City Manager ='' -= u�f'Orange Bowl Stadium RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Resolution authorizing the City Manager to execute an Agreement, in a form acceptable to the City Attorney, with Merchant Payment Source, Inc. for the provision of ATM services at the Orange Bowl Stadium. BACKGROUND The Department of Conferences, Conventions and Public Facilities has determined that it would be advantageous to provide ATM machines at several locations at the Orange Bowl Stadium to provide an opportunity for attendees of events to obtain currency. The benefits to the City would be twofold. The City is guaranteed to receive $1.00 for each ATM transaction. Secondly, attendees would immediately have access to money that could then be spent either for tickets, or for concession or souvenir items. It is estimated that $45,000 in revenues to the City would be generated annually. based on 30 events per year. The Department solicited proposals from the following four firms for the provision of ATM services: Merchant Payment Source, Inc., Automated Access System, Sun Trust, and Manhattan Financial Services. Responses were received from three firms (see attached list), and Merchant Payment Source, Inc. provided the most advantageous proposal. The contract requires no outlay of funds by the City. Merchant Payment Source, Inc. would provide portable ATM machines on event days and assume full responsibility for the delivery, removal, and maintenance of the machines. CAG/FKR/CPA/yp 01- 530
