A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE CITY OF MIAMI'S LOCAL HOUSING ASSISTANCE PLAN FOR THE PERIOD OF JULY 1, 2001 THROUGH JUNE 30, 2004, PURSUANT TO THE CITY'S CONTINUED PARTICIPATION IN THE STATE OF FLORIDA'S STATE HOUSING INITIATIVES PARTNERSHIP ("SHIP") PROGRAM; AUTHORIZING THE CITY MANAGER TO SUBMIT THE LOCAL HOUSING ASSISTANCE PLAN, ATTACHED AND INCORPORATED, FOR REVIEW AND APPROVAL BY THE FLORIDA HOUSING FINANCE CORPORATION; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT THE TERMS AND CONDITIONS OF THE SHIP PROGRAM AND THE LOCAL HOUSING ASSISTANCE PLAN; ESTABLISHING THE ACTIVITIES TO BE IMPLEMENTED BY THE PLAN; AND INCREASING THE ADMINISTRATIVE COSTS FOR IMPLEMENTATION OF THE SHIP PROGRAM FROM FIVE TO TEN PERCENT. WHEREAS, on July 7, 1992, the State of Florida enacted the William E. Sadowski Affordable Housing Act ("Sadowski Act"), which provides for the allocation a portion of new and existing documentary stamp taxes on deeds on real estate transactions to local governments for the development and maintenance of affordable housing; and ?i 11 At' Cx� APR 2 6 2001 aea0iUtim ate►. 01- 370.4 WHEREAS, the Sadowski Act provided a dedicated revenue source for affordable housing and created the State Housing Initiatives Partnership Program ("SHIP Program"); and WHEREAS, in August, 1994, the City of Miami was notified by the State of Florida ("State") that the City would be eligible to receive $1,353,387 in SHIP Program funds beginning with the State's 1995-1996 Fiscal Year; and WHEREAS, the City has since received approximately $1.3 to $1.9 million annually from the State in connection with the SHIP Program; and WHEREAS, Resolution No. 99-705, adopted September 28, 1999, approved the City's revised Local Housing Assistance Plan (the "Plan"), enabling the City to expand the number of housing assistance programs available to very low, low and moderate income eligible families and the elderly; and WHEREAS, the City is projected to receive approximately $1,904,695 in SHIP Program funds from the State for the 2001-2002 Fiscal Year for implementation of the Program; and WHEREAS, it is required that the City submit to the State of Florida Housing Finance Corporation a Local Housing Assistance Plan covering Fiscal Years 2001-2002, 2002-2003 and 2003-2004 to ensure continued eligibility for participation in the SHIP Program; and 01. 370.1 Page 2 of 8 WHEREAS, in an effort to further promote the City's goals to preserve the existing residential housing stock and provide homeownership opportunities to the City's very low, low and moderate income families and the elderly, the Administration recommends that the Commission adopt the attached Local Housing Assistance Plan, attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City of Miami's revised Local Housing Assistance Plan covering Fiscal Years 2001-2002, 2002-2003 and 2003-2004, attached and incorporated, prepared pursuant to the implementation of the SHIP Program, is approved. Section 3. The City Manager is authorized to submit said Plan to the State of Florida Housing Finance Corporation for review and approval. Section 4. The City Manager is authorized!' to execute any all documents and agreements, in a form acceptable to the v The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Page 3 of 8 01— 370-1 City Attorney, to carry out the terms and conditions of the SHIP Program and the Plan. Section 5. It is established that any funds received by the City pursuant to the SHIP Program to implement the Plan, shall be used to carry out the following activities: 1. Sinqle Family Rehabilitation Proaram This Program will provide rehabilitation assistance to very low, low and moderate income persons and the elderly who occupy and maintain single-family residences within the City of Miami. Financial assistance will be provided in the form of a zero percent (0%) deferred payment loan secured by the property, and will be forgiven on a pro -rata basis of ten percent (10%) per year for a ten-year term, as long as the applicant homeowner continues to own and occupy the property. Should the homeowner die and an income eligible heir inherits the property during the ten (10) year period, the heir will not be required to repay the pro -rata balance, but will be allowed to assume the mortgage provided that the heir becomes the owner -occupant. A maximum of up to $40,000 in financial assistance will be available under this strategy for homeowners who reside and maintain the property as their principal residence. Page 4 of 8 01— 370.1 2. Homebuyers Financing Program The Homebuyers Financing Program will provide down payment/closing costs and/or second mortgage financing assistance to qualified very low, low and moderate income persons and the elderly to assist in the purchase of newly constructed affordable homeownership housing units developed by not-for-profit housing corporations, private developers or the purchase of an existing residential property located within the corporate limits of the City. To qualify for financial assistance under this strategy, homebuyers must have received a commitment from a first mortgage lender for the purchase of the residential unit. The property must be owner occupied. Financial assistance provided will be in the form of a zero (0%) percent deferred payment loan secured by the property, and will be forgiven on a pro -rata basis of ten (100) percent over a ten-year term, as long as the housing unit is owned and occupied by the homeowner. The financial assistance provided will be due and payable to the City if the property is leased, sold to a subsequent homebuyer or upon refinancing by the current homeowner. The homeowner must complete any rehabilitation under this strategy within twelve months after the culmination of the home purchase. A maximum of up to $40,000 in financial assistance will be Page 5 of 8 01- 370,91 available to homebuyers who reside and maintain the property as their principal residence. 3. Single Family Replacement Housing Program The Single Family Replacement Housing Program will be utilized to replace dilapidated owner -occupied housing units that are not suitable for rehabilitation. A maximum of $75,000 per unit will be made available to construct a new housing unit on land owned by the existing homeowner/applicant or on a vacant residential property that may be available and owned by the City or Miami -Dade County. Financial assistance under this strategy will be made available on an as -needed basis. Funds will be awarded in the form of a zero (0%) percent interest deferred payment loan secured by the property. The assistance provided under this strategy will be forgiven on a pro -rata basis over a fifteen -year term, as long as the housing unit is owned and occupied by the applicant. If the property is rented, leased or sold during the fifteen (15) year period, the balance remaining on the loan will become due and payable to the City of Miami at that time. If the property is not rented, leased or sold during the fifteen (15) year term, the loan shall be considered paid in full. In the event of death of all eligible Page 6 of 8 01— 370.1 homeowner(s), an heir to the property can assume the obligation of the original owner as long as the heir is income eligible, remains the owner -occupant of the property and does not sell or rent the property for the remaining term of the loan. 4. Homeownership Development Program The Homeownership Development Program is designed to increase homeownership opportunities for very low and low and moderate income persons by creating new affordable homeownership housing units in the City. SHIP Program funds will be used for the cost of land acquisition, site development, construction and permanent financing associated with the development of affordable housing units. SHIP Program funds utilized under this strategy for construction by the developer can be converted into downpayment, mortgage buydown or closing costs assistance to the prospective homebuyer of the newly constructed housing units. Housing projects assisted through this program can receive financial assistance up to $40,000/unit. Section 6. The City Commission finds that five percent (5%) of the local housing distribution plus five percent (5%) of program income is insufficient to adequately pay the necessary Page 7 of 8 01- 370. costs of administering the Plan, therefore, the City's