WHEREAS, the Miami Zoning Board at its meeting of February 26, 2001, Item No. 1, following an advertised public hearing, adopted Resolution No. ZB 2001-0405 by a vote of nine to zero (9-0), denying a request for a variance from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 4, Section 401, to waive 45 of the required 128 off-street parking spaces as hereinafter set forth; and WHEREAS, the applicant has appealed the decision of the Zoning Board; and �ATTAt�9�'��T (s)� CONTAINED � On copampa Memo Cr APR 2 6 2001 P-Salu� J60.01- 360 WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding the decision of the Zoning Board, finds that the stated grounds for the appeal and the facts presented in support thereof do justify reversing the decision of the Zoning Board and granting of the variance; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Ms. Teresita Fernandez Executive Secretary City of Miami 444 SW 2"d Avenue Miami, FL 33131 RE: El Dorado Furniture Variance Request, Case No. 2000-0387 Dear Ms. Fernandez: We are writing to appeal the Zoning Board's decision to deny our variance request. The board failed to recognize our hardship. We stated that our hardship is the way in which the Zoning Code groups furniture showrooms with general retail for the purposes of determining the required parking spaces. There are two factors that distinguish the furniture showroom from general retail. The first is the frequency in which the merchandise is purchased and the second is the actual physical space which the merchandise occupies. The average family purchases furniture once every 4 years, whereas that same family visits the grocery store at least once a week. The amount of merchandise displayed on a square foot basis is much less for a furniture store than a grocery store. Presently, the parking requirements for the furniture showroom and the grocery store as dictated by your zoning code are the same. Other municipalities have acknowledged those differences and granted parking variances as an adjustment to their parking requirements. Miami -Dade County has gone as far as separating the furniture show room from retail. Miami -Dade County's parking requirements for furniture showrooms are as follows: 3 spaces for the first 2,500 square feet 1 space for each additional 500 square feet Under Miami -Dade County's requirements for our project, we would be required to provide 75 spaces. As a point of comparison, we are being asked by the City of Miami Zoning Code to provide 1 space for every 300 square feet for a total of 128 spaces. We are providing 83 parking spaces. We feel that the Zoning Board should have recognized the differences between a furniture showroom and a retail store and should have seen the code's failure to recognize that difference as our hardship. The economics of the project at 38,275 square feet will not work with less square footage. Other El Dorado facilities currently under construction are over 100,000 square feet. The possibility of a 2 -story facility has also been considered and is not economically feasible. Ground floor space out sells second floor space 3 to 1. The following findings have been made: • It is found that although the applicant is seeking to built a new furniture store building, the zoning code still requires parking ratios to comply with C-1 "Restricted Commercial' zoning designation. • It is found that the proposed structure will require a total of 128 parking spaces for which the proposed site only provides 83 spaces. • It is found that the proposed structure, as designed, may result in an overbuilding of the subject property, which will have an overall adverse impact on the neighborhood and adjacent properties due to additional parking demands having to be accommodated on adjacent local streets. • It is found that there is no hardship to justify the requested variance; there are an adequate number of properties located within nearby C-1 Restricted Commercial Districts to accommodate the growing business. • It is found that since this is new construction, it should be designed to comply with all zoning requirements, including parking. Based on these findings, the Planning and Zoning Department is recommending denial of the application as presented. The survey was performed during a storewide sale on Saturday, April 21, 2001 by an experienced traffic technician. The technician arrived just before 1:00 PM at the subject store to begin observations of the store's parking demand. It was noted that there are 24 spaces serving the 18, 303 square foot store. The survey ended at 4:00 PM. This time was pre -selected, as it is historically the peak time of day for customer arrivals according to the information you provided. Employees were asked to park off-site to make room, if needed, for customer traffic circulation and parking. There are usually seven (7) spaces used by store employees during the Saturday survey time. Snapshots (observations) of parking demand were taken every ten minutes and recorded over the three-hour study period. When the technician arrived, store customers were using three (3) spaces at 1:00 PM. At 3:40 PM, the maximum demand of five (5) spaces were recorded.
