A RESOLUTION OF THE MIAMI CITY COMMISSION, AFFIRMING THE RECOMMENDATION OF THE ZONING BOARD THEREBY GRANTING A SPECIAL EXCEPTION FROM THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, TO ALLOW PUBLIC RECREATIONAL FACILITIES, FOR THE PROPERTIES LOCATED AT APPROXIMATELY (I) 1338 AND 1360 NORTHWEST 3RD AVENUE, (II) 1330 NORTHWEST 2ND COURT AND (III) 308 AND 450 NORTHWEST 14TH STREET, MIAMI, FLORIDA, PURSUANT TO PLANS ON FILE AND SUBJECT TO A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED AND THE FOLLOWING CONDITIONS RECOMMENDED BY THE PLANNING AND ZONING DEPARTMENT: PRIOR TO THE ISSUANCE OF ANY BUILDING PERMITS THE PROPERTY OWNER SHALL SUBMIT A COMPLETE NEW LANDSCAPE PLAN ACCEPTABLE TO THE DEPARTMENT, INCLUDING, BUT NOT LIMITED TO, SUBSTITUTION FOR DEPICTED PALMS AND SHADE TREES. WHEREAS, the Miami Zoning Board at its meeting of February 26, 2001, Item No. 4, adopted Resolution No. ZB 2001-0412 by a vote of nine to zero (9-0), RECOMMENDING APPROVAL of a Special Exception requiring City Commission approval as hereinafter set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the Special Exception as hereinafter set forth; and 40= COI�RIS8IO�I i, 30MMG or z APR 26�2^001 7 . tla WHEREAS, the City Commission after careful consideration of this matter, finds the application for Special Exception does meet the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to affirm the recommendation of the Zoning Board and grant the Special Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The decision of the Zoning Board to recommend approval of a Special Exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, to allow public recreational facilities, for the properties located at approximately (I) 1338 and 1360 Northwest 3rd Avenue, (II) 1330 Northwest 2nd Court and (III) 308 and 450 Northwest 14th Street, Miami, Florida, legally described as shown in Exhibit "A" attached and made a part hereof, is affirmed, and the Special Exception is granted, pursuant to plans on file, subject to a time limitation of twelve (12) months in which a building permit must be obtained and the following conditions recommended by the Planning and Zoning Department: prior to the issuance of any 3 Page 2 of 3 building permits, the property owner shall submit a complete new landscape plan acceptable to the Department including, but not limited to, substitution for depicted palms and shade trees. ANALYSIS FOR SPECIAL EXCEPTION 1330 N.W. 2nd Court and 1338,1360 N.W. 3rd Avenue and 3089 450 N.W. 14th Street CASE NO. 2001-0415 Pursuant to Section 401 of Ordinance 11000, as amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed to allow public recrea- tional facilities in the PR Parks, Recreational and Open Space as follows: NOTE: This Special Exception for public recreational facilities requires City Commission approval. Roughly 400 people attended the meeting. approximately 150 Overtown residents registered their votes on the following referendum items: 1. Use Agreement with the City of Miami for the Overtown Academy and Community Center at St. Francis Xavier Catholic School to utilize a portion of Williams Park as their playground area. Amended to request the Overtown Academy and Community Center (St. Francis Xavier Catholic School) take full responsibility for the Williams Park swimming pool maintenance and ol,eration year round; open to the public during non -school hours. And Further amended to include that St. Francis Overtown Academy commit to dedicate 40(7( of their full tuition scholarships to Overtown students. (Item passed with 68% of 99 votes cast) 2. As so eloquently stated by Dr. Nelson Adams, the meetings resulted in a "Letter of Understanding" regarding concerns by church members such as: • The physical structure of the Youth Center facility and its impact on the view of the historic St. John's church; • The prograninthtg of the Youth Center and its influence on area children; • The appropriate security during hours of operation complete with adequate lighting. • And finally, the level of commitment by the principals, Mr. Marguelis and Mr. Mourning, as it relates to the operation of the facility. These are reasonable questions and deserving of an answer. Through several meetings involving the different entities, all were asked and all were answered. Ultimately, this will lead toward a "good neighbor" relationship with open communication. It is apparent that community harmony regarding this issue is restored. Although the citizens were not asked to vote on the zoning issue, the referendum item passed with a 98% favorable vote. But before this item starts, I want to make a couple of very important points. Number one, this item is currently before the City Commission on a zoning issue. The zoning issue is simply to redesignate the land use from what to what? Who's the Zoning -- who's the Planning representative here? Who's the Parks representative here? Who's the lawyer for the Heat here, for the Marguelis here? Unidentified Speaker: Special exception. Commissioner Teele: It's a spacial exception. A special exception zoning requires a vote of the Commission. Any Commissioner who meets with someone on a zoning matter and- says ndsays how they're going to vote has violated the law. I'm going to say that again. Any Commissioner who meets with someone and announces after that private meeting how they are going to vote has violated the law. The law is the Jennings law. And a Commissioner is a judge on zoning matters. That's a quasi-judicial matter. Zoning is different from Commission. That is when you stand up and raise your right hand -- When we go into zoning, we're no longer Commissioners. We're judges. And it's our job to be fair and impartial. The law further says that you may not have ex parte communications -- that is one-on-one communications -- with people about a zoning matter. Any Commissioner who gave a commitment on how