administrative cost limit for implementation of the City's SHIP Program is increased from five percent (5%) to.ten (10%) percent of the SHIP Program funding allocation. PROGRAM DESCRIPTION a. Participating Local Government The City of Miami, a municipal corporation established under the laws of the State of Florida has developed this Local Housing Assistance Plan (hereinafter referred to as the "Plan") to comply with the requirements of the William E. Sadowski Affordable Housing Act. This Plan describes the activities the City of Miami will undertake to meet the affordable housing needs of it's very low, low and moderate -income residents as defined in section 420.9071, Florida Statutes using State Housing Initiatives Partnership Act (SHIP) funds in accordance with the requirements of Section 420.907 of the Florida Statutes and Chapter 67-37 of the Florida Administrative Code. On July 7, 1992, the William E. Sadowski Affordable Housing Act was signed into law. The centerpiece of this legislation is the State Housing Partnership Act which provides a dedicated revenue source to state and local governments to facilitate the creation of public/private partnerships whose purpose is to preserve the existing housing stock and stimulate the production of new affordable housing. b. Program Description For State FY 2001-2002, FY 202-2003, and FY 2003 — 2004, the City of Miami will use 90% of its SHIP allocation to undertake various homeownership activities designed to enhance and facilitate the development, purchase and maintenance of housing units in the City. These housing strategies and activities will be carry -out through the SHIP assisted Single Family Rehabilitation Program, Homebuyers Financing Program, Single Family Replacement Housing Program and Home- ownership Development Program These activities will involved the construction, reconstruction, rehabilitation and acquisition/purchase of housing to be occupied by very low, low and moderate income households and homeowners with incomes at or below 120% of the area median income adjusted for family We 370 -1 size. The remaining 10% will be used to cover administrative expenses associated with implementation of the SHIP Program. Where the program strategy refers to very low, low and moderate income persons or households, it shall be in accordance with Section 420.907, Florida Statutes as follows: • Very low income is defined as one or more natural persons or a family that has a total annual gross household income that does not exceed 50% of the median annual income adjusted for family size for households within the Metropolitan Statistical Area. • Low-income is defined as one or more natural persons or a family that has a total annual gross household income that does not exceed 80% of the median annual income adjusted for family size for households within the Metropolitan Statistical area. • Moderate income is defined as one or more natural persons or a family that has a total annual gross household income that does not exceed 120% of the median annual income adjusted for family size for households within the Metropolitan Statistical Area. The Department of Community Development staff will perform mid -year and end year to ensure compliance with the program statutory requirements in accordance with Chapter 67-37, Florida Administrative Code. c. Plan Period The City of Miami Local Housing Assistance Plan will cover a three (3) year period, State Fiscal Years 2001-2002, 2002 — 2003 and 2003 — 2004. This Plan and any plan amendments will become effective immediately upon adoption by the Mayor and City Commission and subsequent approval by the Florida Housing Finance Corporation. d. Public Input and the Local Housing Assistance Plan Development Process The City of Miami implemented an extensive Citizen Participation process that included a series of public meeting at the Citywide Community Development Advisory Board level culminated by six (6) Public hearing held in individual City Commissioner's districts. The District Public Hearings were co-chaired by the Chairperson of the Citywide Community Development Advisory Board and the City Commissioner representing each of the City's five (5) districts. The Districts Public Hearings represented a new concept in the City of Miami's planning process to develop its U. S. Department of Housing and Urban Development approved Five (5) Year Consolidated Plan (1999-2004). At each of the Pubic Hearings recognized professionals in the area of Housing, Economic Development, Public Services and Workforce Development were invited to present objective testimonies in their area of expertise intended to provide pertinent insights to the general public, Advisory Board Members and elected officials. 2 01— 3PIO o In addition, an advertisement was placed in the local newspaper of major circulation requesting input from citizens and all interested parties in the development of this three (3) year Local Housing Assistance Plan. This Plan outlines the housing programs and strategies which will be implemented on an annual basis to assist the City of Miami in addressing its housing needs utilizing the SHIP and how those objectives will be accomplished. The housing strategies outlined in the Local Housing Assistance Plan are consistent with the City's Five (S) Year Consolidated Plan (1999 — 2004). e. Supportive Services Each applicant that applies for assistance under the SHIP Programs will receive assistance, counseling and referral to other programs that provides services that they may need. The City of Miami will work with members of the Housing Partnership to provide support services to -those residents/homeowners participating in the various housing programs. Services include but are not limited to: • Assistance/referral to Legal Services of Miami, Inc. homeowners who have title problems or outstanding liens that would prohibit their participation in the program. • Applicants that do not qualify for assistance will receive referrals to other agencies and programs that they may qualify for. • Assist homeowner(s) participating in the Single Family Rehabilitation and Single Family Housing Replacement Programs throughout the rehabilitation /reconstruction process from the time of application until project completion. • Referrals to consumer credit clinics and homebuyer counseling programs provided by local lenders and non-profit organizations. • Referrals to the Office of Workforce Development for employment and job training. • Referrals to the appropriate local agencies for fair housing assistance, information and counseling. • Legal aid referrals for counseling and guidance on other legal matters. SECTION II. INTERLOCAL AGREEMENT This plan is not governed by an inter -local agreement. 3 01- 370.1 SECTION III. LOCAL HOUSING PARTNERSHIPS a. Development of Partnerships The City of Miami has developed and worked in Partnership with various non-profit and private for profit housing developers and agencies to facilitate the production and rehabilitation of affordable housing units in the City. The City of Miami works in partnership with various community housing development organizations and community development corporations that include the following agencies: • Allapattah Business Development Authority, Inc. • BAME Development Corporation of South Florida, Inc. • CODEC, Inc. • East Little Havana Community Development Corporation • Miami Beach Community Development Corporation • Greater Miami Neighborhoods, Inc. • Habitat for Humanity of Greater Miami, Inc. • Little Haiti Housing Association, Inc. • Jubilee Community Development Corporation • St. John Community Development Corporation In addition, the City of Miami works with local lenders and Realtors, Fannie Mae, Local Initiatives Support Corporation (LISC), Model City Affordable Housing Planning Work Group, Miami -Dade Housing Agency, Consumer Credit Counseling Services and many other service providers to provide referrals, services expertise and resources to better serve the residents of our community. These organizations will be encouraged to continue to participate in program activities and to assist in program implementation. b. Strategies to Reduce Cost • The City of Miami will work closely with Miami Dade County's Office of Community Development and Miami Dade Housing Agency to leverage available financial resources in the financing of affordable housing projects sponsored by not-for-profit and for-profit housing developers planned in the City. • The City of Miami will allocate funds under the federally funded CDBG and Home Programs to fund a Residential Emergency Grant Program and expansion of the Single Family Rehabilitation Homebuyers Financing Programs. These programs will assist in reducing the overall cost of funds needed to assist properties under the various strategies assisted with SHIP Program funds. 