A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE DIRECTOR OF FINANCE TO PAY
TXE TRUST ACCOUNT OF RONALD J. COHEN,
P.A., ON BEHALF OF THE F.O.P., LODGE 20
{FRATERNAL ORDER OF POLICE), ATTORNEY'S
FEES AND COSTS, IN AN AMOUNT NOT TO EXCEED
$100,000, FOR THOSE FEES AND COSTS RELATED
TO A PROPOSED MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF MIAMI AND FORMER
POLICE OFFICER FRANK TAYLOR; ALLOCATING
FUNDS FROM THE SELF-INSURANCE AND
INSURANCE TRUST FUND, INDEX CODE
NO. 515001.624401.6.661.
WHEREAS, former Police Officer Frank Taylor has expended
funds defending criminal charges leveled against him; and
and
WHEREAS, Mr. Taylor was acquitted of the criminal charges;
WHEREAS, Florida law allows the City to reimburse attorney's
fees and costs for public officers when .acquitted in criminal
cases; and

WHEREAS, the City Attorney has reviewed the facts of the
case and has determined that the payment of attorney's fees and
costs, in the amount of $100,000, is reasonable;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The Director of Finance is authorized to pay
the Trust Account of Ronald J. Cohen, P.A., on behalf of the
F.O.P. (Fraternal Order of Police), attorney's fees and costs, in
an amount not to exceed $100,000, for those fees and costs
related to a proposed Memorandum of Understanding between the
City of Miami and former Police Officer Frank Taylor, with funds
allocated from the Self -Insurance and Insurance Trust Fund, Index
Code No. 515001.624401.6.661.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.11
�i If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

RE: Proposed Resolution for May 24, 2001 City Commission Meeting
Payment of reasonable attorney's fees and costs: Frank Taylor (J-01-419)
At the January 11, 2001 meeting, the City Commission adopted Motion 01-024 which
approved the payment of attorney's fees and costs for the successful criminal defense of police
officers Henry Llorella and Frank Taylor, subject to a determination by the City Attorney that the
amount to be paid was reasonable and appropriate.
The invoices related to Frank Taylor's case have been reviewed, and adjustments in
certain sums have been made. and based upon the customary rates paid in the community, the
sum of $100,000 is determined to be reasonable.
I therefore recommend approval of the attached proposed resolution authorizing payment,
in the amount of $100,000, to the Trust Account of Ronald J. Cohen, P.A., on behalf of the
F.O.P. (Fraternal Order of Police). Funds are available from the City of Miami Self -Insurance
and Insurance Trust Fund, Index Code No. 515001.624401.6.661.

Financial review and approval for payment of attorney's fees and costs for
former Police Officer Frank Taylor (J-01-419)
The attached proposed Resolution seeks authorization for payment, in the amount of
$100,000, to the Trust Account of Ronald J. Cohen, P.A., on behalf of the F.O.P. (Fraternal
Order of Police) for the criminal defense of former Police Officer Frank Taylor.
Funds for the fees and costs are available from the City of Miami Self -Insurance and
Insurance Trust Fund, Index Code No. 515001.624401.6.661.
Please indicate your review and approval hereinbelow by affixing your signature and
return this.original memorandum to Beverly Solomon, Administrative Assistant II, of this office
as soon as possible.
