CITY OF MIAMI
CITY ATTORNEY'S OFFICI 19
MEMORANDUM
TO: Mayor and Members of the Ci o . is '
FROM: Alejandro Vilarello, City o
DATE: May 9, 2001
RE: Proposed Resol o a 24, 2001 City Commission Meeting
Increased Co at' for Spccial Counsel to Code Enforcement Board
(J-01-314)
The attached proposed Resolution provides for a compensation increase, in the amount of
$12,000 (from $18,000 to $30,000 annually), for Special Counsel to the Code Enforcement
Board. Funds for the increase are available from Fiscal Year 2000-2001 budgeted funds of the
Office of Hearing Boards, Account No. 820101-011,
Special counsel as legal advisor to the Code Enforcement Board is required because the
City Attorney cannot both represent and prosecute code violation cases before the Code
Enforcement Board.
Prior to the City's financial problems, the Special Counsel was compensated in an
amount not to exceed $30,000 annually. it is my opinion that due to the expertise and scope of
legal services provided by the Special Counsel, an increase in the previously approved
compensation of $18,000 annually is appropriate. The compensation is payable as earned
during the period of such counsel's employment, and the increased compensation will be pro.
rated effective June 1, 2001. Services provided by Special Counsel includes any related
litigation services required by the Code Enforcement Board.