4 01_ 370.1 • Assistance will be provided in the form of deferred payment loans to prevent additional cost burdens on very low, low and moderate income households and ensure that homeowners can remain in their homes after the assistance is provided. SECTION IV. HOUSING STRATEGIES la. SHIP Single Family Rehabilitation Program a. Strategy Description The Single Family Rehabilitation Program will provide rehabilitation assistance to very low, low and moderate income residents who live in single family owner -occupied properties located within the corporate limits of the City of Miami. The property must require needed repairs to meet the -- decent, safe and sanitary standard and must not be in violation of any housing codes after rehabilitation. The City of Miami, Department of Community Development will be the primary agency responsible for the implementation of the Local Housing Assistance Plan Strategy. b. Strategy Period The strategy identified in this section will be used to carry out the Housing Assistance Plan for State Fiscal Years 2001 — 2002, 2002 — 2003, 2003 — 2004. The three (3) year strategy will cover homeownership activities. C. Income Category to be Served Available SHIP funds shall be reserved for housing units occupied by income eligible persons or households. To comply with the overall requirements under Title 67-37 of the Florida Administrative Code, eligible persons or households will be very low, low and moderate income. d. Selection Criteria All recipients of assistance must meet the eligibility requirements as stipulated in the Florida Statutes, the SHIP Ordinance, Resolution and this Plan. Eligible housing includes single family homes, town houses or twin homes. Manufactured housing and mobile homes are not eligible for assistance under this program. The properties to be assisted must be owner -occupied and located within the ccrperate limits of the City of Miami. Applications will be processed on a first -come -first serve basis from all applicants meeting the selection criteria, subject to funding availability and in such a manner as to comply with the statutory requirements to meet the following benchmarks: Very low income households will receive preferential consideration for SHIP funding until at least thirty percent (30%) of the funds have been reserved for the benefit of very low- income persons or households. 01_ 3'70'1 • Low-income households will receive preferential consideration for SHIP funding until at least thirty percent (30%) of the annual allocation set-aside to carry -out the program strategy have been reserved for the benefit of the low-income persons or households. • The remainder of SHIP Program funds may be made available for the benefit of moderate - income persons or households. • Applicants with household income above (120%) of the median area income limit are ineligible for SHIP assistance under this strategy. • Staff will review actual performance data on a continuous basis to ensure that adjustments are made as necessary to remain in compliance with funding requirements. Other selection criteria will include the following: • The property shall consist of one (1) owner -occupied residential unit. • The property must be located in the City of Miami. • The appraised value of the home may not exceed the maximum sales price (value) allowed under the SHIP Program. • The property must require needed repairs to meet the decent, safe and sanitary standard and must not be in violation of any housing codes after rehabilitation. • The maximum amount of financial assistance to be provided may not exceed the lesser of (1) the actual cost of rehabilitation or (2) $40,000. • The applicant may not be delinquent on any debt owned to the City of Miami or Miami - Dade County. e. Recapture Provisions Financial assistance to be provided under the SHIP Single Family Rehabilitation Program will be provided in the form of a zero (0%) percent, ten (10) year deferred payment loan secured by the property, that will be forgiven ten (10%) percent per year while the homeowner continues to own and occupy the property as their principal residence. There are no monthly payments associated with this loan. In the event the property receiving financial assistance is rented, leased or sold during the ten (10) year period, the pro -rata balance of the loan must be paid back to the City of Miami. In the event of death of all eligible homeowner(s), the heirs to the property can assume the obligation of the original owner as long as the heirs are income -eligible, remain owner occupants of the property and do not sell or rent the property for the remaining term of the mortgage and note. Homeowners who qualify and receive assistance must execute a Deferred Payment Loan Mortgage 6 01- 370-1 and Note that will be filed with the Miami -Dade County Clerk of the Circuit Court for compliance with the recapture provisions for the program. E Leveraging The City of Miami will also use its Home Program funds from the U.S. Department of Housing and Urban Development expand the availability of funding available for this strategy thereby leveraging the SHIP funds. g. Strategy Implementation The City of Miami, Department of Community Development will be the primary agency responsible for carrying out this strategy under the Housing Assistance Plan and does not anticipate the use of a sponsor to carry out program activities. However, if the need for a sponsor should arise, the City of Miami will use a Request for Proposals process in accordance with State Rule 67- 37.005(6)b(7) Florida Administrative code to select an eligible sponsor. Eligible persons, sponsors or other recipients of assistance under this program will be required to contractually commit and comply with all SHIP Program requirements. 2b. Homebuyers Financing Program a. Strategy Description The City of Miami through the Homebuyers Financing Program will provide downpayment, closing cost and/or second mortgage financing assistance to eligible persons and households who are first time homebuyers to purchase a newly constructed or existing residential properties within the City of Miami. The strategy will be available to assist very low, low and moderate income residents to purchase a single family home, town home or condominium. b. Strategy Period The strategy identified in this Section is a three (3) year strategy covering the State Fiscal Years 2001— 2002, 2002 —2003,2003 — 2004. c. Income Category to be Served Available STIP funds shall be reserved for eligible persons and households. To comply with the overall requirements under Title 67-37 of the Florida Administrative Code, thirty percent (30%) of the SHIP funds must be reserved for persons or households who are very low-income. Another thirty percent (30%) of the SHIP funds must be reserved for persons or households who are low- income. The remaining SHIP funds will be used to assist persons or households who are moderate income. 