A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY MANAGER AND THE CITY
ATTORNEY TO SEEK AN AMENDMENT TO THE RESTATED
COMPOST RECYCLING AGREEMENT ATTEMPTING TO
RESOLVE ISSUES RELATED TO THE SETTLEMENT OF
THE LAWSUIT BEDMINSTER SEACOR SERVICES MIAMI
CORPORATION V. THEi _CITY OF MIAMI, IN THE
CIRCUIT COURT OF THE ELEVENTH JUDICIAL
CIRCUIT, CASE NO. 98-20458 CA 32, AND TO
DEVELOP AN AMENDMENT TO THE AGREEMENT, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH
BEDMINSTER SEACOR SERVICES MIAMI CORPORATION
TO PRESENT TO THE CITY COMMISSION FOR
APPROVAL.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Manager and the City Attorney are
authorizedl' to seek an amendment to the Restated Compost
Recycling Agreement attempting to resolve issues related to the
settlement of the lawsuit BEDMINSTER SEACOR SERVICES MIAMI
CORPORATION V. THE CITY OF MIAMI, in the Circuit Court of the
Eleventh Judicial Circuit, Case No. 98-20458 CA 32, and to
develop an amendment to the Agreement, in a form acceptable to

requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.11

Bedminster Negotiations
After meeting with the representative of Bedminster Seacor Services Miami
Corporation concerning its proposal to resolve the litigation between
Bedminster and the City, I am encouraged that the issues related to the
litigation could be resolved through negotiation of an amendment to the
Restated Compost Recycling Agreement to provide the City of Miami with
residential waste disposal services.
The representatives from Bedminster Seacor Services Miami Corporation
would like to answer any questions the City Commission may have. I request
that the City Commission discuss this matter at 11:00 a.m. at the City
Commission Meeting on Thursday, May 10, 2001, to consider the attached
resolution authorizing the City Manager and the City Attorney to continue
negotiations toward an ultimate resolution which could result in an amended
agreement between the City and Bedminster that would be considered by the
City Commission.
