A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY CLERK TO LOAN THE CITY OF MIAMI HISTORIC COLLECTION OF PHOTOGRAPHS AND NEGATIVES TO THE HISTORICAL MUSEUM OF SOUTHERN FLORIDA, LOCATED AT 101 WEST FLAGLER STREET, MIAMI, FLORIDA; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, pursuant to Section 2-48 of the Miami City Code, the City Clerk is the designated custodian of City of Miami Public Records; and WHEREAS, a collection of negatives and photographs of Miami taken between 1940 and 1990 has been identified by the City Clerk; and WHEREAS, the Office of the City Clerk lacks the resources to preserve, maintain and provide public access to said collection; and WHEREAS, the Historical Museum of Southern Florida has agreed to accept, preserve, maintain, and provide public access to the photographic collection on a nonpermanent basis; CITY cordb ISSION DU=NG OF APR 2 6 2001 Reeak"Wo kiw. 01- 400 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Clerk is authorized to loan the City of Miami historic collection of photographs and negatives to the Historical Museum of Southern Florida, located at 101 West Flagler Street, Miami, Florida. Section 3. The City Manager is authorizedll to execute the necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor .2/ 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2/ If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