01- 370#1 d. Selection Criteria All recipients of financial assistance must meet the eligibility requirements as provided in the Florida Statutes, SHIP Program Ordinance, Resolution, the Plan and this Strategy. Eligible housing includes single family homes, a townhouse or a condominium unit. Mobile homes are not eligible for assistance under this program. The properties to be purchase must be located within the corporate limits of the City of Miami. Participants shall be first time homebuyers. A first time homebuyer is defined as someone who has not owned a home within the last three (3) years. Applicants will be processed from an existing waiting list, on a first come first serve basis, subject to funding availability and in such a manner as to comply with the statutory requirements to achieve following benchmarks: • Very low-income households will receive preferential consideration for funding until at least thirty (30%) percent of the annual allocation set aside to carry out program strategies have been reserved for the benefit of the very low-income persons or households. • Low-income households will receive preferential consideration for funding until at least thirty (30%) percent of the annual allocation set aside to carry out program strategies have been reserved for the benefit of the very low-income persons or households. • Low-income households will receive preferential consideration for funding until at least thirty (30%) percent of the annual allocation set aside to carry out program strategies have been reserved for the benefit of the low-income persons or households. • The remainder of SHIP Program funds will be reserved for the benefit of moderate -income persons or households. • Applicants with household incomes above one hundred twenty (120%) percent of the median area income limit are ineligible for SHIP Program assistance under this strategy. • Staff will review actual performance data on a continuous basis to ensure that adjustments are made as necessary to remain in compliance with SHIP funding requirements. • Eligible properties are those where the proposed sales price or value, based on an appraisal performed by a state certified appraiser of a new or existing home purchased or rehabilitated using SHIP Program funds, does not exceed 90% of the median area purchase price for either new or existing housing as applicable, for the area where the housing is located, as approved by the Florida Housing Finance Corporation. • SHIP funds for this strategy may be used for downpayment, closing cost, second mortgage financing and repairs. Properties receiving financial assistance under this strategy that are in need of minor repairs, the repairs must be completed within twelve (12) months immediately after the purchase closing. Ship funds allocated to address repairs will be deposited into an OI- 370,! escrow account at the time of closing and disbursed once the rehabilitation of the unit is completed. The City of Miami retains the right to inspect the repairs that have been completed on the property. • Monthly mortgage payments, including taxes and insurance shall not exceed thirty (30%) percent of an amount representing the percentage of the area's median annual gross income for the household, unless the first mortgage lender is satisfied that the household can afford mortgage payments in excess of the thirty (30%) percent benchmark, based on the first mortgage loan approval. • The maximum amount of financial assistance to be provided may not exceed $40,000. e. Recapture Provisions Financing assistance to be provided under the SHIP Homebuyers Financing Program will be provided in the form of a zero (0%) percent, ten (10) year deferred payment loan secured by the property, that will be forgiven ten (10%) percent per year while the homeowner continues to own and occupy the property as their principal residence. There are not monthly payments associated with this loan. In the event the property receiving financial assistance is rented, leased or sold during the ten (10) year period, the pro -rata balance of the loan must be paid back to the City of Miami. In the event of death of all eligible homeowner(s) the heirs to the property can assume the obligation of the original owner as long as the heirs are income -eligible, remain owner occupants of the property and do not sell or rent the property for the remaining term of the mortgage and note. Homeowners who qualify and receive assistance must execute a Deferred Payment Loan Mortgage and Note that will be field with the Miami -Dade County Clerk of the Circuit Court for compliance with the recapture provisions of the program. E Leveraging The City of Miami will also use its Home Program funds from the U. S. Department of Housing and Urban Development to expand the availability of funding available for this strategy thereby leveraging the SHIP funds. The City of Miami will also use loan(s) provided by the first mortgage lender to leverage its SHIP Program funds. The City will also encourage lenders to use bond programs provided through Miami -Dade County's Housing Finance Agency, and programs administered by Metro -Miami Action Plan (',EMAP) and Miami -Dade Housing Agency that makes available funds to assist homebuyers with second mortgage -financing, down payment, closing cost assistance, reduction of interest rates, fees and points. Participating lenders will be those who submitted letters of interest to the City under the SHIP and Home assisted Homebuyers Financing Programs. 01- 370.1 g. Strategy Implementation The City of Miami, Department of Community Development will be the primary agency responsible for carrying out this strategy under the Housing Assistance Plan and does not anticipate the use of a sponsor to carry out program activities. However, if the need for a sponsor should arise, the City of Miami will use a Request for Proposals process in accordance with State Rule 67- 37.005(6)b(7) Florida Administrative code to select an eligible sponsor. Eligible persons, sponsors or other recipients of assistance under this program will be required to contractually commit and comply with all SHIP Program requirements. 3c. SHIP Single Family Replacement Housing Program a. Strategy Description The Single Family Replacement Housing Program is designed to address substandard and dilapidated housing units that the cost of repairs or poor housing conditions cannot be addressed through the SHIP and Home assisted Single Family Rehabilitation Programs. Under this strategy, only single family residential property/(ies) which are beyond repair and unsafe for human habitation will be provided assistance. The SHIP Program housing inspection unit will make the determination regarding the economical feasibility (cost) and soundness of the structure, in consultation with the City of Miami Building Department. The SHIP funds will be used to defray the cost of temporary relocation expenses, demolition of the dilapidated structure, soft and hard construction costs associated with the reconstruction of the new home. This strategy will be used to primarily to assist existing owners of single family homes where the must appropriate solution to their housing problem would be to demolish the existing structure and replace it with a newly constructed housing unit on the exiting lot. b. Strategy Period The strategy identified in this Section is a three (3) year strategy covering the State Fiscal Years 2001 —2002,2002— 2003, 2003 —2004. C. Income Category to be Served Available SHIP funds shall be reserved for income eligible persons and households who occupy the property as there principal residence. To comply with the overall requirements under Title 67 of the Florida Administrative Code, eligible persons and households will be very low, low or moderate income. d. Selection Criteria All recipients of financial assistance must meet the eligibility requirements as provided in the Florida Statutes, the SHIP Program Ordinance, Resolution, the Plan and this Strategy. Eligible 10 ai- 370. housing includes single family owner -occupied homes that have been determined by the housing inspector, in consultation with the Department of Building has been determined to be beyond repair, unsafe for human habilitation and suitable for demolition. Mobile homes or manufactured homes will not be a type of replacement home offered under this strategy. The properties to be assisted must be the primary residence of the owner and the property must be located within the corporate limits of the City of Miami. Staff will review actual performance data on a continuous basis to ensure that adjustments are made as necessary to remain in compliance with SHIP funding requirements. • For eligible persons or households who are building a new home on land that they own, a State -certified Appraiser will determine the sales price or value of the newly constructed unit. The appraisal must include the land value and the after construction value of the property and must be dated within twelve (12) months of the date construction is to commence. • The amount of the financial assistance provided will be the full cost of demolition, temporary relocation and reconstruction of the property to include hard and soft cost, not to exceed $75,000. The following costs associated with this strategy are eligible: 1. Hard cost which are typical and customarily viewed as construction cost(s) by institutional lenders; 2. Payment of impact fees; 01- 370 •1 3. Infrastructure fees typically paid by the developer; 4. Construction soft cost such as architectural and engineering fees, appraisals, if directly related to housing construction. 