HomeMy WebLinkAboutR-01-0442J-01-255 5/09/01 RESOLUTION NO. 01— 442 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), TRANSFERRING AND ADDING A PORTION OF NORTHWEST 42" COURT, BETWEEN 14" AND 187" STREETS, TOGETHER WITH ALL PUBLIC RIGHT-OF-WAY ADJACENT THERETO, MORE PA,RTIC.ULARLY SHOWN IN "EXHIBIT A", TO THE JURISDICTIONAL RESPONSIBILITY OF THE STATE OF FLORIDA HIGHWAY SYSTEM IN CONFORMANCE WITH SECTION 337.29, FLORIDA STATUTES; CONDITIONING THE TRANSFER AND ADDITION UPON FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") AGREEING TO ASSUME THE RESPONSIBILITY OF THE MAINTENANCE OF THE LANDSCAPING IMPROVEMENTS INSTALLED AS PART OF THE' CONSTRUCTION OF THE MIAMI INTERMODAL CENTER; AUTHORIZING THE FDOT TO RECORD A RIGHT-OF-WAY MAP OF THE SUBJECT ROAD IN THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA; FURTHER AU'T'HORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, Northwest 42"`i Court, between Northwest 14th and 18th Streets, is a dedicated public right-of-way within the City of Miami, Florida; and WHEREAS, the Florida Department of Transportation ("FDOT") is currently preparing plans for the construction of the Miami ATTACHMENT (SIP ovI rI1IiZi�tZ:•b- el" comms mmma or MAY 1 n 2001 iwaawfi n rm. iW 442 0 • Intermodal Center ("MIC") located adjacent to the Miami International Airport and Mel Reese Golf Course; and WHEREAS, a critical component of the MIC plan includes access through Northwest 42nd Court between Northwest 14th and 18th Streets, Miami, Florida; and WHEREAS, FDOT wishes to include a portion of the right-of-way of Northwest 42nd Court, Miami, Florida, in the state highway system to accommodate the proposed roadway and access improvements required for the construction of the MIC; and WHEREAS, as a condition of the said right-of-way transfer and addition to the state highway system, FDOT agrees to assume responsibility for the maintenance of the landscaping improvements installed as part of the construction of MIC; and WHEREAS, in conformance with Section 337.29, Florida Statutes, a right-of-way map of the subject road, more particularly shown in "Exhibit A", has been prepared and will be duly recorded in the Public Records of Miami -Dade County, Florida, by the FDOT; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorpora--ed as if fully set forth in this Section. Page 2 of 4 01- 442 91I1I/il 0 E • Section 2. A portion of Northwest 42nd Court, between Northwest 14th and 18" Streets, together with all public right-of-way adjacent thereto, more particularly shown _ in "Exhibit A", is transferred and added to the jurisdictional responsibility of the State of Florida highway system in conformance with Section 337.29, Florida Statutes. Section 3. As a condition of said transfer and addition:, FDOT agrees to assume the responsibility of the maintenance of the landscaping improvements installed as part of the construction of the Miami Intermodal Center. Section 4. FDOT is authorized to record a right-of-way map of the subject road in the Public Records of Miami -Dade County, Florida, Section 5. The city Manager is authorizedll to execute the necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor./ 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but iiot limited to those proscribed by applicable city Charter and code provisions. If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. It the Mayor vetoes this Resolution, it shall become effective immediately upon override of 4he veto by the city Commission. BACKGROUND The Florida Department of Transportation (FDOT) is currently preparing plans for the construction of the Miami Intermodal Center (MIC) located adjacent to Miami International Airport and the City's Met Reese Golf Course. In cooperation with the FOOT, the City Commission adopted Resolution No. 01-010 on January 11, 2001 transferring several roadways to the jurisdiction of the State that are necessary to accommodate the design and construction of the MIC. Due to the magnitude of the project, the design of the MIC has been revised for the .' intersection with the East-West Expressway (S.R. 838) requiring an additional roadway transfer to the State of NW 42 Court between NW 14 Street to NW 18 Street. The FDOT is formally requesting the transfer of the jurisdiction of this additional City of Miami roadway to the State to accommodate the design and construction of the MIC at its intersection with the East-West Expressway The FOOT has prepared the necessary right-of-way map for the subject area to be transferred and will be responsible for all costs to construct the MIC improvements. This Resolution permits the proper recording of the required right-of-way map to effect the transfer of jurisdiction.
