HomeMy WebLinkAboutR-01-0373J-01-261 4/10/01 RESOLUTION NO. 01' 373 A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOUR-FIFTHS (4/5THS ) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING THE BAYFRONT PARK MANAGEMENT TRUST'S ("TRUST") EXECUTIVE DIRECTOR'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE ACQUISITION AND INSTALLATION OF A MOELLER CIRCUIT BREAKER NZM12-800/ZM12A-700-NA FROM FLORIDA BEARINGS, INC. FOR THE MILDRED AND CLAUDE PEPPER FOUNTAIN AT BAYFRONT PARK, IN AN AMOUNT NOT TO EXCEED $4,916.71; ALLOCATING FUNDS FROM THE GENERAL OPERATING BUDGET OF THE TRUST. WHEREAS, the Mildred and Claude Pepper Fountain (the "Fountain"), located at the Bayfront Park, is a premier attraction in Downtown Miami which operates 24 hours a day; and WHEREAS, the Trust required the acquisition and installation of a Moeller circuit breaker NZM12-800/ZM12A-700-NA to replace the circuit breaker which was damaged by water seepage and caused the electrical power necessary to operate the pumps, fans and computers for the Fountain to shut down; and WHEREAS, the Executive Director of the Trust made a written finding that the acquisition and installation of the circuit CITY COMUSSION MMI NG OF APR 2 6 2001 X173 breaker for the Fountain constituted a valid emergency and recommended that the requirements for competitive sealed bidding procedures be waived and authorized the acquisition and installation of the circuit breaker from Florida Bearings, Inc.; and WHEREAS, funds for the acquisition and installation of the circuit breaker are available from the General Operating Budget of the Trust; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5th,) affirmative vote of the members of the City Commission, the Trust's Executive Director's finding of an emergency, waiving the requirements for competitive sealed bidding procedures and approving the acquisition and installation of a Moeller circuit breaker NZM12-800/ZM12A-700-NA from Florida Bearings, Inc. for the Mildred and Claude Pepper Fountain at Bayfront Park, in an amount not to exceed $4,916.71, is ratified, approved and confirmed, with funds allocated from the General Operating Budget of the Trust. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. Constantz Executive Direct( RECOMMENDATION 31 DATE: March 14, 2001 SUBJECT: Resolution — Ratifying the Executive Director of Bayfront Park's Emergency Finding for Repair to the Mildred and Claude Pepper Fountain at Bayfront Park It is respectfully recommended that the Miami City Commission adopt the attached Resolution ratifying, approving and confirming the Executive Director of the Bayfront Park Management Trust's finding of an emergency, waiving the requirements for competitive sealed bids and approving the acquisition and installation of a Moeller Circuit Breaker NZM12-800/ZM12A-700-NA from Florida Bearings, Inc., for the Mildred and Claude Pepper Fountain at Bayfront Park, in an amount not to exceed $4,916.71. Funding is available from the Bayfront Park Management Trust Operating Budget. BACKGROUND The Bayfront Park Management Trust was created by the Miami City Commission to direct, operate, manage and maintain all aspects of Bayfront Park with the goal of ensuring maximum community involvement. On Friday, November 24, 2000, water seepage through electrical conduit in Bayfront Park's Mildred and Claude Pepper Fountain damaged the main breaker (Moeller Circuit Breaker NZM12-800/2M12A-700-NA). The breaker was deemed irreparable by the park's electrician as well as an electrical contractor, Elohim Electric, identified through the City of Miami's General Building/Specialty Trade Services city —wide contract. The breaker's failure left the fountain complex without electrical power, which is essential to keeping its pumps, fans and computers operating. The longer that situation continues, the more likely further deterioration would result. Staff contacted Moeller representatives in Atlanta, who put them contact a local firm, Florida Bearings, Inc., who located the part in Cleveland, Ohio. This purchase is deemed an emergency because the immediate procurement of the Moeller Breaker is essential to the safety and convenience of the city. JCC/ts 01- 473