5. Temporary relocation cost associated with the reconstruction of the home. e. Recapture Provisions The financial assistance provided under this strategy will be provided in the form of a zero (0%) percent interest deferred payment loan secured by the property, that will be forgiven over a fifteen (15) year period from the date of loan closing. There is no monthly payment associated with this loan. Persons or households that qualify and receive financial assistance must execute a Deferred Payment Loan Mortgage and Note that will be filed with the Miami -Dade County Clerk of the Circuit Court for compliance with the recapture provisions for the program. This mortgage will remain against the property for a fifteen (15) years from the date of the loan closing. The assistance provided under this strategy will be forgiven on a pro -rata basis over a fifteen (15) year term, as long as the housing unit is owned and occupied by the initial applicant. If the property is rented, leased or sold during the fifteen (15) year period, then the pro -rata balance remaining on the original loan will become due and payable to the City of Miami at that time. If the property is not rented, leased or sold during the fifteen (15) years, the loan shall be release in full. In the event of death of all eligible homeowner(s), the heir to the property can assume the obligation of the original owner as long as the heirs are income eligible, remain owner -occupants of the property and do not sell or rent the property for the remaining term of the mortgage and note. E Leveraging The City of Miami will use Community Development Block Grant fiends as needed for eligible program expenditures. g. Strategy Implementation The City of Miami, Department of Community Development will be the primary agency responsible for carrying out this strategy under the Housing Assistance Plan and does not anticipate the use of a sponsor to carry out program activities. However, if the need for a sponsor should arise, the City of Miami will use a Request for Proposals process in accordance with State Rule 67- 37.005(6)b(7) Florida Administrative code to select an eligible sponsor. Eligible persons, sponsors or other recipients of assistance under this program will be required to contractually commit and comply with all SHIP Program requirements. 12 01. 37 0, 4d. SHIP Homeownership Development Program a. Strategy Description The SHIP Homeownership Program is designed to promote and create affordable homeownership opportunities for very low, low and moderate income families and individuals. SHIP Program funds reserved for this strategy will be used to assist not-for-profit and for profit housing developers or the City. SHIP funds reserved for this strategy will be utilized by the City of Miami to finance the project cost associated with land acquisition, site development, hard and soft construction financing and permanent financing associated with the development of affordable housing units by not-for-profit housing developers or the City. b. Strategy Period The strategy identified in this Section will be used to carry out the Local Housing Assistance Plan for State Fiscal Years 2001 — 2002, 2002 — 2003, 2003 — 2004. c. Income Category to be Served Available SHIP funds shall be reserved to assist affordable housing projects which will provide housing for eligible persons and households. To comply with the overall requirements under Title 67-37 of the Florida Administrative Code, thirty (30%) percent for persons or households who are very low-income. Another thirty percent (30%) of the SHIP funds must be reserved for persons or households who are low-income. The remaining SHIP funds will be used to assist persons and households who are moderate income. d. Selection Criteria SHIP funding under this strategy will be awarded through a competitive Request for Proposals (RFP) process. Through the City of Miami's solicitation, proposals will be received from for-profit and not-for-profit housing developers for the construction of new affordable housing units targeted for very low, low and moderate income families and individuals. All housing developers applying for financial assistance under the strategy will be awarded SHIP funding using criteria including, but not limited to the following: • Financial capacity and strength of the not-for-profit or for-profit housing developer; • Ability cf not-for-profit or for-profit housing developer to complete the housing project by the expenditure deadline requirements established by the SHIP Program and State of Florida; • Ability to document/demonstrate that construction will be underway within six (6) months from the date of funding award by the City; • Firm evidence of site control; 13 Qi- 370. • Document and/or identify other project financing from other public and/or private sources which would leverage financial assistance provided by the City at a minimum of one (1) to three (3) for homeownership projects as stipulated by Resolution No. 98-587; • Consistency with the City of Miami's Five Year Consolidation Plan (1999 — 2004) and SHIP Local Housing Assistance Plan (2001 — 2004). All recipients or households that will receive housing or assistance under this strategy once the housing project has been completed, must meet the eligibility requirements as stipulated in the Florida Statutes, the SHIP Program Ordinance, Resolution, the Plan and this strategy. Eligible housing types under this strategy includes single family homes, a townhouse or a condominium unit. The properties to be developed and purchased by the targeted households must be located within the corporate limits of the City of Miami. The non -for-profit or for-profit housing developer(s) must sell the newly constructed housing units to an eligible household on a first come first-served basis using the same criteria as described in the Homebuyers Financing Program previously enumerated in this Plan. • The following expenditures shall qualify and will be eligible under this strategy: 1. Those hard cost which are typical and customarily treated as construction cost by institutional lenders; 2. Construction staff costs such as architectural engineering studies and appraisals, if directly related to housing construction; 3. Infrastructure expenses typically paid by the developer; 4. Payment of impact and permitting fees. 5. Cost associated with land acquisition and site development. • A maximum of up to $40,000/unit in financial assistance may be received for housing projects assisted through this strategy. e. Recaptune provisions The financial assistance provided under this strategy to the developer may be provided as a low interest rate loan or in the form of a grant which will be determined based on the economic feasibility and affordability of the housing project(s) to be assisted with SHIP funds. The assistance provided under this strategy will be provided in the form of a construction loan at three — six (3% - 6%) percent and there will be no monthly payments associated with the loan during the construction phase. Once the developer has successfully completed the construction and all the housing units are 14 O1" 370 1 purchased and occupied by eligible homebuyers, the City of Miami will fully satisfy the developer's obligation to the City in connection with the financing of the project. Financial assistance made to the developer as a grant will also be satisfied upon completion of the construction phase and all the housing units have be marketed and occupied by eligible homebuyers. Financial assistance provided to a project in the form of permanent second mortgage financing for the homebuyers will be provided to eligible households based on the same criteria as described in the Homebuyers Financing Program Strategy as previously outlined in this Plan. Financing assistance to be provided under the SHIP Homebuyers Financing Program will be provided in the form of a zero (0%) percent, ten (10) year deferred payment loan secured by the property, that will be forgiven ten (10%) percent per year while the homeowner continues to own and occupy the property as their principal residence. There are no monthly payments