A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT, REVERSING THE DECISION OF THE ZONING BOARD THEREBY GRANTING A SPECIAL EXCEPTION FROM THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, TO ALLOW A MINI -STORAGE FACILITY FOR THE PROPERTY LOCATED AT APPROXIMATELY 5201 SOUTHWEST 8TH STREET, MIAMI, FLORIDA, LEGALLY DESCRIBED IN "EXHIBIT A", SUBJECT TO A TIME LIMITATION OF TWELVE MONTHS TO PULL A BUILDING PERMIT. WHEREAS, the Miami Zoning Board at its meeting of February 26, 2001, Item No. 5, adopted Resolution No. ZB 2001-0407 by a vote of five to four (5-4), denying a Special Exception as hereinafter set forth; and WHEREAS, the applicant has appealed the decision of the Zoning Hoard; and 41 WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding the recommendation of the Zoning Board, finds that the stated grounds for the appeal and the facts presented in support thereof do justify reversing the decision of the zoning Board and granting the Special Exception as hereinafter set forth; ATTACHMENTS) CONTA Ea 01— 518 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission grants the appeal, reverses the decision of the Zoning Board, thereby granting a Special Exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, to allow a mini - storage facility, for the property located at approximately 5201 Southwest 8th Street, Miami, Florida, legally described as shown in "Exhibit An attached hereto and made a part hereof, subject to a time limitation of twelve months to pull a building permit. Section 3. Dear Ms. Fernandez: Pursuant to the provisions of The Zoning Ordinance of the City of Miami, Florida, the applicant, Gables Edge Investments LLC, hereby files its Notice of Appeal and requests review by the City Commission of the denial by the City of Miami Zoning Board of the application for special exception agended as item number 5 for the Zoning Board Hearing held on February 26, 2001 at 7:00 p.m. at City Hall, 3500 Pan American Drive, Miami, Florida 33133. The application for special exception concerned the property located generally at 5201 Southwest Eighth Street, Miami, Florida, and known as case number 2001-0409, the application being for a special exception for use of the property as a mini -storage facility as a conditional principal use as permitted in the present zoning of the property which is C-1 Restricted Commercial. The basis for the appeal. and request for review by the City Commission is the following: 1. The zoning board did not give full consideration to the recommendations to the Director of planning, building and zoning (attached is a copy of the Analysis for Special Exception wherein the Director recommended the approval of the application for special exception as presented); 2. The zoning board did not mace any written findings that the applicable requirements of the zoning ordinance of the City of Miami have or have not been met; 3. The zoning board did not act in accordance with the procedures, standards and requirements of the zoning ordinances including, without limitation, section 1303 of 01- 518 0 • the ordinance; 4. Upon reaching its decision, the Zoning Board did not take the actions as required by the zoning ordinance including, without limitation, the applicant was not informed in writing, with a summary of the reasons therefor, nor was the applicant given notice that complete records on the case were available in a location specified and are public records; 5. The decision of the Zoning Board was based upon a motion made and supported by discussion that denial of the application for special exception was due solely to the fact that the proposed use of the property as a mini - storage facility did not, according to the Zoning Hoard, bring business into the surrounding area on Eighth Street and, therefore, the application for special exception for use of the property as a mini -storage facility was improperly denied. 6. The Zoning Board discussed that the proposed use of the property as a mini storage facility as permitted as a conditional principal use within the C-1 restricted commercial zoning should not be permitted on an arterial roadway such as Eighth Street, however, the zoning ordi- nance provides for this type of use to be preferably located upon property directly served by an arterial roadway. Therefore, it was error for the Zoning Board to consider the character of the roadway as being inappropri- ate for the use of this property as a mini storage facility 7. The planning and zoning department recommended approval of the application for special exception for use of the subject property as a mini storage facility and generally found that: • The proposed use was beneficial to the area in providing a much needed service to the general public • The proposed use was an appropriate use for C-1. restricted commercial zoning designation • The plans submitted comply with all zoning requirements including parking and open space • The proposed facades of the building were well designed and appropriate • The plans submitted by the applicant are in compliance with respect to all other criteria listed in section 1305 of the Zoning Ordinance 8.
