A RESOLUTION OF THE MIAMI CITY COMMISSION
AMENDING RESOLUTION NO. 00-915 TO INCREASE
COMPENSATION TO SPECIAL COUNSEL FOR THE
NUISANCE ABATEMENT BOARD BY $12,000, FROM
$18,000 TO $30,000; ALLOCATING FUNDS FROM
FISCAL YEAR 2000-•2001 BUDGETED FUNDS OF THE,
OFFICE OF HEARING BOARDS, ACCOUNT CODES
NO. 820101.011, FOR SAID INCREASE.
WHEREAS, pursuant to Resolution No. 00-915, adopted
October 26, 2000, the City Commission allocated $18,000 for
payment of compensation to Special Counsel for the Nuisance
Abatement Board; and
WHEREAS, the expertise and the scope of legal services

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Resolution No. 00-915, adopted
October 26, 2000, is amended in the following particulars:!'

from Fiscal Year Budgeted Funds of the Office of
Hearinca Boards, Account Code No. 820101-011 €e -F
21 This compennation shall be payab a as earned during the period
of such counsel's employment.
Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.3l
Words and/or figures stricken through shall be deleted. Underscored
words and/or figures shall be added. The remaining provisions are now
in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.
'/ If the Mayor does not sign this Resolution, it shall become effective
at the end of ten calendar days from the date it was passed and
adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the city Commission.

Increased compens n for Special Counsel to Nuisance Abatement Board

The attached proposed Resolution provides for a compensation increase, in the amount of
512,000 (from $18,000 to $30,000 annually) for Special Counsel to the Nuisance Abatement
Board Funds for the increase are available from the Fiscal Year 2000-2001 budgeted funds of
the Office of Hearing Boords, Account No. 820101.011.
Special counsel as legal advisor to the Nuisance Abatement Board is required because the
City Attorney cannot both represent and prosecute cases before the Board.
Prior to the City's financial problems, the Special Counsel was compensated in an
amount not to exceed $30,000 annually. The Nuisance Abatement Board has requested that
due to the expertise and scope of legal services provided by the Special Counsel, an increase in
the previously approved compensation of $18,000 annually is appropriate. The compensation
is payable as earned during the period of such counsel's employment, and the increased
compensation will be pro -rated effective June 1, 2001. Services provided by Special Counsel
includes any related litigation services required by the Nuisance Abatement Board.

Compensation increase for Special Counsel to the Nuisance Abatement Board

Attached is a copy of a resolution which is being placed on the City Commission Agenda
for the meeting of May 10, 2001. If approved, payment of increased compensation, in the
amount of $12,000 (from $18,000 to $30,000 annually), for Special Counsel to the Nuisance
Abatement Board will be authorized.
Funds for the compensation increase are available from Fiscal Year 2000-2001 budgeted
funds of the Office of Hearing Boards, Account No. 820101.011. The compensation is payable
as earned during the period of such counsel's employment, and the increased compensation will
be pro -rated effective June 1, 2001.
Please indicate your review and approval below prior to the request being presented to the
City Commission and return this original memorandum to Beverly Solomon, Administrative
Assistant If.