associated with this loan. In the event the property receiving_ financial assistance is rented, leased or sold during the ten (10) year period, the pro -rata balance of the loan must be paid back to the City of Miami. In the event of death of all eligible homeowner(s), the heirs to the property can assume the obligation of the original owner as long as the heirs are income -eligible, remain owner occupants of the property and do not sell or rent the property for the remaining term of the mortgage and note. Homeowners who qualify and receive assistance must execute a Deferred Payment Loan Mortgage and Note that will be field with the Miami -Dade County Clerk of the Circuit Court for compliance with the recapture provisions of the program. C Leveraging The City of Miami will also use its Home Program funds from the U. S. Department of Housing and Urban Development to expand the availability of funding available to undertake the strategy thereby leveraging its SHIP funds. Under this strategy, private construction and permanent financing, in addition to financing from other public and private sector and private foundation sources such as Miami -Dade Housing Agency, Miami -Dade County's Housing Finance Agency, Fannie Mae, Federal Home Loan Bank of Atlanta, John S. and James L. Knight Foundation and Local Initiatives Support Corporation (LISC) will be leveraged to ensure that the housing to be constructed will be affordable to very low, low and moderate income families and individuals. g. Strategy Implementation The City of Miami, Department of Community Development will be the primary agency responsible for carrying out this strategy under the Housing Assistance Plan and does not anticipate the use of a sponsor to carry out program activities. LOCAL HOUSING INCENTIVE STRATEGIES On October 10, 1996, the City of Miami Commission adopted the City of Miami's Affordable Housing Incentive Plan (AHIP), in compliance with the Ordinance No. 11253, Resolution No.s 95- 188 and 95-305, Florida Administrative Code and Section 420.9076 of the Florida Statutes, based on the recommendations of the City of Miami's Affordable Housing Advisory Board. The Affordable Housing Incentive Plan as adopted, provides developers of affordable housing projects with a number of local incentives that are intended to expedite the pre -development process and reduce certain cost(s) in connection with the production of affordable housing projects in the City of Miami. The following incentives are available in the City of Miami: Incentive 1. Expedited Permitting for Affordable Housing Projects • Priority is given to affordable housing developments by expediting the permitting process. The City of Miami's Department of Community Development works closely with the Building Department in assisting developers through this process. Developers of affordable housing projects whose projects have been certified as affordable by the City of Miami's Department of Community Development are eligible for certain incentives that assist with expediting the permitting process. Prior to presenting the projects building plans to the Department of Building for the plan review process, developers are able to schedule a pre - construction meeting with the Department of Building. A pre -construction meeting is attended by a representative from each of the plan review sections. This meeting provides the developers with information and suggestions that will better prepare them for the plan revision process. Once the building plans have gone through the plan review process, developers can schedule a "Joint Review" meeting, also attended by a representative of each of the planning review sections, to address the comments made by the plan reviewers. This process can shorten the permit approval process by 15 days. There is no charge for this service to developers of certified affordable housing projects. Incentive 2. Review of Legislation, Policies and Plans that Impact Affordable Housing. The Department of Community Development conducts on-going review of actions being considered by the City of Miami's Planning Advisory Board, Zoning and Code Enforcement Boards and the City Commission that is being considered and may have an impact on affordable housing. 19 01-- 37001 Incentive 3. Impact Fee Wavier / Exemption • Affordable housing projects are exempted from the payment of Development Impact Fees as stipulated in Ordinance No. 10426, adopted April 25, 1998. The Department of Community Development is required to certify to the Department of Building that the proposed housing project(s) will be affordable low and moderate income families and individuals which results in the developer securing an exemption from the impact fees. This incentive is functioning as intended. Incentive 4. Interim Proprietary and General Services Fee Waiver / Exemption Affordable housing projects are exempted from the payment of proprietary in Ordinance No. 010705, adopted February 7, 1990. The Department of Community Development is required to certify to the Department of Building that the proposed housing project(s) will be affordable to low and moderate income families and individuals which results in the developer securing an exemption from the above mentioned fees. This incentive is functioning as intended. Incentive 5. Reduction of Parking and Setback Requirements Affordable housing projects are afforded an opportunity to receive a reduction in the parking by the City of Miami, as stipulated in Section 917.5 of Ordinance No. 110000. The Department of Planning and Zoning is responsible for facilitating this incentive for providers of housing affordable to low and moderate income. This incentive is functioning as intended. Incentive 6. Interim Proprietary and General Services Fee Waiver / Exemption • Affordable housing projects are exempted from the payment of construction debris removal fees as stipulated in Ordinance No. 11725, adopted November 17, 1998. The Department of Community Development is required to certify to the Department of Building that the proposed housing project(s) will be affordable to low and moderate income families and individua!s which results in the developer securing an exemption from the from the aforementioned fee. This incentive is functioning as intended. 20 01 370.1 SECTION VII. AFFORDABILITY a. Homeownership The gross annual household income limits, as established by the Florida Housing Finance Corporation, adjusted for family size, will be used to determine applicant eligibility for the program. (These limits are subject to change.) 2. The SHIP Program considers housing affordable when the monthly mortgage payments or housing debt including an allowance for taxes and insurance, do not exceed 30% of area median income adjusted by household size. SECTION VIII. ADVERTISEMENT AND OUTREACH a. Outreach Strategies 1. The City of Miami will use several outreach strategies to inform local residents of the SHIP resources available under the Local Housing Assistance Plan. Our goal will be ensure that residents have one or more avenues to access and receive information above the availability of program resources. The City of Miami has an existing back log of applicants who will be processed first based on the availability of SHIP funding. All additional outreach efforts will include advertisement in newspapers of general circulation to inform potential applicants that the City of Miami has a current backlog of applicants waiting for rehabilitation and homebuyer assistance. All applicants responding to the advertisement will be added to the end of the waiting list, and the assistance will be provided on a first-come first-served basis. The City's overall outreach efforts will include advertisement in newspapers of general circulation, flyers placed at strategic locations throughout the City including the Office of Workforce Development, Department of Community Development's Satellite Offices, various Neighborhood Enhancement Team (NET) Offices and offices of members of the Housing Partnership. Additional outreach will be carried out through programs on the City's Net Channel 9 (cable) and staff presentations at various homebuyer's seminars and community rrkeetings. b. Adveris--ment The City of Miami will publish an advertisement in English and Spanish outlining the availability of SHIP funds in a local newspaper of general circulation at least 30 days prior to the application period. All advertisements or flyers disseminated to the public will advise potential applicants that there is an existing backlog (waiting list) for assistance and all applicants who wish to participate under the program will be added to the end of the waiting on a first-come first -serve basis. 