they're going to vote, in my judgment, has done a disservice to the institution of the City government, and has done a disservice to the people who want to be heard. And even though I have said to anyone who will listen to me privately and publicly, including the board of the St. John's Church, with at least 40 people present, that I'm open to anything they have to say or anything anyone else has to say. It is my judgment that the project is a very good project, and I'm not prepared to say how I'm going to vote on something. Now, the Mayor, just so that you know this, doesn't vote. So he can (indicating) all he wants to, and keep as much stuff going as much as he wants to. OK? But I'm going to tell you something. Anybody who says that Arthur Teele has said he's going to vote against something is a categorical liar. And anyone who said that I said I was going to vote for something is also a liar. What anyone can tell you is this: The land that we're talking about was owned by the CRA. That's the other board. I made the motion to transfer the land from the CRA to the City for the purpose of allowing the Marguelis Project to go forward. I want to say that again. The land was owned by the CRA. In November or October of last year, I made the motion to transfer the land on Gibson Park to the City, so that the City could enter into an agreement. The only issue that I have discussed publicly is the issue that I want to say here and now. Anybody who comes in and makes a commitment to Overtown needs to be prepared financially to back it up, not today, but two years, five years from now, when the heat of the moment is gone. You all know better than I do that Miami -Dade Community College came in here and promised dah-dah-dah. Every kid was going to have an -- a health record. Remember? That every kid was going -- that we were going to have every kid in Overtown inoculated, that there was going to be this Overtown initiative. Where is that program? There was somebody else who came in and promised that every kid who finished high school was going to get a college scholarship. Where are those people? OK? So the whole issue that I've raised is one issue. And if a white man, or a black man or a Cuban is offended that I raised the issue, I apologize, but I'm going to do it again. Put up a trust fund to ensure the operation of the center for at least six months, so that if you change your mind, or somebody gets traded, or somebody changes where they're going that one day, we don't all see a big sign saying "closed," because the City of Miami does not have the money or the budget to walk in next day and start running a program. That's just good business management. I want to say publicly that I think Alonzo Mourning is one of the greatest athletes to ever come to Miami, and this City is blessed to have him here. And we ought to pray for him, and we ought to pray for the Heat, and we ought to pray that Mourning stays here forever. But none of us are going to be here forever. I have voted "yes" three times. But I have tried to defend you by saying I want a trust fund, a reserve of two hundred thousand dollars ($200,000), which is about half of what they estimate it costs to run this for one full year, put in a trust fund, put in reserve. They can -- they can have their lawyers handle it, so that if the Overtown developers change their mind, God forbid, or if they get transferred, or have a second change of heart, or something else comes up that we don't all run out and start blaming each other. The first thing everybody is going to say is, "Well, why did Teele let him do it?" You know it and I know it. I'll be the one blamed. "Well, why can't y'all open it up?" The City doesn't have the money to run -- if we had money, we'd keep the pools open more. That's what I'd do. I would have the pools open more. So I want to clear the air on this issue. I have said to Reverend Nevins, I have said to the chairman of the board that I would hope that you all could work together. But I've also said to them I will never, ever take public exception with anyone personally who is doing what they think to be the right thing. And Reverend Nevins, you and your board know I've not made any statements out of deference to St. John's, an institution that has been here for 80 years. And they are entitled to some modicum of respect in this process. That doesn't mean they ought to have their way. That doesn't mean they shouldn't have their way. I'm not taking sides on that. I'm taking the stance on one thing. If we don't learn to respect each other, nobody is going to come in here and respect us. And we can disagree, we can disagree with each other, but we've got an obligation, a moral obligation to be agreeable with each other. And so all I've said to St. John's, this is a difficult issue, and I would hope and pray that you could see it the way I believe it ought to be. But I will never take exception and criticize you, or to call you names, or to do that. And that goes for everybody in this room. And if anybody were building a hotel on Brickell Avenue, the whole Commission would do exactly what we did if the homeowners all came down and said, "We don'.