A RESOLUTION OF THE MIAMI CITY COMMISSION AMENDING RESOLUTION NO. 00-914 TO INCREASE COMPENSATION TO SPECIAL COUNSEL FOR THE CODE ENFORCEMENT BOARD BY $12,000, FROM $18,000 TO $30,000 ANNUALLY; ALLOCATING FUNDS FROM FISCAL YEAR 2000-2001 BUDGETED FUNDS OF THE OFFICE OF HEARING BOARDS, ACCOUNT CODE NO. 820101-011, FOR SAID INCREASE. WHEREAS, pursuant to Resolution No. 00-914, adopted October 26, 2000, the City Commission allocated $18,000 for payment of compensation to Special Counsel for the Code Enforcement Board; and WHEREAS, the expertise and the scope of legal services provided by the Special Counsel for the Code Enforcement Board warrants an increase in the annual compensation; and WHEREAS, the increased compensation will be pro -rated effective June 1, 2001; NOW, THEREFORE, BE IT RESOLVW BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: . Funds for the increase are available from Fiscal Year 2000-2001 budgeted funds of the Office of Hearing Boards, Account No. 820101-011, Special counsel as legal advisor to the Code Enforcement Board is required because the City Attorney cannot both represent and prosecute code violation cases before the Code Enforcement Board. Prior to the City's financial problems, the Special Counsel was compensated in an amount not to exceed $30,000 annually. it is my opinion that due to the expertise and scope of legal services provided by the Special Counsel, an increase in the previously approved compensation of $18,000 annually is appropriate. The compensation is payable as earned during the period of such counsel's employment, and the increased compensation will be pro. rated effective June 1, 2001. Chiaro Assistant City Attorney DATE: May 8, 2001 RE: Financial review and approval for City Commission Meeting - May 10, 2001 Compensation increase for Special Counsel to the Code Enforcement Board (J-01-314) Attached is a copy of a resolution which is being placed on the City Commission Agenda for the meeting of May 10, 2001. If approved, payment of increased compensation, in the amount of $12,000 (from $18,000 to $30,000 annually), for Special Counsel to the Code Enforcement Board will be authorized. Funds for the compensation increase are available from Fiscal Year 2000-2001 budgeted fiords of the Office of the Hearing Boards, Account No. 820101-011. The compensation is payable as earned during the period of such counsel's employment, and the increased compensation will be pro -rated effective June 1, 2001.