21 01- 370.1 SECTION IX. ADMINISTRATIVE EXPENSES a. Responsible Agency The City of Miami Department of Community Development will be primarily responsible for the implementation of the housing strategies. Staff functions include applicant intake, qualification and underwriting of homeowners and homebuyers, inspections, preparation of documents, and implementation of the strategy from commencement to project completion. b. (2) All SHIP funds will be expended in a manner which will insure that there will be no discrimination on the basis of race, creed, religion, color, age, sex, familial or marital status, handicap, or national origin. (3) A process for selection of recipients for funds has been developed. - (4) The eligible municipality or county has developed a qualification system for applications for awards. (5) Recipients of funds will be required to contractually commit to program guidelines. (6) The Florida Housing Finance Corporation will be notified promptly if the local government (or interlocal entity) will be unable to comply with the provisions the plan. (7) The Local Housing Assistance Plan shall provide for the expenditure of SHIP funds within 24 months following the end of the State fiscal year in which they are received. (8) The plan conforms to the Local Government Comprehensive Plan, or that an amendment to the Local Government Comprehensive Plan will be initiated at the next available opportunity to insure conformance with the Local Housing Assistance Plan. (9) Amendments to the approved Local Housing Assistance Plan shall be provided to the Corporation with in 21 days after adoption. (10) The trust fund shall be established with a qualified depository for all SHIP funds as well as moneys generated from activities such as interest earned on loans. (11) Amounts on deposit in the local housing assistance trust fund shall be invested as permitted by law. (12) The local housing assistance trust fund shall be separately stated as a special revenue fund in the local governments audited financial statements, copies of the audits will be forwarded to the Corporation as soon as available. 13) An interlocal entity shall have its local housing assistance trust fund separately audited for each state fiscal year, and the audit forwarded to the Corporation as soon as possible. 23 01- 370,1 Page 2 Certification (14) SHIP funds will not be pledged for debt service on bonds or as rent subsidies. Gimenez City Commission Meeting City Manager ENCLOSURES: of April 26, 2001 RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution approving the City of Miami's Local Housing Assistance Plan for period covering fiscal year 2001-2002, 2002-2003 and 2003-2004, required by the State of Florida for the City's continued participation in the State Housing Initiatives Partnership (SHIP) Program. BACKGROUND: In 1992, the William E. Sadowski Affordable Housing Act established the State Housing Initiatives Partnership (SHIP) Program, which is administered by the Florida Housing Finance Agency. SHIP Program funds are derived from set-aside allocations from documentary stamp levies on real estate transactions statewide. In 1995, the City of Miami became eligible to receive SHIP Program funding from the State of Florida and has received approximately $1.3 million to $1.9 million annually beginning with the State's Fiscal Year 1995-96. In order to receive funding through the State Housing Initiatives Partnership Program, each unit of local government participating in the SHIP Program must submit a Local Housing Assistance Plan to the State of Florida. The Local Housing Assistance Plan essentially outlines how the City proposes to utilize the funds received from the State of Florida through the SHIP Program. In September of 1999, with the adoption of Resolution No. 99-705, the City Commission approved the Administration's recommendation to modify the City's Local Housing Assistance Plan which enabled the City to expand the number of housing assistance programs which would be available to very low, low and moderate income eligible families within the City of Miami. The housing programs, which are being recommended for implementation over the next three (3) years are consistent with the City's Five (5). Year Consolidated Plan. As you are aware, the City's Consolidated Plan emphasizes a housing ' gti'ategy which focuses on increasing the availability of affordable homeownership opportunities to very low and low and moderate 01. 370' The Honorable Mayor and Members of the City Commission Page 2 income families through public/private partnerships between the City, Miami -Dade County, private and not-for-profit housing industry and private financial institutions. While the major focus of the City's efforts over the next five (5) years will emphasize a long term homeownership strategy for stabilizing the City's predominately residential neighborhoods through the establishment of seven (7) "Homeownership Zones", the need to insure that the City's existing housing stock remains safe, decent, sanitary and affordable to both owner - occupants and the elderly through various rehabilitation activities is also equally important. With the approval of the City's Local Housing Assistance Plan, the City's SHIP Program funds will be utilized to fund the following programs: Single Family Rehabilitation Program This Program will provide rehabilitation assistance to very low and low and moderate income persons that occupy and maintain their homes as their principal residence. Eligible homeowners will receive financial assistance in the form of a zero (0%) percent, ten (10) year deferred payment loan secured by the property, that will be forgiven ten percent (10%) per year while the homeowner continues to own and occupy the property. In the event the property receiving financial assistance is leased or sold during this ten (10) year period, the balance of the loan must be paid back to the City. In the event of the death of the eligible homeowner receiving the financial assistance and an income eligible heir(s) inherit the property during the ten (10) year term, the heir(s) will not be required to repay the pro -rata balance of the deferred loan, but will be allowed to assume the mortgage provided that the heir(s) becomes the owner -occupant. A maximum of up to $40,000 in financial assistance will be available under this strategy for homeowner(s) that reside and maintain the property as their principal residence. 2. Homebuyers Financing Program This Program will provide downpayment, closing costs or second mortgage financing assistance to qualified very low, low and moderate income persons, to assist in the purchase of newly constructed owner -occupied housing units developed by not-for-profit housing corporations, private sector developer(s) or the purchase of an existing residential property within the corporate limits of the City. Financial assistance provided will be in the form of a zero (0%) percent deferred payment loan secured by the property, P 01- 3'70.1 The Honorable Mayor and Members of the City Commission Page 3 and will be forgiven on a pro -rata basis of ten (10%) percent annually over a ten (10) year term, as long as the housing unit is owned and occupied by the homeowner. The financial assistance provided will be due and payable to the City of Miami if the property is leased, sold to a subsequent homebuyer or upon refinancing by the current homeowner. Any residential- owner -occupied property requiring rehabilitation under this strategy would have to be complete by the homeowner within twelve (12) months after the culmination of the home purchase. A maximum of up to $40,000 in financial assistance would be available to a homebuyer(s) that would reside and maintain the property as their principal residence. 