- want it." We'd say, "Hold it, stop. You all go out and talk about it." That's the only thing we've done. As Commissioner Teele has indicated, this is, what we feel, a very important project that will bring something very positive to the community of Overtown. I'd like to also say that I have been a resident of Overtown for about 17 days now. I just got there. I just got an apartment in Overtown. But since Alonzo has been in Miami, since he first set foot in Miami, he had a vision. And when it was determined that he was going to be in Miami for a long time to come, he shared that vision with me. And just so you will know, I am the person who is behind the scenes making sure that vision becomes a reality. And Alonzo wants to do everything he can for this community. He believes in Miami. He believes in the people. He believes in the community. And so with that, we don't want to take too much of your time, but we would like to explain the merits of the Overtown Youth Center. First, I want for Al Dotson to -- Al Dotson, Jr. -- I'm sorry -- to go through the points of the center, and explain them in detail, so everyone will understand. Then I have a few things that I want to share with you in regards to the issue that or the items that the Commissioner brought up, and we will take whatever questions you have and be more than happy to answer them. Mr. Dotson: Thanks, Andre. First of all, let us clarify one thing. The Overtown Youth Center and the principals behind the Overtown Youth Center are not in opposition to, do not have any issues with anyone. We've had a wonderful opportunity over the past two years to dialogue both with the community residents as well as St. John's and their leadership, and Commissioner Teele, to hear your issues. From that dialogue, an agreement was reached between the City of Miami and the Overtown Yout'. Center. And that agreement requires a couple of things I just want to point out here this afternoon, I think, and that is that Marty Marguelis and Alonzo Mourning, and the Overtown Youth Center have guaranteed the funds that are required to construct that facility. But more importantly, and in addition that -- and that's without any public or City funds. In addition to that, they have in their agreement agreed to continuously operate that center throughout the entire term of their lease. And to make sure that the City, and the City Manager, the Overtown Advisory Board and the residents of Overtown are comfortable with their ability to meet that commitment, the City has required that on an annual basis, we submit a plan that shows our complete operating budget, our revenues, but more importantly, the source of our revenues, so they could make sure that that center could continue to operate. But in EK 11 OVERTOWN--TOWN HALL MTG.-- REFERENDUM ITEM 5 01- 357 ROUGH DRAFT addition to that -- and that goes to one of the points that Commissioner Teele raised -- it was explained to us that it would take approximately six months if there was a need to transition to a new operation, operational funding for the center. And Alonzo Mourning, without hesitation, said "We'll make sure that that reserve is in place." Commissioner Teele: Yes, he did. City Clerk Mr. Dotson: Now, it has been your input that has allowed Andre Napier and the Overtown Youth Center to develop the programs for that center. I'm going to let Andre talk about some of the programs, and then we would like to hear from St. John's, as well. Commissioner Teele: The public, yes. Mr. Napier: OK. First of all, let's talk about the fact that this center will be a state of the art youth center. As many of you know, a lot of the children who are living in Overtown, grew up in Overtown may not have the opportunities and the resources that other kids throughout the City of Miami and throughout the nation may have. We feel like at this center, we can provide those resources, those very needed resources. Not only athletic resources, which is what people have been talking about. We will have athletic resources. We will have gyms. We will have locker rooms, showers. We will have all of those things. But also the educational resources, because those are important in today's society. It is important that we give our children the tools that they need to succeed. (APPLAUSE) Mr. Napier: So, of course, we will have a computer room. But we won't just have a computer room. And if you've been to some community centers, they're doing the best they can in a lot of ways, and they're not able to provide first class computers. I used to teach a computer class when I was in college, and I probably taught on the very first computers made, because they didn't have the resources to teach with the latest equipment. We will have the latest computer equipment available. Unidentified Speaker: All right. Mr. Napier: We will have the latest internet technology, the latest software, all of the things that we feel like kids should have to be competitive in today and tomorrow's EK 12 OVERTOWN--TOWN HALL MTG.-- REFERENDUM ITEM 5 01— 357 ROUGH DRAFT society, so when they go to these jobs, they won't be intimidated because they see a computer. They won't be intimidated if someone asks them how to run a program, because they will know that already. They may be able to -- and if we do this right -- to tell someone how that program was designed and created. And that's the type of thing that we think we can equip our kids with. There will be tutorial programs for kids who are having problems in school, or who just want to do better. Life Skills Program. Life Skills Program. How to balance a checkbook, how to present yourself at work on a daily basis, how to go after the things that you want in life. All of those things are important, and we want to reinforce that in this center. We want to talk about career opportunities in the center, the arts, and culture. A lot of times, a lot of us -- at least when I was growing up, I'll say me -- don't know all of the wonderful things about our history, the wonderful things about where we've come from. And I think that at this center, that should be a focal point. The history of Overtown, the history of Miami, the history of the nation, the history of Africa, those are all things that we can reinforce in this center. Those are important things. Now, the next point is key. We will have a comprehensive volunteer program. Now, that's important, because we need your help for that. We need the input and the time of the community, the community of Miami -- more importantly, the community of Overtown -- to come in and help us with these kids. We're not talking