HomeMy WebLinkAboutR-01-0523J-01-425 5/24/01 RESOLUTION NO. 01- 523 A RESOLUTION OF THE MIAMI CITY COMMISSION RELATED TO THE SEVENTH ANNUAL ROOTS & CULTURE FESTIVAL, CONDUCTED BY THE ROOTS & CULTURE FOUNDATION, INC. (THE "ORGANIZER"), TO BE HELD ON NORTH MIAMI AVENUE, BETWEEN NORTH WEST 54' STREET AND NORTH WEST 62ND STREET ON SATURDAY AND SUNDAY, MAY 26 AND 27, 2001; AUTHORIZING THE CITY MANAGER TO ISSUE A TWO-DAY PERMIT FOR THE SALE OF ALCOHOLIC BEVERAGES DURING SAID EVENT IN THE AREA DESIGNATED HEREIN; AUTHORIZING THE WAIVER OF FEES AND PERMITS, IN AN AMOUNT NOT TO EXCEED $7,442.30, CONSISTING OF DEPARTMENT OF POLICE - PERMIT $100 AND ADMINIS'1'i2ATIVE FEE INCLUDING SURCHARGE $4,986, DEPARTMENT OF FIRE RESCUE - PERMIT $55 AND ADMINISTRATIVE FEE $264, DEPARTMENT OF SOLID WASTE - EQUIPMENT RENTAL $1,788, DEPARTMENT OF PUBLIC WORKS - PERMIT $789.30; DIRECTING THE CITY MANAGER THAT THE ORGANIZER SHALL PAY TO OFFSET THE COSTS FOR CITY PERSONNEL SERVICES, IN AN AMOUNT NOT TO EXCEED $14,000; AND DIRECTING THE CITY MANAGER THAT SAID AUTHORIZATIONS SHALL BE SUBJECT TO THE ORGANIZER: (1) OBTAINING ALL PERMITS REQUIRED BY LAW; (2) PAYING FOR ALL NECESSFRY COSTS OF CITY SERVICES AND APPLICABLE FEES ASSOCIATED WITH SAID EVENT; (3) OBTAINING INSURANCE, INCLUDING BUT NOT LIMITED TO LIQUOR LIABILITY, TO PROTECT THE CITY IN THE AMOUNT AS PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE; (4) INSTITUTING AN IDENTIFICATION PROGRAM TO ASSURE THAT ONLY THOSE INDIVIDUALS OVER THE AGE OF TWENTY-ONE MAY PURCHASE ALCOHOLIC BEVERAGES; AND (6) COMPLYING WITH ALL CONDITIONS AND CiTy CO Q KRETM 411 MAY 2 4 2001 R"*IuU" Ko. _Qi! 523 LIMITATIONS AS MAY BE PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is authorized to issue a two-day permit for the sale of alcoholic beverages during the Seventh Annual Roots & Culture Festival, conducted by The Roots & Culture Foundation, Inc., to be held on Saturday and Sunday, May 26 and 27, 2001, in the area of North Miami Avenue, between North West 54t' Street and North West 62"d Street, including all streets, avenues, alleys, ways and thoroughfares which intersect said areas in Miami, Florida. Section 2. The waiver of all fees and permits permissible by the Code of the City of Miami, Florida, as amended, and the provision of in-kind services, in an amount not to exceed $7,442.30, consisting of Department of Police - permit $100 and administrative fee including surcharge $4,986, Department of Fire Rescue - permit $55 and administrative fee $264, Department of Solid Waste - equipment rental $1,788, and Department of Public Works - permit $789.30, are hereby authorized. Section 3. The organizer shall pay to offset the costs for city personnel services, in an amount not to exceed $14,000. Page 2 of 4 01— 523 Section 4. The herein authorizations are conditioned upon the organizer: (1) obtaining all permits required by law including, but not limited to, a temporary permit to sell alcoholic beverages by the Florida Department of Business Regulation, Division of Alcoholic Beverages and Tobacco, pursuant to Section 54-13 of the Code of the City of Miami, Florida, as amended; (2) paying for all other necessary costs of City services and applicable fees associated with said event; (3) obtaining insurance, including liquor liability, to protect the City in the amount as prescribed by the City Manager or his designee, (4) instituting an identification program to assure that only those individuals over the age of twenty-one may purchase alcoholic beverages; and (5) complying with all conditions and limitations as may be prescribed by the City Manager or his designee. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.11 If the Mayor does not sign this Resolution, it shall become effective at the and of ton calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