3. Single Family Replacement Housing Program The Program is designed to address substandard and dilapidated housing units when the cost of rehabilitation is no longer economically feasible. Financial assistance through this Program would only be available to eligible homeowners who reside in homes where the most appropriate solution to their housing problem would be to demolish the existing home and replace it with a newly constructed housing unit. This strategy would be employed on a case by case basis, when the cost of rehabilitating the existing home exceeds the maximum amount of $40,000 available under then City's Single Family Rehabilitation Loan Program. The maximum amount of financial assistance available under this strategy inclusive of the cost of temporary relocation expenses, demolition of the dilapidated structure and construction of the new home shall not exceed $75,000. The assistance provided under this strategy will be forgiven on a pro -rata over a fifteen (15) year term, as long as the housing unit is owned and occupied by the initial applicant. If the property is rented, leased, or sold during the fifteen (15) year period, then the pro -rata balance,remaining on the original loan will become due and payable to the City of Miami at that time. If the property is not rented, leased or sold during the fifteen (15) years, the loan shall be release in full. In the event of death of all eligible homeowner(s), the heir to the property can assume the obligation of the original owner as long as the heirs are income eligible, remain owner -occupants of the property and do not sell or rent the property for the remaining term of the mortgage and note. 4. Homeownership Development Program The Homeownership Development Program is designed to increase homeownership opportunities for very low and low and moderate income persons by creating new affordable homeownership housing units in the City. SHIP Program funds utilized under this strategy for construction by the developer can be converted into downpayment, mortgage buydown or closing cost assistance to the prospective homebuyer of the newly constructed housing units. Housing projects assisted through this program can receive fmancial assistance up to $40,000/unit. In order to ensure the City's continued participation in the SHIP Program, City Commission approval of the attached Plan and resolution is recommended. Sadowski Affordable Housing, Act ("Sadowski Act"), which allocates a portion of new and existing documentary stamp taxes on deeds or real estate transactions to local governments for the development and maintenance of affordable housing; and WHEREAS, the Sadowski Act provides a dedicated revenue source for affordable housing and created the State Housing Initiatives Partnership ("SHIP") Program; and WHEREAS, in August, 1994, the City of Miami was notified by the State of Florida that the City would be eligible to receive ATTACHMENT (S) cm connnuOlt Pawn= or SER 2 no 10 $1,353,387 in SHIP Program funds beginning with the State's 1995-96 Fiscal Year; and WHEREAS, at the November 21, 1996 City Commission meeting, the City Commission through Resolution No. 96-851, approved the City's modified Local Housing Assistance Plan which outlines the City's strategy for the implementation of the SHIP Program for the period covering fiscal years 1995-1996, 1996-1997, and 1997-1998; and WHEREAS, at the April 14, 1998 City Commission meeting, the City Commission through Resolution No. 98-336, approved the City's Local Housing Assistance Plan which outlines the City's strategy for the implementation of the SHIP Program for the period covering fiscal years 1998-99, 1999-2000, and 2000-2001; and WHEREAS, currently the City's housing strategies under the SHIP Program is limited to the City's Homeownership Development Program and Downpayment/Closing Costs Assistance Program; and WHEREAS, currently through the City's Homeownership Development Program funds, can only be provided to certified Community Housing Development Organizations (CHDO's), and has precluded the private housing industry_ from securing SHIP Program funds, which could be utilized for the cost of land acquisition, site development, construction and permanent 01- 370.1 - 2 - financing associated with the development of affordable homeownership units in the City; and WHEREAS, currently through the City's Downpayment/Closing Costs Assistance Program, funds can only provided to qualified very low, low and moderate income households who desire to purchase an owner -occupied residential unit developed by a City of Miami certified Community Housing Development Organization (CHDOs); and WHEREAS, the City Administration has experienced difficulties in expending the SHIP Program funding within the two (2) year time frame mandated by the State of Florida due to the restrictions which are inherent in the City's current housing programs and strategies; and WHEREAS, the City of Miami has been cited by the State of Florida for its poor performance in the expenditure of its SHIP Program funds; and WHEREAS, in our effort to increase the City's SHIP Program expenditure rate, and while providing a variety of homeownership opportunities to very—low, low and moderate income families, the City's housing strategy in connection with the SHIP Program has been modified; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference 01- 3'70•I c � i thereto and incorporated herein as if fully set forth in this Section. Section 2. The City of Miami's revised Local Housing Assistance Plans for the period covering fiscal years 1995-1996, 1996-1997, 1997-1998 and 1998-1999, 1999-2000 and 2000-2001, attached hereto and made a part hereof, prepared pursuant to the implementation of the State of Florida's Housing Initiatives Partnership ("SHIP") Program in the City of Miami is hereby approved. The SHIP Program funds reserved for this strategy will be utilized by the City to carryout site acquisition activities, site development, construction and permanent financing to not-for- profit housing corporations and private developers, to assist with the development of homeownership units, affordable to very low , low and moderate -income families. Once construction has been completed, the SHIP Program funds will then be converted into permanent financing, downpayment, buy -down and/or closing cost assistance to the homebuyer of the newly constructed units. In order to qualify for financial assistance under this strategy, homebuyers must have received a commitment from a first mortgage lender for the purchase of the prospective residential unit. C. Owner-Orrujai ed Rehahi 1 i to i o rngram The Owner -Occupied Rehabilitation Program will provide rehabilitation assistance to very low, low and moderate income persons of owner -occupied single family residences with the City of Miami. Financial assistance will be provided in the form of a zero percent (0%), deferred payment loan secured by the property and forgiven on a pro -rata basis of ten percent—(10%) per year for a ten (10) year term, as long as the residential unit remains owned and occupied by the homeowner (applicant). Should the homeowner die and an income eligible heir inherit the property during the ten (10) year period, the heir will not be required to repay the pro -rata balance, but will be allowed to assume 01- 370.1 the mortgage provided that the heir becomes the owner-occupant. D. Sj nul Family Rt=p1 ar-PmPnt- Ho c;j n$ Pro ram The Single Family Replacement Housing Program will be utilized to replace dilapidated owner- occupied housing units which are not suitable for rehabilitation. A maximum of $65,000 per unit will be made available to construct a new housing unit on land owned by the existing homeowner (applicant) or on a vacant residential property that may be available and owned by the City or County. Financial assistance under this strategy will be made available on an as needed-basis, with priority given to households that do not have the financial means to secure a private mortgage loan for the full amount, but are able to secure partial financing through a first mortgage lender. Funds will be awarded as a zero (OU percent interest deferred loan for a period coinciding with the first mortgage loan term. The assistance provided under this strategy wpuld be due and payable to the City of Miami if the property is sold to a subsequent buyer or upon refinance by the homeowner. Should the homeowner die and an income eligible heir inherit the property during the term of the deferred mortgage, the heir will 01- 370#1 7 - not be required to repay the pro -rata balance, but would be allowed to assume the mortgage provided that the heir becomes the owner -occupant.