about a lot of time. Two hours a month, if everybody in this room gave two hours a month to spend time and to help tutor with these kids. We need coaches. We need referees. We need teachers. We need instructors. This is a community project, and I think that's something that has not been discussed enough. No one is coming to Overtown, putting in a building and telling you how to raise your kids. That's not going to happen. The community is going to work with this center. The community at large is going to work with this center for the kids and on behalf of the kids in Overtown to make the community a better place. And that's what this project is all about. Two other points that Commissioner Teele was good enough to bring up. One, obviously, Attorney Dotson has mentioned Alonzo, without hesitation, has guaranteed that there will be a reserve. And so we've already talked about That. The second one that you mentioned was the St. John's, and obviously, they are our next door neighbor. And with that, I'd like to -- it's my pleasure, actually, to bring up the chairman of the St. John's Board of Trustees, Dr. Nelson Adams. And I'd also like to recognize Brother Dorsett, chairman of the Board of Deacons, and Pastor Nevins, as well. I'm sorry. Pastor Nevins. Dr. Adams: Thank you so much, Mr. Napier. And I'm not the Chairman of the Board of Trustees at St. John. But a little bit about me. I was born in Overtown. I did attend Phyllis Wheatley, and I'm a graduate of Miami Jackson High School. I've been a life long member of the historic St. John's Baptist Church, a 95 year old institution. I serve as the chairman of its Community Development Corporation. I'm on the Board of Trustees. And our chairman of the Trustee Board is Deacon Dorsett. I'm also a deacon at St. John's Baptist Church, and very committed to the community. A little bit of history. At a Commission meeting a few weeks ago, the pastor of the church made reference to discussions with elected officials and staffers from the City of Miami as it related to the property that the Overtown Youth Center has plans to build on. Though there is no written record, let me publicly say that discussions were had, and that the church has always been very interested in that property. The record needs to reflect very clearly that the church is committed to youth and committed to the building of such a structure in Overtown. The issues raised by Pastor Nevins on that day, however, did two things. One, it has created an opportunity for the issues as it relates to this youth center to be discussed openly. Commissioner Teele: Yes. Dr. Adams: And secondly, it has allowed for there to be dialogue with the principals and the membership and elected officers at St. John's Baptist Church. It has been a rallying point throughout the City. On Monday night, I had the pleasure of attending a meeting that -- Vision of Victory -- 800 -plus people there. One of the rallying points was, "What's good for Overtown?" This audience today speaks volumes. The meeting the other night -- the other day at 3 o'clock speaks volumes in terms of the commitment to doing something good in Overtown. Let me share these things with you. And first, let me say this: There's nothing better than a good understanding. Commissioner Teele: Amen. Dr. Adams: The purpose of all of this and all that's gone on over the last few weeks is for us to get a good understanding. I think now we have achieved that. Sor,Le of the questions that we had at St. John's were the following: The physical structure of the proposed center, how it might impact on our church, how close it might be, how tall it might be. Would it obstruct the view of, yes, that historic structure? Those questions have been answered. Program. We heard a little bit from Andre Napier just now in terms of some of the programs. But, you know, not all things that happen in centers are what church folk feel are appropriate things. And Mr. McKnight, so capable in his leadership in this community made me acutely aware of that in a conversation I had with him the other night. But security has been a concern. What happens when there's a gymnasium built next door to your church, and another building that is for arts and education? What happens as it relates to security? What are the hours of operation? Will there be adequate lighting? Those kinds of questions were asked and have been answered. Lastly, commitment. And Commissioner Teele has made it very clear that he, too, was concerned about whether or not there was a commitment on the part of these principals, Mr. Marguelis and Mr. Mourning, as it relates to the operation of this facility. We'd hate for it to be here today and gone tomorrow. So that commitment has been addressed, and the church feels fairly comfortable with that. They have, indeed, promised us, the members of St. John, to be a good neighbor. Al Dotson, Andre Napier, I hold in high esteem. They have given their personal commitment. And Mr. Marguelis has met with us. We have met twice now as the church and the principals to get a better understanding. We've created a Letter of Understanding between the parties. And Commissioner Teele and my Overtown family, I'm pleased to say that the St. John's Baptist Church supports -- (APPLAUSE) Dr. Adams: I don't think you heard me. Additionally, the Overtown Youth Center, will be used as a model for other centers in inner city communities. How can this center be the focus of a civic and political fight? And, how can we allow bickering to divert our attention from the bigger picture - nurturing, educating and building a positive foundation for youth. I implore you and the entire City of Miami commission, as well as those who oppose the center to take a brief moment to reflect on what is lost when our children are denied. It is also my prayer that you will take every step to assure ground is broken on the Overtown Youth Center.
